PRAKASH TATIA, J.\n<\/pre>\n<p>Mr.Parikshit Nayak, for the appellant.<br \/>\nMr.Anil Bachhawat, for the respondent no.2.<\/p>\n<p>     Heard learned counsel for the parties.<\/p>\n<p>     The appellant is aggrieved against the low award of<\/p>\n<p>the compensation vide award dated 18th March, 2008<\/p>\n<p>passed by Motor Accident Claims Tribunal, Banswara in<\/p>\n<p>claim case No.180\/2007.\n<\/p>\n<p>     Learned counsel for the appellant submitted that the<\/p>\n<p>tribunal accepted the income of the appellant to be<\/p>\n<p>Rs.8,000\/-    per   month.   The    medical     board     of    the<\/p>\n<p>Government Hospital certified permanent disability of the<\/p>\n<p>claimant as 43%.      That has also been accepted by the<\/p>\n<p>tribunal and monthly loss of the income to the claimant was<\/p>\n<p>assessed Rs.3440\/- per month but has has been reduced by<\/p>\n<p>the tribunal on the plea that the appellant-claimant was<br \/>\n                                                    SBCMA No.702\/2008<br \/>\n                                      Indeer Mal Vs. Mohd. Yakub &amp; Ors.\n<\/p>\n<p><span class=\"hidden_text\">                                2<\/span><\/p>\n<p>doing agricultural work with the help of servants. It is<\/p>\n<p>submitted that the agricultural operation cannot be done by<\/p>\n<p>one person and he is required to engage number of labours<\/p>\n<p>for agricultural operation.     It is submitted therefore, the<\/p>\n<p>reduction of 50% of the loss of income of the appellant is<\/p>\n<p>absolutely illegal and contrary to the facts of the case by<\/p>\n<p>adopting principle laid down by the Hon&#8217;ble Supreme Court<\/p>\n<p>in another set of facts of the case. It is also submitted that<\/p>\n<p>in a case when the property passes on to the claimants they<\/p>\n<p>are not denied the compensation on account of loss of<\/p>\n<p>income.\n<\/p>\n<p>      Learned   counsel   for       the   respondent       Insurance<\/p>\n<p>Company contested the appeal and supported the reason<\/p>\n<p>given by the tribunal and pointed out that the tribunal was<\/p>\n<p>of   the   view that   the medical        board&#8217;s report      is   not<\/p>\n<p>corroborated by the injury report as there are differences of<\/p>\n<p>injuries in medical report and medical board&#8217;s certificate.<\/p>\n<p>      I considered the submissions of learned counsel for<\/p>\n<p>the respondent on this count also and found that in the<\/p>\n<p>medical report doctor specifically mentioned his opinion on<br \/>\n                                                    SBCMA No.702\/2008<br \/>\n                                      Indeer Mal Vs. Yakub &amp; Ors.\n<\/p>\n<p><span class=\"hidden_text\">                                  3<\/span><\/p>\n<p>the   basis   of   clinical   examination   and    mentioned       the<\/p>\n<p>possibility of fracture. In clinical examination the doctor can<\/p>\n<p>only advise for further examination by obtaining X-ray<\/p>\n<p>report etc. Therefore, that cannot be said to be a vague<\/p>\n<p>medical report given by the doctor, who clinically examined<\/p>\n<p>the patient.       In this case, the certificate given by the<\/p>\n<p>medical board from the Government Hospital cannot be<\/p>\n<p>ignored and when the medical board has certified that<\/p>\n<p>appellant suffered 43.5% permanent disability, which has<\/p>\n<p>been accepted by the tribunal itself, cannot be rejected for<\/p>\n<p>any other purpose.       The income which has been accepted<\/p>\n<p>by the tribunal, cannot be rejected now when that has not<\/p>\n<p>been challenged by anybody. The reduction out of the loss,<\/p>\n<p>which claimant sought to the extent of 50% cannot be<\/p>\n<p>justified and, therefore, the reduction is set aside. It is held<\/p>\n<p>that the appellant suffered loss of Rs.3440\/- per month on<\/p>\n<p>account of injuries he suffered because of the disability of<\/p>\n<p>43%.\n<\/p>\n<p>       In view of the above reason, the compensation<\/p>\n<p>amount on this count is enhanced to Rs.3,30,240\/- which is<br \/>\n                                                              SBCMA No.702\/2008<br \/>\n                                                Indeer Mal Vs. Mohd. Yakub &amp; Ors.\n<\/p>\n<p><span class=\"hidden_text\">                                            4<\/span><\/p>\n<p>              rounded to Rs.3,30,250\/-. On this enhanced amount, the<\/p>\n<p>              appellant shall be entitled to interest @ 6% per annum from<\/p>\n<p>              the date of filing of the claim petition.
