Justice V.GIRI\n\n Dated :07\/11\/2008\n\n O R D E R\n                       V.GIRI, J\n                     -------------------\n                   C.O.C.1567\/2008\n                     --------------------\n      Dated this the 7th day of November, 2008\n\n                     JUDGMENT\n<\/pre>\n<p>      Second respondent in the Contempt of Court<\/p>\n<p>case, Mr.Viswanathan, Tahsildar, appeared before this<\/p>\n<p>Court. Sri.P.N.Santhosh, learned Government Pleader<\/p>\n<p>submits that a copy of the judgment was produced<\/p>\n<p>before   the   Tahsildar      on      22.10.2008   by  one<\/p>\n<p>Mr.Shamsudeen and not by Mr.Ramabhadran.               The<\/p>\n<p>writ petition has been filed by Mr.Ramabhadran,<\/p>\n<p>petitioner in this Contempt of Court case.           In the<\/p>\n<p>meanwhile, it is stated that         a rival claim was made<\/p>\n<p>by some other group of persons over the affairs of the<\/p>\n<p>Club and hence the Tahsildar required the parties to<\/p>\n<p>produce some materials to show that they were in<\/p>\n<p>management of the club on the date on which<\/p>\n<p>Government had taken over the building and its<\/p>\n<p>premises. The Village Officer should have taken note<\/p>\n<p>of the fact that the writ petition was filed by the Club<\/p>\n<p>represented by its President one Mr.Ramabhadran who<\/p>\n<p>is the petitioner in the Contempt of Court case and<\/p>\n<p>C.O.C.1567\/2008<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>therefore, compliance with the directions issued by this<\/p>\n<p>Court should have been effected, by handing over the<\/p>\n<p>premises of the Club to the person who figured as the<\/p>\n<p>petitioner in this writ petition. The dispute between the<\/p>\n<p>office bearers and the members of the Club was not a<\/p>\n<p>matter with which the Revenue Officials were in any<\/p>\n<p>manner concerned.\n<\/p>\n<\/p>\n<p>2.    But I find force in the submission made by the<\/p>\n<p>learned Government Pleader that the respondents did<\/p>\n<p>not intend to violate the orders of this Court or disobey<\/p>\n<p>it. What took place seems to have been a genuine error.<\/p>\n<p>3.    It is also submitted by the learned Government<\/p>\n<p>Pleader    that the Village Officer has the    key of the<\/p>\n<p>building where the Club was functioning, and it is open<\/p>\n<p>to the petitioner to go and collect it.       Government<\/p>\n<p>Pleader assures that if the petitioner appears before the<\/p>\n<p>Village Officer in person, key will be handed over.<\/p>\n<p>Inventory of the articles kept in the building shall be<\/p>\n<p>prepared by the President of the Club and its office<\/p>\n<p>bearers.\n<\/p>\n<p>C.O.C.1567\/2008<br \/>\n<span class=\"hidden_text\">                              3<\/span><\/p>\n<p>4.    In the result, it is open to the petitioner to go and<\/p>\n<p>collect the key of the building from the Village Office,<\/p>\n<p>Kollam East. In the facts and circumstances, Club shall<\/p>\n<p>be permitted four months time from today to hand over<\/p>\n<p>vacant possession of the building in terms of the<\/p>\n<p>directions already issued by this         Court.
