Justice ANTONY DOMINIC\n\n Dated :24\/08\/2007\n\n O R D E R\n                   ANTONY DOMINIC, J.\n\n            = = = = = = = = = = = = = = = =\n              W.P.(C) No. 24813 OF 2007 D\n            = = = = = = = = = = = = = = = =\n\n           Dated this the 24th  August, 2007\n\n                    J U D G M E N T\n<\/pre>\n<p>    Petitioner  approached    this Court  praying   for<\/p>\n<p>quashing Ext. P12 and to direct the 1st respondent to<\/p>\n<p>regularise her service as Female Attendant and to<\/p>\n<p>sanction consequential benefits.  Petitioner commenced<\/p>\n<p>service on provisional basis from 1981 and retired on<\/p>\n<p>31-5-2005   as   Female    Attendant   in    Thodupuzha<\/p>\n<p>Municipality.  Her request for regularisation of her<\/p>\n<p>provisional service was rejected by Exts. P4 and P5 and<\/p>\n<p>her claim for pension was considered by the authorities<\/p>\n<p>and it was eventually rejected by Ext. P12 order.    It<\/p>\n<p>is in the aforesaid background this writ petition has<\/p>\n<p>been filed.\n<\/p>\n<p>    2. In the pleadings, the petitioner referred to<\/p>\n<p>Ext.  P7  Govt.  Order  which  provides  for  ex-gratia<\/p>\n<p>pension for those who are ineligible for pension and<\/p>\n<p>she also makes reference to Ext. P8 judgment of this<\/p>\n<p>Court where a similarly situated person&#8217;s case was<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No. 24813 OF 2007       -2-<\/span><\/p>\n<p>considered and based on Ext. P8 judgment, by Ext. P9<\/p>\n<p>order pension was granted.           On these grounds the<\/p>\n<p>petitioner seeks to quash Ext. P12 and to direct the<\/p>\n<p>authorities to grant her consequential benefits.<\/p>\n<p>     3.      Admittedly,    the  petitioner  commenced  her<\/p>\n<p>service on provisional basis and continued so until her<\/p>\n<p>retirement and her service was not regularised.      As per<\/p>\n<p>the statutory provisions, only regular service will<\/p>\n<p>count towards pension and the provisional service will<\/p>\n<p>not count for pension.          Therefore the claim of the<\/p>\n<p>petitioner for pension has no statutory backing.<\/p>\n<p>     4.     As    far    as Ext.   P7 Government  Order  is<\/p>\n<p>concerned, by this order the Government introduced an<\/p>\n<p>Ex-gratia Pension Scheme to provide relief to employees<\/p>\n<p>who retire from service on superannuation and are<\/p>\n<p>ineligible for statutory pension as per the provisions<\/p>\n<p>in Kerala Service Rules.       This Scheme only enables the<\/p>\n<p>employees who rendered regular service to get ex-gratia<\/p>\n<p>pension and does not apply to provisional employees<\/p>\n<p>like the petitioner.\n<\/p>\n<p>     5. In so far as Ext. P8 judgment is concerned, as<\/p>\n<p>is evident from the same, the judgment was rendered in<\/p>\n<p>the peculiar facts and circumstances of the case and<\/p>\n<p>the judgment does not lay down a law of universal<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No. 24813 OF 2007       -3-<\/span><\/p>\n<p>application that provisional employees are entitled to<\/p>\n<p>pension.       It may be true that following Ext. P8 ex-<\/p>\n<p>gratia pension may have been granted to a provisional<\/p>\n<p>employee.       Equality is a positive concept and an order<\/p>\n<p>of the court cannot perpetuate an illegality.       So long<\/p>\n<p>as the rules do not permit to grant pension for<\/p>\n<p>provisional employees like the petitioner, for the<\/p>\n<p>reason that another person has been granted the benefit<\/p>\n<p>by Ext. P9, the petitioner cannot claim parity with<\/p>\n<p>such person.\n<\/p>\n<p>     6.      Since      the petitioner admittedly   was   a<\/p>\n<p>provisional employee, in terms of the rules she is not<\/p>\n<p>entitled to pension.         Ext. P7 Govt. Order also is<\/p>\n<p>inapplicable to provisional employees.       Therefore, the<\/p>\n<p>rejection of the petitioner&#8217;s claim by Ext.
