THE   SUB-DIVISIONAL   POLICE   OFFICER,\n               BEGUSARAI.\n                              -----------\n<\/pre>\n<p>04.   18.01.2011                    Heard learned counsel for the petitioner<\/p>\n<p>                   and the State.\n<\/p>\n<p>                                    The petitioner is alleged to be the mother-<\/p>\n<p>                   in-law of the deceased and an accused in Matihani P.S.<\/p>\n<p>                   Case No. 88 of 2008 registered for the alleged offences<\/p>\n<p>                   under Section 498A, 304B and 201\/34 of the Indian Penal<\/p>\n<p>                   Code.\n<\/p>\n<p>                                    It is submitted that as a matter of fact,<\/p>\n<p>                   petitioner is not mother-in-law of the deceased and as<\/p>\n<p>                   such, he could not be made accused in the said case<\/p>\n<p>                   alleging the involvement of the mother-in-law. He further<\/p>\n<p>                   submits that during investigation, the fact of relationship<\/p>\n<p>                   of this petitioner with the deceased was not examined and<\/p>\n<p>                   police submitted the charge sheet against the petitioner.<\/p>\n<p>                   He further submits that in the entire case diary there is no<\/p>\n<p>                   material against this petitioner to show that the petitioner<\/p>\n<p>                   is the mother-in-law of the deceased.<\/p>\n<p>                                    Learned counsel for the State submits that<br \/>\n             the investigation was done properly on the basis of the<\/p>\n<p>            materials available and the charge sheet has been<\/p>\n<p>            submitted against the petitioner.\n<\/p>\n<p>                            Considering the rival submission of the<\/p>\n<p>            parties, it is admitted position that charge sheet has been<\/p>\n<p>            submitted against the petitioner.
