SADAR, DISTRICT- BEGUSARAI.\n                                                                 ....PETITIONER.\n                                    Versus\n                  THE STATE OF BIHAR.                        ....OPPOSITE PARTY.\n                                  -----------\n<\/pre>\n<p>2.   22.02.2011             Heard learned counsel for the petitioner and learned<\/p>\n<p>                  counsel for the State.\n<\/p>\n<p>                            The petitioner is in custody in relation to Begusarai<\/p>\n<p>                  Town P.S. Case No. 224 of 2010 instituted under Section<\/p>\n<p>                  302\/34 of the Indian Penal Code.\n<\/p>\n<p>                            It is alleged by the informant that her son was taken<\/p>\n<p>                  away by one Rajesh alias Goga and Gautam Kumar who<\/p>\n<p>                  came at her house. The informant went to search for him.<\/p>\n<p>                  Having heard the cry of her son, she rushed to the spot and<\/p>\n<p>                  found Rajesh Kumar alias Goga, his brother Kamal Singh, the<\/p>\n<p>                  petitioner and Gautam Kumar Singh running away from the<\/p>\n<p>                  spot where her son was lying on the ground with multiple<\/p>\n<p>                  injuries on his head. She states in the First Information Report<\/p>\n<p>                  that her son was taken to Begusarai hospital where he was<\/p>\n<p>                  declared dead by the Doctor.\n<\/p>\n<p>                            Learned senior counsel appearing for the petitioner<\/p>\n<p>                  submits that a reference to the post mortem report would<\/p>\n<p>                  show that the injuries to the chest and liver were such that<br \/>\n<span class=\"hidden_text\">                                    2<\/span><\/p>\n<p>            there was no possibility for the deceased to speak. He further<\/p>\n<p>            stated that in the fardbeyan itself, the informant states that her<\/p>\n<p>            son had been taken away by the persons to settle their own<\/p>\n<p>            internal family disputes.\n<\/p>\n<p>                       Having considered the matter, in my view, there<\/p>\n<p>            being direct allegation against the petitioner by the mother of<\/p>\n<p>            the deceased having seen the three persons fleeing away from<\/p>\n<p>            the spot, this is enough to reject this application.<\/p>\n<p>                       Let the trial be expedited.\n<\/p>\n<\/p>\n<pre>Devendra\/                                    (Navaniti Prasad Singh, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Kamal Singh vs The State Of Bihar on 22 February, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
