(2) 402\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t   ORDER\n<\/p>\n<p>1.By  order  dated 9-10-1987 of this  Court,  Hon&#8217;ble  Mr<br \/>\nJustice\t A.C. Gupta, one of the former Judges of this  Court<br \/>\nwas  appointed\tby consent as a sole  arbitrator  to  decide<br \/>\nprivate\t dispute  between the parties pending in  the  civil<br \/>\nsuit.\n<\/p>\n<p><span class=\"hidden_text\">403<\/span><\/p>\n<p>The learned Judge after giving opportunities to the  parties<br \/>\nin his award dated 30-3-1992 found as under:\n<\/p>\n<blockquote><p>\t\t    &#8220;I have found that the claimant M\/s S.S.<br \/>\n\t      Jatley   is  entitled  to\t realise  from\t the<br \/>\n\t      respondent, College of Vocational Studies,  Rs<br \/>\n\t      9023  by\tway of refund  of  security  deposit<br \/>\n\t      (Claim  A);  Rs 9087.70 and  Rs  78,996.44  as<br \/>\n\t      balance payment for work done and as value  of<br \/>\n\t      materials\t left  at  site (Claim\tB);  and  Rs<br \/>\n\t      36,909 as value of Tools and Plants taken over<br \/>\n\t      by  the respondent (Claim B-1),  totalling  Rs<br \/>\n\t      1,34,016.14.    On   the\t counter-claim\t  of<br \/>\n\t      respondent,  I  have  held that a\t sum  of  Rs<br \/>\n\t      1,08,000 is payable by the claimant due to his<br \/>\n\t      failure  to construct the college building  in<br \/>\n\t      time  forcing  the respondent to pay  for\t the<br \/>\n\t      rented accommodation.\n<\/p><\/blockquote>\n<blockquote><p>\t      Setting  off  the\t counter-claim\tagainst\t the<br \/>\n\t      claim, I award a sum of Rs 26,016.14,  rounded<br \/>\n\t      off  to Rs 26,016 (Rupees Twenty-six  thousand<br \/>\n\t      and  sixteen) only in favour of  claimant\t M\/s<br \/>\n\t      S.S. Jatley.  This sum will carry interest  at<br \/>\n\t      the  rate\t of 18% per annum from the  date  of<br \/>\n\t      this  award till it is made the rule of  court<br \/>\n\t      or till the date of realisation, whichever  is<br \/>\n\t      earlier.\tIn the circumstances of the  case  1<br \/>\n\t      make  no\torder for  pendente  lite  interest.<br \/>\n\t      Also,   in  the  circumstances  of  the\tcase<br \/>\n\t      including\t the proportion of success of  each,<br \/>\n\t      the parties will bear their own costs of these<br \/>\n\t      proceedings.&#8221;\n<\/p><\/blockquote>\n<p>2. An application has been made to make this award a rule of<br \/>\nthe court. Objections have been filed by the appellant under<br \/>\nSection 30 of the Arbitration Act, 1940. It is contended  by<br \/>\nShri  D.V.  Sehgal,  the  learned  senior  counsel  for\t the<br \/>\ncontractor  that time is the essence of the contract.  Under<br \/>\nclause\t12  of the agreement, the respondent  was  under  an<br \/>\nobligation  to supply the drawings and specifications.\tThey<br \/>\ncommitted   breach  of\tthe  contract  and  therefore,\t the<br \/>\ncontractor  was saddled with liability to  incur  additional<br \/>\ncost  in erection of buildings which he had claimed  in\t the<br \/>\nsuit  and became part of the claim in the  arbitration,\t The<br \/>\nlearned\t arbitrator had not considered these aspects of\t the<br \/>\nmatters, though they expressly drew his attention during the<br \/>\ncourse\t  of   arguments.    Therefore,\t   non-consideration<br \/>\nconstitutes  an\t error apparent on the fact  of\t the  record<br \/>\nunder  Section 30 of the Act. In support thereof, he  placed<br \/>\nreliance  on  K.P. Poulose v. State of Kerala&#8217;. We  find  no<br \/>\nforce  in the contention. An omission to refer the  argument<br \/>\naddressed before the arbitrator is not a misconduct. But the<br \/>\narbitrator  is\tguilty\tif  he\tignores\t the  very  material<br \/>\ndocument  which throws abundant light on the matter  in\t the<br \/>\ncontroversy  or if be makes the award without  perusing\t the<br \/>\ncontract  upon\twhich  the rights  and\tliabilities  of\t the<br \/>\nparties depend. But the award cannot be set aside unless  it<br \/>\nappears on the face of the award that the arbitrator ignored<br \/>\nthe material document. Admittedly, the terms of the contract<br \/>\nhad  not  been\tmade  part  of\tthe  award.  Therefore\tthis<br \/>\nCourt cannot look into the terms of the contract to find  as<br \/>\nto who is responsible for the breach of the contract. In the<br \/>\naward, the learned arbitrator has summarised the contentions<br \/>\nof  the\t parties  arising from the  respective\tletters\t and<br \/>\nconsidered  the claims in the part dealing with\t the  claims<br \/>\nand counter-claims. Ultimately, it was concluded that a\t sum<br \/>\nof Rs 26,016.14 was found due and payable to the contractor.<br \/>\nThis  Court  in the aforesaid judgment held in\tparagraph  6<br \/>\nthat   the  legal  misconduct  which  is  complete  if\t the<br \/>\narbitrator   on\t the  face  of\tthe  award  arrives  at\t  an<br \/>\ninconsistent  conclusion even on his own finding or  arrives<br \/>\nat a decision by ignoring the very material documents  which<br \/>\nthrow abundant light<br \/>\n1    (1975) 2 SCC 236: 1975 Supp SCR 214<br \/>\n<span class=\"hidden_text\">404<\/span><br \/>\non  the\t controversy to help a just and fair  decision.\t  In<br \/>\nthis case, the learned Judge has meticulously drawn out\t the<br \/>\ncontentions  raised by the parties and had adverted  to\t the<br \/>\ncontention  on\tperusing the record and\t the  contract,\t the<br \/>\nfoundation  of the rights and liabilities and arrived  at  a<br \/>\ndecision.  We do not find any inconsistency in his  finding.<br \/>\nOn the other hand, a meticulous analysis would disclose that<br \/>\nthe  learned Judge had applied his mind to  the\t controversy<br \/>\nplaced\tbefore him and arrived at a decision in\t the  award.<br \/>\nUnder these circumstances, we do not find any error apparent<br \/>\non  the\t face  of the award  warranting\t interference.\t The<br \/>\nobjections  are\t overruled.
