Opp.Parties.\n                      ----------------------------------\n<\/pre>\n<p>              For the Petitioner : Mr.Shiv Kumar, Adv.<br \/>\n              For the State      : Mr.Satish Kr.Sinha,A.C. to S.C.1.<br \/>\n              For Opp.Party No.3 : Mr.Sanjeev Kumar Mishra, Adv.\n<\/p>\n<p>                      &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8211;<\/p>\n<p>5.   20\/10\/2011           By     order       dated         1.10.2010,        writ<\/p>\n<p>                  application        of      the     petitioner,          namely,<\/p>\n<p>                  C.W.J.C.No.8857 of 2009 was allowed with a<\/p>\n<p>                  direction to the respondents to accept his<\/p>\n<p>                  joining      in    Government          Ayurvedic     College,<\/p>\n<p>                  Patna    and      pay    his     salary    of    the    entire<\/p>\n<p>                  period irrespective of the fact that he had<\/p>\n<p>                  not      actually          performed          his       duties.<\/p>\n<p>                  Petitioner        produced       the   said     order   before<\/p>\n<p>                  the Principal of the College on 12.10.2010.<\/p>\n<p>                  It is submitted that the Principal of the<\/p>\n<p>                  College      requested      for    guidelines       from    the<\/p>\n<p>                  Department by his letter dated 27.10.2010.<\/p>\n<p>                  His     joining         having     not    been      accepted,<\/p>\n<p>                  petitioner filed this contempt application<\/p>\n<p>                  on 3.1.2011.\n<\/p>\n<p><span class=\"hidden_text\">                  2<\/span><\/p>\n<p>      A show cause filed today on behalf of<\/p>\n<p>the Under Secretary of the Department shows<\/p>\n<p>that the file was processed and order of<\/p>\n<p>posting    of    the      petitioner      was     issued       on<\/p>\n<p>28.1.2011       pursuant      to        which     admittedly<\/p>\n<p>petitioner joined his duty. Thereafter, it<\/p>\n<p>is stated in the show cause that, the file<\/p>\n<p>was processed for payment of salary of the<\/p>\n<p>petitioner      at   different          levels    and        final<\/p>\n<p>order,    as    contained         in     Annexure-B,          was<\/p>\n<p>passed    on    30.9.2011         for    payment        of    his<\/p>\n<p>entire    salary     as    directed       by     this    Court.<\/p>\n<p>Pursuant to the same, petitioner has been<\/p>\n<p>paid salary of the entire period by order<\/p>\n<p>dated 30.9.2011. The delay in issuing orders<\/p>\n<p>for posting of the petitioner and payment of<\/p>\n<p>salary has been explained in the show cause<\/p>\n<p>by stating that the file was processed at<\/p>\n<p>different levels in the Department and in<\/p>\n<p>the meanwhile Joint Secretary superannuated<\/p>\n<p>in May, 2011. Hence, there was some delay in<\/p>\n<p>issuing orders for payment of salary which<\/p>\n<p>has been issued as aforesaid.\n<\/p>\n<p>      This contempt application was taken up<\/p>\n<p>on   9.2.2011      and     this    Court       granted       four<\/p>\n<p>weeks time to the opposite parties to file<br \/>\n<span class=\"hidden_text\">                                3<\/span><\/p>\n<p>           their show cause. Show cause was not filed.<\/p>\n<p>           Hence, by order dated 8.9.2011 a proceeding<\/p>\n<p>           of contempt was initiated against opposite<\/p>\n<p>           party no.2 and 3, pursuant to which they<\/p>\n<p>           have     filed      their          show    cause.   The     Under<\/p>\n<p>           Secretary        of       the        Department       and     the<\/p>\n<p>           Principal      of       the    College       are    present   in<\/p>\n<p>           Court.       Though      there        is     some    delay    in<\/p>\n<p>           processing the claim of the petitioner in<\/p>\n<p>           compliance to the orders of this Court, but<\/p>\n<p>           taking into account the fact that this Court<\/p>\n<p>           had    not     fixed          up     any    time    limit     for<\/p>\n<p>           compliance of the order, this Court does not<\/p>\n<p>           consider it appropriate to proceed with the<\/p>\n<p>           contempt any further. As such the show cause<\/p>\n<p>           filed by the opposite parties is accepted.<\/p>\n<p>           Rule   of     contempt         is     discharged      and    this<\/p>\n<p>           application is disposed of.\n<\/p>\n<\/p>\n<pre>Pradeep\/                             ( J.
