Poona Bai on 23 November, 2011<\/div>\n<pre>                                                                        1\n\n\n\n\n                     MCC No.1308\/11\n\nKashi Bai                                              Smt.Poona Bai\n\n\n\n\n23.11.2011\n      Ms.Preeti Khanna, Counsel for applicant.\n       Shri Anurag Tiwari, Counsel for respondent.<\/pre>\n<p>       I.A.No.10680\/11, an application under Section 5 of the<br \/>\nLimitation Act for condonation of delay in filing MCC No.1308\/11<br \/>\n       Though learned counsel appearing for respondent vehemently<br \/>\nopposed this application by stating that no ground is made out for<br \/>\ncondonation of delay, but considering peculiar facts of the case, we find<br \/>\nit a fit case for condonation of delay and accordingly the delay in filing<br \/>\nthis MCC is condoned.\n<\/p>\n<p>       Heard the learned counsel on MCC No.1308\/11<br \/>\n       By this application, the applicant is seeking restoration of First<br \/>\nAppeal No.184\/07 which was dismissed in default on 24.10.2007. It is<br \/>\nstated in the application that the applicant engaged Shri Mohan<br \/>\nTamaskar, Advocate and paid him court-fee apart from legal fee. The<br \/>\nCounsel had not deposited the court-fee and filed the appeal without<br \/>\npayment of court-fee. Thereafter, the matter remained pending before<br \/>\nthis Court for removing the default of payment of deficit court-fee.<br \/>\nHowever, a peremptory order was passed by a Division Bench of this<br \/>\nCourt on 3.10.2007 allowing 10 days opportunity to the appellant\/<br \/>\napplicant for payment of court-fee and to move an appropriate<br \/>\napplication. Neither the court-fee was paid nor an application under<br \/>\nSection 149 of CPC was filed, resulting dismissal of the first appeal on<br \/>\n24.10.2007.\n<\/p>\n<p>       It is stated that the applicant is 75 years old lady and had done<br \/>\nall necessary for filing an appeal, but it was a fault on the part of the<br \/>\ncounsel who neither deposited the court-fee inspite of payment to him<br \/>\nnor filed any application seeking extension of time as is required under<br \/>\nSection 149 of CPC. So applicant suffered dismissal of the appeal.\n<\/p>\n<p>       Learned counsel for applicant submitted that so far as court-fee<br \/>\nwhich was paid to the counsel is concerned, the applicant shall take<br \/>\n<span class=\"hidden_text\">                                                                         2<\/span><\/p>\n<p>                      MCC No.1308\/11<\/p>\n<p>Kashi Bai                                              Smt.Poona Bai<\/p>\n<p>23.11.2011<br \/>\nseparate steps, but now applicant is ready to make payment of court-<br \/>\nfee in the appeal after its restoration.\n<\/p>\n<p>       Considering peculiar facts of the case, on 19.9.2011, we<br \/>\ndirected issuance of the show cause notice to Shri Mohan Tamaskar,<br \/>\nAdvocate, as serious allegations were made in paras 6 to 10 of the<br \/>\napplication and inspite of service, he has not caused appearance. In<br \/>\nthese circumstances, we refer the matter of Shri Mohan Tamaskar,<br \/>\nAdvocate to the State Bar Council of M.P. for taking appropriate action<br \/>\nin this regard. A copy of MCC No.1308\/11 alongwith affidavit of the<br \/>\napplicant be sent to the Secretary, M.P. State Bar Council, Jabalpur<br \/>\nwho shall take action in accordance with law against Shri Mohan<br \/>\nTamaskar and apprise this Court in respect of the outcome of the<br \/>\naforesaid action within a period of three months positively.\n<\/p>\n<p>       Considering reasons stated in the application-MCC No.1308\/11<br \/>\nwhich are strange in nature, we find it fit case for restoration of the<br \/>\nappeal. Though Shri Anurag Tiwari, learned Counsel for respondent<br \/>\nopposed the aforesaid prayer, but in the interest of justice, we find that<br \/>\na case has been made out by the applicant for restoration of the First<br \/>\nAppeal. Accordingly, this application-MCC No.1308\/11 is allowed.
