The claim of the applicant is based on being<br \/>\n\temployed as watchman in the Watch and Ward Department of the company<br \/>\n\tin liquidation.\n<\/p>\n<p>Mr.J.S.Yadav,<br \/>\n\tlearned advocate appearing on advance copy on behalf of the Official<br \/>\n\tLiquidator of the company in liquidation submitted that the<br \/>\n\terstwhile management of the company in liquidation had raised<br \/>\n\tvarious objections, including the applicant being involved in the<br \/>\n\tcase of theft and complete details in this regard have not been<br \/>\n\tplaced on record by the applicant. Hence, it was submitted that<br \/>\n\tunless and until, the applicant approaches the Court with clean<br \/>\n\thands, the application should not be entertained.\n<\/p>\n<p>The<br \/>\n\tsubmission made on behalf of the Official Liquidator would have<br \/>\n\tmerited consideration provided the Court was required to go into<br \/>\n\tmerits of the claim made by the applicant before the Labour Court.<br \/>\n\tIt is open to the Official Liquidator to raise all issues of fact<br \/>\n\tand law, including the preliminary objections sought to be raised<br \/>\n\tbefore this Court, resisting the application filed by the applicant<br \/>\n\therein before the Labour Court.\n<\/p>\n<p>Accordingly,<br \/>\n\tthis application is granted. The applicant is permitted to implead<br \/>\n\tthe Official Liquidator of Jahangir Textile Mills Ltd. (in<br \/>\n\tliquidation) as a necessary party in the pending proceedings before<br \/>\n\tthe Labour Court subject to the right of the Official Liquidator to<br \/>\n\traise all objections as recorded herein before. Needless to state<br \/>\n\tthat granting of this permission shall not entitle the applicant<br \/>\n\therein to take a stand that the claim made before the Labour Court<br \/>\n\tis required to be granted as the Court has desisted from going into<br \/>\n\tthe issues raised. Application stands allowed accordingly in the<br \/>\n\taforesaid terms.
