{"id":134177,"date":"2011-03-11T00:00:00","date_gmt":"2011-03-10T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/bharat-yadav-vs-the-state-of-bihar-on-11-march-2011"},"modified":"2016-12-29T17:38:00","modified_gmt":"2016-12-29T12:08:00","slug":"bharat-yadav-vs-the-state-of-bihar-on-11-march-2011","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/bharat-yadav-vs-the-state-of-bihar-on-11-march-2011","title":{"rendered":"Bharat Yadav vs The State Of Bihar on 11 March, 2011"},"content":{"rendered":"<div class=\"docsource_main\">Patna High Court &#8211; Orders<\/div>\n<div class=\"doc_title\">Bharat Yadav vs The State Of Bihar on 11 March, 2011<\/div>\n<pre>           IN THE HIGH COURT OF JUDICATURE AT PATNA\n                           Cr Misc No 5231 of 2011\n           Bharat Yadav, son of late Mahadeo Yadav, resident of village -\n           Basantpur, P S - Sathi, District - West Champaran    -       Petitioner\n                                     Versus\n           The State of Bihar                                   -       Opposite Party\n                                    -----------\n<\/pre>\n<p>2   11.03.2011                  The petitioner was on bail in Balthar Police Station Case No<\/p>\n<p>                 28 of 2000 which was instituted under the provisions of the Arms Act.<\/p>\n<p>                 Petitioner has been absent from the proceedings for about four years and<\/p>\n<p>                 was arrested by the Police on 04.10.2010 and since then he is in jail.<\/p>\n<p>                 Learned counsel for the petitioner points out that the learned Sessions<\/p>\n<p>                 Judge has referred to a communication from this Court to deny him bail.<\/p>\n<p>                 The said communication appears to be a letter dated 21.01.1983 sent by<\/p>\n<p>                 this Court to the Courts below directing that the Court should not grant<\/p>\n<p>                 bail to absconder accused and should make endeavour of quick disposal<\/p>\n<p>                 of the case itself.\n<\/p>\n<p>                                In my view, this Court could not, by way of administrative<\/p>\n<p>                 order, issue direction how a Judicial Officer should conduct his judicial<\/p>\n<p>                 proceedings. The discretion of the Court concerned is to be exercised<\/p>\n<p>                 depending on the facts of the case. The discretion cannot be taken away<\/p>\n<p>                 by administrative orders.\n<\/p>\n<p>                                Be that as it may, the petitioner abovenamed is directed to<\/p>\n<p>                 be released on bail on his furnishing bonds of Rs 10,000\/- (Rupees Ten<\/p>\n<p>                 Thousand) with two sureties of the like amount each to the satisfaction of<\/p>\n<p>                 Subdivisional Judicial Magistrate, West Champaran at Bettiah in Trial No<\/p>\n<p>                 1585 of 2010 arising out of Balthar Police Station Case No 28 of 2000<\/p>\n<p>                 subject to the condition that the petitioner would be present before the<br \/>\n<span class=\"hidden_text\">                                     2<\/span><br \/>\n          trial Court on each and every dated fixed in the case.<\/p>\n<p>                        Let a copy of this order be sent to the District Judge<\/p>\n<p>          concerned.\n<\/p>\n<\/p>\n<pre>M.E.H.\/                                       (Navaniti Prasad Singh)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211;
