Appeal from Order No. 596 of 1997<br \/>\n          MR DJ BHATT for Appellant No.<br \/>\n          RULE SERVED BY DS for Respondent No. 1-2<br \/>\n<span class=\"hidden_text\">          SERVED BY RPAD &#8211; (R) for Respondent No. 3<\/span>\n<\/p>\n<p>     &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8211;\n<\/p>\n<p>              CORAM : HON&#8217;BLE MR.JUSTICE K.S.JHAVERI<\/p>\n<p>     Date of decision: 01\/02\/2005<\/p>\n<p>ORAL JUDGEMENT\n<\/p>\n<p>     1.The appellant has preferred this        appeal from<br \/>\n     order being aggrieved by the order        dated 15\/07\/1997<br \/>\n passed by the learned Civil Judge (S.D.), Valsad in<br \/>\napplication below exh.5 in Special Civil Suit No.75 of<br \/>\n1996, whereby the said application was rejected.\n<\/p>\n<p>2.Though served none appears for the respondents.<br \/>\nOn 17\/01\/1998, this Court had passed the following order;\n<\/p>\n<p> &#8220;The learned counsel for the appellant<br \/>\n        submitted that the bank guarantee was furnished<br \/>\n        by the appellant in favour of the respondent no.1<br \/>\n        Company. The respondent no.2 being the Executive<br \/>\n        Director of the Company, is trying to get the<br \/>\n        money    of   the   aforesaid   bank   guarantee.<br \/>\n        Proceedings for winding up of the Company have<br \/>\n        already been started and Official Liquidator has<br \/>\n        already been appointed. At the most, the bank<br \/>\n        guarantee may go to the Official Liquidator where<br \/>\n        he can file objection regarding bank guarantee.<br \/>\n        In case, the bank guarantee is encashed by the<br \/>\n        opponent no.2, she will be in great difficulty to<br \/>\n        recover the same.\n<\/p>\n<p> Notice    was issued to the respondents.\n<\/p>\n<p>          Respondent no.2 has refused to accept the same.<br \/>\n          In the facts and circumstances of the case, the<br \/>\n          respondents are directed to maintain status quo<br \/>\n          as regards payment of bank guarantee if it has<br \/>\n          not already been encashed.    Direct service is<br \/>\n          permitted.&#8221;\n<\/p>\n<p>3.In view of the facts and circumstances of the<br \/>\ncase, it would be appropriate if the trial Court is<br \/>\ndirected to expedite the hearing of the suit in question<br \/>\nwhile directing the parties to maintain the arrangement<br \/>\nas was directed by this Court by the aforesaid order.\n<\/p>\n<p>4.Accordingly, parties are directed to abide by the<br \/>\ndirections issued by this Court by order dated 17\/01\/1998<br \/>\nreferred to hereinabove, till the suit pending before the<br \/>\ntrial Court is disposed of finally. The trial Court is<br \/>\ndirected to expedite the hearing of the suit being<br \/>\nSpecial Civil Suit No.75 of 1996 and to dispose it of as<br \/>\nexpeditiously as possible and preferably within a period<br \/>\nof One Year from the date of receipt of writ of this<br \/>\norder. With the above directions, this appeal from order<br \/>\nstands disposed of.\n<\/p>\n<p> ORDER IN CIVIL APPLICATION<\/p>\n<p>In view of the order passed in the appeal from<br \/>\norder, no orders are necessary in this civil application.<br \/>\n It stands disposed of accordingly.\n<\/p>\n<p>(K.
