Sawhney, Sr. Advocate with<br \/>\n            Mr. Rajender Sharma, Advocate,<br \/>\n            for respondent Nos.2 &amp; 3.\n<\/p>\n<p>\nRAKESH KUMAR GARG, J (Oral).\n<\/p>\n<p>            This is insurer&#8217;s appeal, challenging the impugned<\/p>\n<p>award dated 2.8.2006, whereby the respondents-claimants have<\/p>\n<p>been awarded compensation on account of injuries sustained by<\/p>\n<p>Ms. Rashmi Dhir-claimant (herein respondent No.1), caused due to<\/p>\n<p>rash and negligent driving of Bus bearing No.PB-10T-9533, as per<\/p>\n<p>the certified copy of impugned award.\n<\/p>\n<p><span class=\"hidden_text\"> F.A.O. No.5211 of 2006 (O&amp;M)                                       -2-<\/span><\/p>\n<p>           The only argument raised by learned counsel for the<\/p>\n<p>appellant before this Court is that the issue No.1 with regard to<\/p>\n<p>involvement of bus in question has been decided erroneously as<\/p>\n<p>the accident has taken place with Bus No.PB-10F-9333 and not<\/p>\n<p>with the Bus No.PB-10T-9533, and the appellant could not lead<\/p>\n<p>any evidence in this regard as the aforesaid fact came to their<\/p>\n<p>knowledge after passing of the Award.           Learned counsel has<\/p>\n<p>further submitted that because of this fact, the appellant has also<\/p>\n<p>moved an application under Order 41 Rule 27 CPC, for leading<\/p>\n<p>additional evidence along with this appeal. Therefore, keeping in<\/p>\n<p>view the aforesaid documents, which are sought to be proved by<\/p>\n<p>way of additional evidence, the findings of the Tribunal on issue<\/p>\n<p>No.1, cannot be sustained.\n<\/p>\n<p>           I have heard learned counsel for the parties.<\/p>\n<p>           However, from the impugned award, I find that no such<\/p>\n<p>plea was taken by the appellant-Insurance Company in its<\/p>\n<p>pleadings and therefore, application for leading additional evidence<\/p>\n<p>at this stage for the facts, which are not pleaded, cannot be<\/p>\n<p>allowed. Moreover, despite the fact that the appellant has taken a<\/p>\n<p>preliminary objection and was given permission under Section 170<\/p>\n<p>of the Motor Vehicles Act, 1988, to take all the defences\/grounds to<\/p>\n<p>contest the claim and a specific issue i.e. issue No.4 was framed,<\/p>\n<p>which reads as under:-\n<\/p>\n<blockquote><p>           &#8220;Whether the claimant has filed the petition in collusion with<br \/>\n           respondent Nos.1 &amp; 2? OPR&#8221;<\/p><\/blockquote>\n<p>\n<span class=\"hidden_text\"> F.A.O. No.5211 of 2006 (O&amp;M)                                    -3-<\/span><\/p>\n<p>           Yet, no evidence was lead on this issue and the<\/p>\n<p>aforesaid issue was decided against the appellant.<\/p>\n<p>           In view of the aforesaid, I am not inclined to interfere in<\/p>\n<p>the impugned award of the Tribunal.\n<\/p>\n<p>           Dismissed.\n<\/p>\n<p>26th November, 2009.
