Sinha\n                       For the State       :Mrs. Indu Bala Pandey, APP\n                                        -----------\n<\/pre>\n<p>03.   29.06.2011               Heard both sides.\n<\/p>\n<p>                               This is repeat application seeking bail in a case<\/p>\n<p>                   lodged under section 302 and 120B\/34 IPC.<\/p>\n<p>                               Earlier, petitioner had moved this Court for bail<\/p>\n<p>                   which was considered and rejected by order dated 10.05.2010.<\/p>\n<p>                   Gravity of the case can be seen from the said order. However,<\/p>\n<p>                   petitioner was granted liberty to renew his prayer for bail in case<\/p>\n<p>                   there is undue delay in taking up the matter.<\/p>\n<p>                               Counsel for the petitioner submits that petitioner is<\/p>\n<p>                   in custody since 23.04.2009 and that there was dispute relating<\/p>\n<p>                   to land on which the deceased was carrying the business of cattle<\/p>\n<p>                   fair.\n<\/p>\n<p>                               Status report was called for which is at Flag A. it<\/p>\n<p>                   appears therefrom     that the trial has already commenced in<\/p>\n<p>                   which three prosecution witnesses have already been examined<\/p>\n<p>                   and the case is posted for evidence of remaining witnesses to be<\/p>\n<p>                   produced on behalf of the prosecution.<\/p>\n<p>                               Having considered the submissions and on going<\/p>\n<p>                   through materials on record including the report at Flag-A, this<\/p>\n<p>                   court while rejecting the prayer of the petitioner, disposes of this<br \/>\n<span class=\"hidden_text\">                           2<\/span><\/p>\n<p>     application in the following manner:<\/p>\n<blockquote><p>              Let the trial court endeavour to examine rest of the<br \/>\n         prosecution witnesses within six months from the date<br \/>\n         of receipt\/communication of this order in the court below,<br \/>\n         failing which the trial court(CJM, Gaya)        shall release<br \/>\n         the petitioner abovenamed      on bail on furnishing bail<br \/>\n         bond of Rs.10,000\/- (ten thousand) with two sureties of<br \/>\n         the like amount each to its satisfaction in connection<br \/>\n         with Chandauti(Chakhand) P.S. Case No. 66\/09, subject<br \/>\n         to the condition that one of the bailors shall be his<br \/>\n         own\/close family member.       The petitioner shall appear<br \/>\n         in person on each date fixed at the trial. In case of default<br \/>\n         in such appearance without there being any compelling<br \/>\n         circumstance, the trial court shall cancel his bail bonds<br \/>\n         and secure his arrest in accordance with law.<\/p><\/blockquote>\n<p>                              ( Kishore K.
