Justice ANTONY DOMINIC\n\n Dated :01\/01\/2008\n\n O R D E R\n                        ANTONY DOMINIC, J.\n\n                 = =W.P.(C) = = = = = = = = = = =\n                     = = =\n                           No. 38309 OF 2007 I\n                 = = = = = = = = = = = = = = = =\n\n                   Dated this the 1st January, 2008\n\n                          J U D G M E N T\n<\/pre>\n<p>      Petitioner who was a participant in the folk dance at the Sub<\/p>\n<p>District Youth Festival in which he was adjudged second.        It is<\/p>\n<p>stated that while he was performing on the stage, a nail struck on<\/p>\n<p>his foot and that affected in his performance which resulted in his<\/p>\n<p>inferior ranking. Aggrieved by the ranking given by the judges the<\/p>\n<p>petitioner filed an appeal and that was also rejected. Thereupon<\/p>\n<p>this writ petition has been filed praying for quashing the appellate<\/p>\n<p>order and for directing the respondents to permit the petitioner to<\/p>\n<p>participate in the District Youth Festival 2007-08 scheduled at<\/p>\n<p>Kothamangalam from 1st January, 2008.\n<\/p>\n<p>      2. Even according to the petitioner, whatever be the reason<\/p>\n<p>thereof, his performance was not upto even his own expectation. If<\/p>\n<p>that be so, the ranking given by the judges cannot be impugned on<\/p>\n<p>any valid grounds. I do not find any reason to interfere either with<\/p>\n<p><span class=\"hidden_text\">WPC No. 38309\/07                   -2-<\/span><\/p>\n<p>the decision of the judges or the conclusion of the appellate<\/p>\n<p>committee.\n<\/p>\n<p>      3. However, the petitioner complains that the decision on his<\/p>\n<p>appeal was not communicated to him and that Ext. P9 which alone<\/p>\n<p>was communicated, does not contain any reason for rejection of the<\/p>\n<p>appeal.    It is true that Ext. P9 does not contain any reason as<\/p>\n<p>pointed out by the petitioner, but then in all cases when appeals are<\/p>\n<p>decided, separate orders are passed by the appellate committee.<\/p>\n<p>Since the appellate order with reasons has not been communicated<\/p>\n<p>to the petitioner, I direct the 2nd respondent to communicate to the<\/p>\n<p>petitioner the decision taken on the appeal filed by the petitioner.<\/p>\n<p>      With this direction, the writ petition is disposed of.<\/p>\n<p>                                                      ANTONY DOMINIC<br \/>\n                                                                JUDGE<br \/>\njan\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Harikrishnan.D.
