Mr.H.L.Jani,<br \/>\n\tlearned APP waives service of rule on behalf of respondent -State.\n<\/p>\n<p>\tThis application has been<br \/>\n\tpreferred under Section 439 of the Code of Criminal Procedure, 1973<br \/>\n\tin connection with the offence being CR No.I-70 of 2010 registered<br \/>\n\twith Talala Police Station, for the offence under Sections 376, 506,<br \/>\n\t292 and 34 of Indian Penal Code.\n<\/p>\n<p>\tHeard Mr.P.M.Lakhani,<br \/>\n\tlearned advocate for the applicant and Mr.H.L.Jani, learned APP on<br \/>\n\tbehalf of the respondent &#8211; State.\n<\/p>\n<p>\tMr.Lakhani contended that<br \/>\n\tapplicant is a lady. He contended that age of the prosecutrix is<br \/>\n\trequired to be considered at the time of bail. He contended that<br \/>\n\tlooking to the allegations made the present applicant is wrongly<br \/>\n\tinvolved in the crime. He contended that from the contents of the<br \/>\n\tFIR it prima facie appears that concocted story is made out. He<br \/>\n\tfurther contended that looking to the circumstances of this case and<br \/>\n\tsmall kids of the present applicant she is required to be released<br \/>\n\ton bail.\n<\/p>\n<p>\tMr.H.L.Jani, learned APP<br \/>\n\tread order of the lower Court and contended that looking to the<br \/>\n\tallegations made against the present applicant lenient view is not<br \/>\n\trequired to be taken. He contended that her husband, who is the main<br \/>\n\taccused, has committed rape. He contended that looking to the<br \/>\n\tstatement of prosecutrix prima facie role of present applicant is<br \/>\n\testablished beyond reasonable doubt. He contended that applicant has<br \/>\n\trecorded videography. He has contended that it is a very serious<br \/>\n\toffence and looking to the seriousness of offence applicant is not<br \/>\n\trequired to be enlarged on bail.\n<\/p>\n<p> I<br \/>\n\thave gone through the papers produced before. I have also considered<br \/>\n\tsubmissions advanced by learned<br \/>\n\tadvocates on both the sides. At the time of hearing of bail<br \/>\n\tapplication, the Court is required to see whether there is prima<br \/>\n\tfacie involvement of the accused in commission of offence or not.<br \/>\n\tLooking to the papers produced before me, it is clearly established<br \/>\n\tthat the applicant is involved in the offence alleged against her.<br \/>\n\tFrom perusal of the papers it appears that present applicant is lady<br \/>\n\taccused, but it is not a ground to consider bail in connection with<br \/>\n\tthe serious offence committed by lady accused. From role attributed<br \/>\n\tto the present applicant it appears that she was present at the time<br \/>\n\tof incident of rape. She has also recorded videography. She has<br \/>\n\tcommitted very heinous crime. Looking to the evidence produced on<br \/>\n\trecord this is not the case for bail.\n<\/p>\n<p>\tIn view of above<br \/>\n\tobservations, this application is rejected.
