NO. 3674     OF 2008\n            ===========================\n\n     Dated this the 18th day of December,2008\n\n                       ORDER\n<\/pre>\n<p>    Revision is filed challenging the order passed<\/p>\n<p>by  Enquiry   Commissioner   and   Special   Judge,<\/p>\n<p>Thiruvananthapuram in C.C.2\/2003 directing   Deputy<\/p>\n<p>Superintendent of Police, Vigilance to file the<\/p>\n<p>charge sheet before the proper court for the reason<\/p>\n<p>that  second accused who alone is a public servant<\/p>\n<p>expired on 26.12.2003 and the case as against the<\/p>\n<p>first accused a private person will not lie and<\/p>\n<p>Special Court has no jurisdiction.<\/p>\n<p>    2.  Learned Public Prosecutor and the learned<\/p>\n<p>counsel appearing for respondent were heard.<\/p>\n<p>    3.   Learned Public Prosecutor submitted that<\/p>\n<p>the fact that respondent is a private individual<\/p>\n<p>does  not   mean   that   Special  Court   has   no<\/p>\n<p>jurisdiction to try him for an offence under the<\/p>\n<p>Prevention of Corruption Act, when the prosecution<\/p>\n<p>case  is  that  in  furtherance   of  the  criminal<\/p>\n<p><span class=\"hidden_text\">CRRP 3674\/2008             2<\/span><\/p>\n<p>conspiracy the offence was committed along with the<\/p>\n<p>second accused who is a public servant.       Learned<\/p>\n<p>counsel appearing for the respondent submitted that<\/p>\n<p>the contract was executed on 8.8.1989 and after the<\/p>\n<p>lapse of 17 years it is not in the interest of<\/p>\n<p>justice to proceed with the case.\n<\/p>\n<p>     4.    The only question for consideration in the<\/p>\n<p>revision      is  whether   the   Special      Judge,<\/p>\n<p>Thiruvananthapuram      was  justified  in  directing<\/p>\n<p>return     of   the  charge  sheet   to  the   Deputy<\/p>\n<p>Superintendent of Police       for the reason that<\/p>\n<p>second accused the public servant         expired on<\/p>\n<p>26.12.2003.      It cannot be disputed that if the<\/p>\n<p>second accused is alive, respondent could have been<\/p>\n<p>tried by the Special Judge.     In such circumstance,<\/p>\n<p>the death of the second accused will not take away<\/p>\n<p>jurisdiction, which     was with the    Special Judge<\/p>\n<p>when cognizance was taken.\n<\/p>\n<p>     Revision is allowed.   The order dated 15.1.2005<\/p>\n<p>is set aside.      Enquiry Commissioner and Special<\/p>\n<p>Judge, Thiruvananthapuram is directed to proceed<\/p>\n<p>with the trial.
