Singh, Judge\nDate: 25.03.2010 \n:J U D G M E N T :\n<\/pre>\n<p>Gandarb Singh Katoch-respondent filed a Claim<br \/>\nPetition under Section 15(2) of the Payment of Wages<br \/>\nAct, 1936 with the Authority under the Payment of<br \/>\nWages Act (Labour Officer), Reasi saying that the<br \/>\nAdditional Chief Executive Officer of Shree Mata<br \/>\nVaishno Devi Shrine Board, Katra had allotted work for<br \/>\nconstruction of widening of road from Katra to Shree<br \/>\nMata Vaishno Devi Shrine in the year 1996 in favour of<br \/>\nKanth Lal-Contractor, who approached him for supply of<br \/>\nlabour for execution of the work. He along with 51<br \/>\nothers workers, accordingly, worked for the construction<br \/>\nof road from RD-595 to RD-740 from 13.11.1996 to<br \/>\nAugust, 1997. The labourers were, however, paid only<br \/>\nin part by the contractor.\n<\/p>\n<p>A claim for Rs.2,46,464\/- was thus laid before the<br \/>\nAuthority under the Payment of Wages Act by Gandarb<br \/>\nSingh Katoch for and on behalf of the labourers<br \/>\nemployed by Kanth Lal-Contractor for execution of the<br \/>\nwork of Shree Mata Vaishno Devi Shrine Board.<br \/>\nThe Contractor appeared before the Authority in<br \/>\nresponse to the Notice issued to him in this behalf and<br \/>\nagreed to settle the dispute amicably by making<br \/>\npayment of wages by the next date of hearing fixed for<br \/>\nJuly 26, 1999. He, however, failed to honour his<br \/>\ncommitment opting to remain absent from the<br \/>\nproceedings. The Contractor and the other respondents<br \/>\nincluding the Board were later set ex-parte when after<br \/>\nappearing before the Authority, they opted not to file any<br \/>\nobjection to the Claim Petition and remain absent.<br \/>\nOn the basis of the ex-parte evidence produced in<br \/>\nthe case, the Authority under the Payment of Wages Act<br \/>\nheld the claimant entitled to Rs.1,71,474\/- as per the<br \/>\ndetails appearing in the Muster sheet placed on records<br \/>\nof the Authority.\n<\/p>\n<p>In terms of the Award of the Authority, all the<br \/>\nrespondents i.e. the Contractor, Shree Mata Vaishno<br \/>\nDevi Shrine Board and its functionaries were held liable<br \/>\nto satisfy the Award.\n<\/p>\n<p>Statutory remedy of Appeal does not appear to<br \/>\nhave been resorted to either by the Contractor or by the<br \/>\npetitioners who have filed this Writ Petition seeking<br \/>\nquashing of the Award of the Authority.<br \/>\nMr. D.C.Raina, learned Senior counsel, appearing<br \/>\nfor the Board submitted that the Board had discharged<br \/>\nits contractual obligation by paying the Contractor for<br \/>\nthe work he had done for it and in view of the<br \/>\nContractor&#8217;s admission to pay the claimant and his<br \/>\nlabourers, the Board was not under any obligation to<br \/>\nsatisfy the Award, which the learned counsel says, was<br \/>\nwithout jurisdiction in so far as it held the Board liable to<br \/>\nsatisfy the labourers&#8217; claim.\n<\/p>\n<p>Per contra Mr. B.S.Bali, referring to the provisions<br \/>\nof the Contract Labour (Regulation and Abolition) Act,<br \/>\n1970 submitted that Board, being the Principal employer<br \/>\nfor whom the contractor had engaged the labour, the<br \/>\nAuthority had not committed any jurisdictional error in<br \/>\nholding the Board liable to satisfy the labour Claim.<br \/>\nMr. Bali further submitted that having agreed to<br \/>\nsatisfy the Award during the execution proceedings, the<br \/>\nBoard was not entitled to invoke the Extra Ordinary Writ<br \/>\nJurisdiction of the Court, because the Board cannot be<br \/>\npermitted to approbate and reprobate.<br \/>\nLearned counsel referred to interim orders passed<br \/>\non 28.02.2002, 18.03.2002, 25.04.2002 and 4.06.2002,<br \/>\ncopies whereof have been placed on records, to urge<br \/>\nthat having all along agreed to satisfy the labour claim,<br \/>\nthe petitioners&#8217; approach to this Court was not bonafide.