Justice V.GIRI\n\n Dated :30\/05\/2008\n\n O R D E R\n                         V.GIRI, J\n                       -------------------\n                   W.P.(C).16120\/2008\n                       --------------------\n            Dated this the 30th day of May, 2008\n\n                       JUDGMENT\n<\/pre>\n<p>      Petitioner, who is working as Deputy Director of<\/p>\n<p>Education and Media Officer, Thiruvananthapuram,           has<\/p>\n<p>sought for a posting as Food Inspector which amounts to<\/p>\n<p>a reversion to a lower post. This is provided under Rule<\/p>\n<p>21(a) of Part-I of the         KSR.        Petitioner has been<\/p>\n<p>constrained to resort to this request to enable him to take<\/p>\n<p>care of his ailing wife and son, who are being treated in<\/p>\n<p>the Regional Cancer Centre,                Thiruvananthapuram.<\/p>\n<p>Petitioner points out that the request made by his junior<\/p>\n<p>Sri.P.Unnikrishnan Nair, on account of personal problems<\/p>\n<p>was accepted by the Government and the incumbent was<\/p>\n<p>directed to be given a suitable posting. As per Ext.P7,<\/p>\n<p>Unnikrishnan Nair was given a posting as Food Inspector<\/p>\n<p>in the Kollengode Circle, Palakkad District. Petitioner has<\/p>\n<p>filed several representations before the Government<\/p>\n<p>seeking a similar direction and the latest one, Ext.P10, is<\/p>\n<p>pending before the Government.             Petitioner   further<\/p>\n<p>W.P.(C).16120\/2008<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>submits that he has three years            in service for<\/p>\n<p>superannuation.\n<\/p>\n<\/p>\n<p>2.    I heard learned counsel for the petitioner and the<\/p>\n<p>learned Government Pleader.\n<\/p>\n<\/p>\n<p>3.    Having perused the averments in the writ petition<\/p>\n<p>as also Ext.P10 in the light of Ext.P6, I am of the view<\/p>\n<p>that the petitioner&#8217;s request is liable to be considered<\/p>\n<p>by the Government. If there is any factor which stands in<\/p>\n<p>the way of the Government in accepting the petitioner&#8217;s<\/p>\n<p>request, same must be specifically communicated to the<\/p>\n<p>petitioner.\n<\/p>\n<\/p>\n<p>4.    In the result, writ petition is disposed of directing<\/p>\n<p>the first respondent to consider and pass orders on<\/p>\n<p>Ext.P10 within a period of one month from the date of<\/p>\n<p>receipt of a copy of this judgment, in the light of Ext.P6<\/p>\n<p>order. I make it clear that if there is any factor which<\/p>\n<p>stands in the way of the Government accepting the<\/p>\n<p>W.P.(C).16120\/2008<br \/>\n<span class=\"hidden_text\">                              3<\/span><\/p>\n<p>petitioner&#8217;s request, it must be specifically indicated in<\/p>\n<p>the order to be passed by the Government. I am sure<\/p>\n<p>that the Government shall sympathetically consider the<\/p>\n<p>case of the petitioner and pass appropriate orders as<\/p>\n<p>indicated above.
