KRUTI M SHAH for Applicant(s) : 1 - 2. \nMR\nDC SEJPAL, APP for Respondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE AKIL KURESHI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 09\/02\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>\tRule.\n<\/p>\n<p>Learned APP Mr. Sejpal waives service of rule for State.\n<\/p>\n<p>\tCounsel<br \/>\nfor the applicants submitted that except for offence under Section<br \/>\n506(2) of IPC, all other offences indicated in the FIR are bailable.<br \/>\nShe drew my attention to the nature of allegations made in the<br \/>\ncomplaint and submitted that applicants undertake to cooperate with<br \/>\nthe investigation, if released on bail.\n<\/p>\n<p> \tIn<br \/>\naddition to the statement made, I have also perused the nature of<br \/>\nallegations made in the complaint.  Under<br \/>\nthe circumstances, by allowing this application, it is ordered that<br \/>\nin the event of arrest of the applicants in connection with C.R.<br \/>\nNo.I-23\/2011 registered before Valsad city police station, Valsad,<br \/>\nthey shall be released on bail upon his furnishing a bond of Rs.<br \/>\n10,000\/-(Rupees Ten Thousand)each with one surety of like amount to<br \/>\nthe satisfaction of the lower Court and subject to the<br \/>\nfollowing conditions :\n<\/p>\n<p>[A]\tshall<br \/>\ncooperate with the investigation and make themselves available for<br \/>\ninterrogation whenever required.\n<\/p>\n<p>[B]\tshall<br \/>\nremain present at Valsad City Police Station, Valsad on 14.2.2011<br \/>\nbetween 11:00 am to 2:00 pm:\n<\/p>\n<p>[C]\tshall<br \/>\nnot hamper the investigation in any manner nor shall directly or<br \/>\nindirectly make any inducement, threat or promise to any witness so<br \/>\nas to dissuade them from disclosing such facts to the Court or to any<br \/>\nPolice Officer;\n<\/p>\n<p>[D]\tat<br \/>\nthe time of execution of bond, furnish the address to the<br \/>\nInvestigating Officer and the Court concerned and shall not change<br \/>\nthe residence till the final disposal of the case or till further<br \/>\norders;\n<\/p>\n<p>[E]<br \/>\n\twill not leave India without the permission of the Court and, if is<br \/>\nholding a Passport, shall surrender the same before the trial Court<br \/>\nimmediately<\/p>\n<p>[F]\tIt<br \/>\nwould be open to the Investigating Officer to file an application for<br \/>\nremand, if he considers it just and proper and the concerned<br \/>\nMagistrate would decide it on merits.\n<\/p>\n<p>[G]\tWithin<br \/>\na period of ten days from the date of arrest, the applicants shall<br \/>\napply for regular bail which application shall be decided by the<br \/>\ncompetent Court in accordance with law without being influenced by<br \/>\nthe fact that anticipatory bail was granted.\n<\/p>\n<p>\tRule<br \/>\nmade absolute.