<br \/>\nI have considered the submissions of learned<br \/>\ncounsel for the parties and perused the records.<br \/>\nTo determine the issue raised by the learned<br \/>\nSenior counsel that the Board was not under any<br \/>\nobligation to satisfy the Award of payment of wages to<br \/>\nthe labourers engaged by the Contractor employed by<br \/>\nthe Board, regard needs to be had to the provisions of<br \/>\nSection 3 of the Payment of Wages Act 1936, which for<br \/>\nfacility of reference is reproduced hereunder:-<br \/>\n&#8220;[ RESPONSIBILITY FOR PAYMENT OF WAGES.&#8211;(1)<br \/>\nEvery employer shall be responsible for the payment of all<br \/>\nwages required to be paid under this Act to persons<br \/>\nemployed by him and in case of persons employed\n<\/p>\n<p>(a) in factories, if a person has been named as the<br \/>\nmanager of the factory under clause (f) of sub-section<br \/>\n(1) of section 7 of the Factories Act, 1948 (63 of 1948);\n<\/p>\n<p>(b) in industrial or other establishments, if there is a<br \/>\nperson responsible to the employer for the supervision<br \/>\nand control of the industrial or other establishment;\n<\/p>\n<p>(c) upon railways (other than in factories), if the employer<br \/>\nis the railway administration and the railway<br \/>\nadministration has nominated a person in this behalf<br \/>\nfor the local area concerned;\n<\/p>\n<p>(d) in the case of contractor, a person designated by such<br \/>\ncontractor who is directly under his charge; and\n<\/p>\n<p>(e) in any other case, a person designated by the<br \/>\nemployer as a person responsible for complying with<br \/>\nthe provisions of the Act;\n<\/p>\n<p>the person so named, the person responsible to the<br \/>\nemployer, the person so nominated or the person so<br \/>\ndesignated, as the case may be, shall be responsible for<br \/>\nsuch payment.\n<\/p>\n<p>(2) Notwithstanding anything contained in subsection<br \/>\n(1), it shall be the responsibility of the<br \/>\nemployer to make payment of all wages required to be<br \/>\nmade under this Act in case the contractor or the<br \/>\nperson designated by the employer fails to make such<br \/>\npayment.]&#8221;\n<\/p>\n<p>Perusal of Section 3(2) quoted above<br \/>\nindicates, unambiguously, the responsibility of the<br \/>\nemployer to make payment of all wages required to<br \/>\nbe made under the Payment of Wages Act in case<br \/>\nthe Contractor or any other person designated by<br \/>\nthe employer fails to make the payment of wages to<br \/>\nthe employed persons i.e. the labourers.<br \/>\nLearned Senior counsel is thus not right in<br \/>\nsaying that the Board was not liable to satisfy the<br \/>\nAward which remained unsatisfied by the<br \/>\ncontractor engaged by it.\n<\/p>\n<p>This apart, the Board cannot even otherwise<br \/>\ndeny its liability to satisfy the Award in view of the<br \/>\nexpress provisions of Section 21(4) of the Contract<br \/>\nLabour (Regulation and Abolition) Act, 1970 which<br \/>\nhold the principal employer, liable to pay the wages<br \/>\nof the labourers, which for facility of reference are<br \/>\nreproduced hereunder:-\n<\/p>\n<p>&#8220;21. RESPONSIBILITY OF PAYMENT OF<br \/>\nWAGES(1) A contractor shall be responsible for<br \/>\npayment of wages to each worker employed by<br \/>\nhim as contract labour and such wages shall be<br \/>\npaid before the expiry of such period as may be<br \/>\nprescribed.\n<\/p>\n<p>(2) Every principal employer shall nominate<br \/>\na representative duly authorized by him to be<br \/>\npresent at the time of disbursement of wages by<br \/>\nthe contractor and it shall be the duty of such<br \/>\nrepresentative to certify the amounts paid as<br \/>\nwages in such manner as may be prescribed.<br \/>\n(3) It shall be the duty of the contractor to<br \/>\nensure the disbursement of wages in the presence<br \/>\nof the authorized representative of the principle<br \/>\nemployer.