Misc. No.8127 of 2011\n                                     INDRA KANT JHA\n                                             Versus\n                          THE STATE OF BIHAR THROUGH VIG\n                                          -----------\n<\/pre>\n<p>03.   27.04.2011              This    application     has   been    filed   by     the<\/p>\n<p>                   petitioner        for   modification     of     Order,        dated<\/p>\n<p>                   23.11.2006, passed in Cr. Misc. No. 49823 of 2006,<\/p>\n<p>                   whereby       anticipatory    bail   was      granted    to     the<\/p>\n<p>                   petitioner.\n<\/p>\n<p>                               While granting anticipatory bail, a condition<\/p>\n<p>                   was imposed that petitioner will remain physically<\/p>\n<p>                   present in Court on each and every date.<\/p>\n<p>                              Counsel appearing for the petitioner submits<\/p>\n<p>                   that on account of his old age and ailment, it is not<\/p>\n<p>                   possible for the petitioner to remain present in Court<\/p>\n<p>                   on each and every date. However, petitioner is ready<\/p>\n<p>                   to appear in Court, whenever his appearance will be<\/p>\n<p>                   required in Court as per the direction of the Court.<\/p>\n<p>                   In support of petitioner&#8217;s old age and ailment,<\/p>\n<p>                   specific     averment        has     been     made       in     the<\/p>\n<p>                   Supplementary Affidavit as well as in the main<\/p>\n<p>                   petition.\n<\/p>\n<p>                              Considering these facts, the Order dated<\/p>\n<p>                   23.11.2006 is modified to the extent that petitioner<\/p>\n<p>                   is not required to remain present physically in Court<br \/>\n<span class=\"hidden_text\">                         2<\/span><\/p>\n<p>      on each and every date.
