SAGHIR AHMAD\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t    WITH<br \/>\n\t\tCIVIL APPEAL NO.1825 OF 1986<br \/>\n\t\t\t O R D E R<br \/>\nCA NO.472\/86:\n<\/p>\n<p>     This appeal  by special  leave arises from the judgment<br \/>\nof the\tDivision Bench\tof the Allahabad High Court, made on<br \/>\nNovember  6,  1985  in\tCivil  Miscellaneous  Writ  Petition<br \/>\nNo.10982\/85.\n<\/p>\n<p>     The admitted facts are that the appellant was appointed<br \/>\nas Headmistress\t of Junior  High School,  Kamla Nehru  Kanya<br \/>\nVidyalaya, Shiv\t Shankari  Dham\t Pachewara  Chunal  Mirzapur<br \/>\nwhich was  upgraded  in\t July,\t1982  as  High\tSchool.\t The<br \/>\nManaging Committee  advertised through\tnewspaper under\t the<br \/>\nU.P. Intermediate  Education Act,  1921 for selection of the<br \/>\ncandidates, obviously, under Section 16-E. The committee had<br \/>\nselected  the\tappellant  on  December\t 17,  1983  and\t the<br \/>\nappellant was  sought to be ratified. Since the ratification<br \/>\nwas not\t accorded by  the District  Inspector, the appellant<br \/>\nhad approached\tby the\tHigh Court.  The High  Court relying<br \/>\nupon its earlier decision in Jai Prakesh Sharma vs. State of<br \/>\nU.P. &amp;\tOrs. [WP  No.174\/85] dismissed\tthe  writ  petition.<br \/>\nThus, this appeal by special leave.\n<\/p>\n<p>     Though the\t High Court  may not be correct in following<br \/>\nits judgment  in dismissing  the writ  petition, on facts we<br \/>\nfind that  there is no substantial difference in the result.<br \/>\nThe admitted  position is  that the U.P. Secondary Education<br \/>\n(Services Commission)  Act, 1982,  had come  into force with<br \/>\neffect from  July 14,  1981. Section 10 of the Act specifies<br \/>\nthe purpose  of making\tappointment to the posts of teachers<br \/>\nspecified in the Schedule. It postulates thus:\n<\/p>\n<blockquote><p>     &#8220;(1) For  the   purpose  of  making<br \/>\n     appointment of  a teacher specified<br \/>\n     in\t the  Schedule,\t the  management<br \/>\n     shall notify  the\tvacancy\t to  the<br \/>\n     Commission\t in   such  manner   and<br \/>\n     through such  officer or  authority<br \/>\n     as may be prescribed.\n<\/p><\/blockquote>\n<blockquote><p>     (2)  The procedure\t of selection of<br \/>\n     candidates for  appointment to  the<br \/>\n     posts of  such  teachers  shall  be<br \/>\n     such as may be prescribed:<br \/>\n     Provided that the Commission shall,<br \/>\n     with a  view to  inviting\ttalented<br \/>\n     persons, give wide publicity in the<br \/>\n     State  to\tthe  vacancies\tnotified<br \/>\n     under sub-section (1).&#8221;<\/p><\/blockquote>\n<p>     It is, thus, clear that Section 10 envisages two steps,<br \/>\nnamely, every  institution is  enjoined\t to  notify  to\t the<br \/>\nCommission the\tvacancies through  such officer or authority<br \/>\nas  may\t  be  prescribed.  The\tService\t Commission,  before<br \/>\nselection, will give wide publicity by inviting applications<br \/>\nfrom all  qualified candidates\tso that\t talented candidates<br \/>\nwould apply  for get  selected\tto  the\t post.\tThough\tthis<br \/>\nSection has  been amended  by Amendment\t Act 12 of 1985, the<br \/>\nsame is not relevant and has no application to this case. It<br \/>\nreads as under:\n<\/p>\n<blockquote><p>     &#8220;Notwithstanding  anything\t to  the<br \/>\n     contrary\t contained     in    the<br \/>\n     Intermediate Education Act, 1921 or<br \/>\n     the Regulations made thereunder but<br \/>\n     subject  to   the\t provisions   of<br \/>\n     Sections 18,  21-B, 21-C.\t21-D, 33<br \/>\n     and 33-A on or after July 10, 1981,<br \/>\n     be made  by the  management only on<br \/>\n     the    recommendation     of    the<br \/>\n     Commission;\n<\/p><\/blockquote>\n<blockquote><p>     (b)  every appointment of a teacher<br \/>\n     specified in  the Scheduled, shall,<br \/>\n     on or  after July\t1, 1981, be made<br \/>\n     by\t the   management  only\t on  the<br \/>\n     recommendation of the Board.&#8221;<\/p><\/blockquote>\n<p>     Thus, it  could be seen that after coming into force of<br \/>\nthe said  Amendment Act,  the power  of\t the  Management  to<br \/>\nconstitute a  Selection Committee  under Section 16-E of the<br \/>\nU.P. Intermediate  Act has  been  taken\t away.\tInstead\t the<br \/>\nselection has  to be  made only through the Commission under<br \/>\nthe Act and the selected candidate shall be appointed on its<br \/>\nrecommendation and  in no other manner. The selection by the<br \/>\nSchool under Intermediate Education Act, 1921 is illegal.\n<\/p>\n<p>     Learned counsel  for the  appellant has sought to place<br \/>\nreliance on  Section  33-A  of\tthe  Regulation\t made  under<br \/>\nSection 16-E of the U.P. Intermediate Act to regularise such<br \/>\nad hoc\tappointments. Undoubtedly,  every  teacher  directly<br \/>\nappointed before  the commencement  of\tthe  Act,  in  other<br \/>\nwords, on  ad hoc basis, against the substantive vacancy may<br \/>\nbe regularised\tunder Section 33-A; but it cannot be used as<br \/>\na routine.  It is  mandatory for the management to notify to<br \/>\nthe Commission\tand in\tcase the  Commission  is  unable  to<br \/>\nrecommend the  selected candidates within a reasonable time,<br \/>\nany candidate  appointed on  ad hoc  basis will be deemed to<br \/>\nhave been appointed in substantive capacity. The resourse to<br \/>\nSection 33-A  should be made sparingly and not as a routine.<br \/>\nIf Section  33-A route\tis adopted  as a routine, the entire<br \/>\nprocess of  Selection contemplated  under the  Act would  be<br \/>\ngiven a\t decent burial\tand illegal  appointment would\tgain<br \/>\nlegitimacy. Under  these circumstances, we do not think that<br \/>\nthe counsel  is right in contending that the appellant could<br \/>\nbe regularised under Section 33-A of the Regulation.\n<\/p>\n<p>     The appeal is accordingly dismissed. No. costs.<br \/>\nCA NO.1825\/86:\n<\/p>\n<p>     The appeal\t having become infructuous, is dismissed.
