BASANT, J.\n            -------------------------------------------------\n                     B.A. No. 2449 of 2008\n            -------------------------------------------------\n           Dated this the 11th day of April, 2008\n\n                               ORDER\n<\/pre>\n<p>      Application for anticipatory bail. The petitioner faces<\/p>\n<p>indictment in a prosecution under the Kerala Abkari Act.        The<\/p>\n<p>petitioner was not arrested at the crime stage or thereafter.<\/p>\n<p>Investigation is complete. Final report has already been filed.<\/p>\n<p>Cognizance has been taken. Committal proceedings has been<\/p>\n<p>registered. Reckoning the petitioner as an absconding accused,<\/p>\n<p>coercive processes have been issued against the petitioner.<\/p>\n<p>The petitioner apprehends imminent arrest in execution of<\/p>\n<p>such processes.\n<\/p>\n<p>      2. According to the petitioner, he is absolutely innocent.<\/p>\n<p>His absence earlier was not wilful or deliberate.               The<\/p>\n<p>petitioner, in these circumstances, wants to surrender before<\/p>\n<p>the learned Magistrate and seek regular bail. The petitioner<\/p>\n<p><span class=\"hidden_text\"> B.A. No. 2449 of 2008          -: 2 :-<\/span><\/p>\n<p>apprehends that his application for regular bail may not be<\/p>\n<p>considered by the learned Magistrate on merits, in accordance<\/p>\n<p>with law and expeditiously. It is, in these circumstances, that<\/p>\n<p>the petitioner has come to this Court for a direction to the<\/p>\n<p>learned Magistrate to release him on bail when he appears<\/p>\n<p>before the learned Magistrate.\n<\/p>\n<p>       3. After the decision in Bharat Chaudhary and another<\/p>\n<p>v. State of Bihar (AIR 2003 SC 4662), it is by now trite that<\/p>\n<p>powers under Sec.438 of the Cr.P.C. can be invoked in favour of<\/p>\n<p>a person who apprehends arrest in execution of a non-bailable<\/p>\n<p>warrant issued by a court in a pending proceedings.     But even<\/p>\n<p>for that, sufficient and satisfactory reasons must be shown to<\/p>\n<p>exist. I am not persuaded, in the facts and circumstances of this<\/p>\n<p>case, that any such reasons exist.\n<\/p>\n<p>      4.   It is for the petitioner to appear before the learned<\/p>\n<p>Magistrate    and   explain   to    the  learned Magistrate   the<\/p>\n<p>circumstances under which he could not earlier appear before<\/p>\n<p>the learned Magistrate. I have no reason to assume that the<\/p>\n<p>learned   Magistrate    would    not    consider the  petitioner&#8217;s<\/p>\n<p>application for regular bail on merits, in accordance with law<\/p>\n<p>and expeditiously.    No special or specific directions appear to<\/p>\n<p>be necessary. Every court must do the same. Sufficient general<\/p>\n<p><span class=\"hidden_text\"> B.A. No. 2449 of 2008         -: 3 :-<\/span><\/p>\n<p>directions on this aspect have already been issued in the decision<\/p>\n<p>reported in <a href=\"\/doc\/147290035\/\">Alice George v. Deputy Superintendent of Police<\/a><\/p>\n<p>(2003 (1) KLT 339).\n<\/p>\n<p>     5. In the result, this application is dismissed; but with the<\/p>\n<p>observation that if the petitioner surrenders before the learned<\/p>\n<p>Magistrate and seeks bail, after giving sufficient prior notice to<\/p>\n<p>the Prosecutor in charge of the case, the learned Magistrate<\/p>\n<p>must proceed to pass appropriate orders on merits and<\/p>\n<p>expeditiously &#8211; on the date of surrender itself. Needless to say,<\/p>\n<p>the application for bail will have to be considered in the light of<\/p>\n<p>the decision in <a href=\"\/doc\/1158859\/\">Sukumari v. State of Kerala<\/a> (2001 (1) KLT 22).<\/p>\n<p>                                          (R.