\n<\/p>\n<p>(4) In case the contractor fails to make<br \/>\npayment of wages within the prescribed period or<br \/>\nmakes short payment, then the principal employer<br \/>\nshall be liable to make payment of wages in full or<br \/>\nthe unpaid balance due, as the case may be, to<br \/>\nthe contract labour employed by the contractor<br \/>\nand recover the amount so paid from the<br \/>\ncontractor either by deduction from any amount<br \/>\npayable to the contractor under any contract or as<br \/>\na debt payable by the contractor.&#8221;\n<\/p>\n<p>In view of the provisions of the Contract<br \/>\nLabour (Regulation and Abolition) Act, 1970<br \/>\nreserving right with the employer, like the Board to<br \/>\nrecover the wages payable to the labourers by the<br \/>\ncontractor, from the contractor in the event of its<br \/>\nmaking payment of unpaid wages to the labourers,<br \/>\nthe Board&#8217;s Writ Petition is clearly misconceived, in<br \/>\nthat, in view of the statutory provisions referred to<br \/>\nhereinabove, the Board cannot deny its liability to<br \/>\nsatisfy the Award of the Authority.\n<\/p>\n<p>Mr. Bali&#8217;s plea that the approach of the Board<br \/>\nto this Court was not bonafide, appears to be well<br \/>\nmerited, in that, having all along agreed in<br \/>\nexecution proceedings before the Authority under<br \/>\nthe Payment of Wages Act, to pay the wages to the<br \/>\nlabourers, the Board&#8217;s approach to this Court<br \/>\ndenying its liability to make payment of wages to<br \/>\nthe labourers, cannot looked from any angle, be<br \/>\nsaid to be bonafide.\n<\/p>\n<p>Shree Mata Vaishno Devi Shrine Board&#8217;s Writ<br \/>\nPetition is, thus, found to be misconceived and<br \/>\nwithout merit.\n<\/p>\n<p>The Writ Petition, therefore, fails and is,<br \/>\naccordingly, dismissed with costs quantified at<br \/>\nRs.5000.\n<\/p>\n<p>Registrar Judicial is directed to release the<br \/>\namount deposited by the Board in this Court in<br \/>\nfavour of Gandarb Singh Katoch-respondent no.1,<br \/>\nalong with interest accrued thereon.<br \/>\n(J. Singh)<br \/>\nJudge<br \/>\nJAMMU:\n<\/p>\n<p>25.03.2010<br \/>\nVinod <\/p>\n<p>_______________________________________________________________________________<br \/>\nCMP No.134\/2010:-\n<\/p>\n<p>Petitioners have moved this Motion for amendment<br \/>\nof the Writ Petition seeking substitution of petitioner<br \/>\nNo.1 M.K.Dwivedi, the then Additional Chief Executive<br \/>\nOfficer, Shree Mata Vaishno Devi Shrine Board, Katra,<br \/>\nby &#8220;Shree Mata Vaishno Devi Shrine Board through<br \/>\nAdditional Chief Executive Officer, Katra,&#8221; on the ground<br \/>\nthat M.K.Dwivedi, the then Additional Chief Executive<br \/>\nOfficer was inadvertently indicated as petitioner No.1 in<br \/>\nthe Writ Petition in place of Shree Mata Vaishno Devi<br \/>\nShrine Board, Katra, which had infact filed the Writ<br \/>\nPetition to question Award dated 17.02.2001 of the<br \/>\nAuthority under Payment of Wages Act(Labour Officer),<br \/>\nReasi.\n<\/p>\n<p><span class=\"hidden_text\">2<\/span><\/p>\n<p>After having heard learned counsel for the Board<br \/>\nand Mr. Bali for respondent No.1, the claimant, I find<br \/>\nthat omission of Shree Mata Vaishno Devi Shrine<br \/>\nBoard, Katra as petitioner in the Writ Petition appears to<br \/>\nbe inadvertent.\n<\/p>\n<p>Looking to the long pendency of the Writ Petition in<br \/>\nthe Court, it is considered appropriate to determine the<br \/>\nWrit Petition finally, after hearing Shree Mata Vaishno<br \/>\nDevi Shrine Board in the matter which has been<br \/>\nadjudged liable to pay the awarded amount.<br \/>\nAccordingly, finding merit in the Motion, it is<br \/>\nallowed permitting substitution of Shree Mata Vaishno<br \/>\nDevi Shrine Board, Katra as petitioner no.1 in place of<br \/>\nMr. M.K.Dwivedi, in OWP No.719\/2002.<br \/>\nRegistry to make necessary corrections.<br \/>\n(J.
