Against the said deposits at Santram Bank, which were<br \/>\nunder various schemes, a certificate was issued in the name of the<br \/>\npresent appellant and his family members amounting to Rs.3 Lacs, on<br \/>\nmaturity date, the amount would have fetched to the tune of Rs. 4<br \/>\nLac. The respondent No.2 &#8211; accused issued a cheque No.482710 in<br \/>\nfavour of the present appellant on 25.12.2006 of Rs.2,86,447\/- of<br \/>\nIndian Bank, Nadiad. The said cheque was deposited with Bank of<br \/>\nBaroda, Narsanda Branch on 17.1.2007, which was returned back with<br \/>\nthe endorsement of &#8220;Insufficient Fund&#8221; on 23.1.2007.<br \/>\nAfter following due process like notice, the appellant filed<br \/>\ncomplaint under Section 138 of the Negotiable Instrument Act against<br \/>\nthe accused. The same was registered as Criminal Case No.1786 of 2007<br \/>\nbefore the learned 8th  Additional Senior Civil Judge and<br \/>\nJudicial Magistrate First Class, Nadiad.\n<\/p>\n<p>2.2<br \/>\nNecessary investigation was carried out and statements of several<br \/>\nwitnesses were recorded. The trial was initiated against the<br \/>\nrespondent No.2 &#8211; accused.\n<\/p>\n<p>2.3\tTo<br \/>\nprove the case against the present accused, the prosecution has<br \/>\nexamined 1 witness  and on behalf of defence side, three witnesses<br \/>\nhave been examined and also produced various documentary evidence.\n<\/p>\n<p>2.4\tAt<br \/>\nthe end of trial,  after recording the statement of the accused   and<br \/>\nhearing arguments on behalf of prosecution and the defence side, the<br \/>\ntrial Judge acquitted the respondent of all the charges leveled<br \/>\nagainst him by judgment and order dated 21.4.2009.\n<\/p>\n<p>2.5\tBeing<br \/>\naggrieved by and dissatisfied with the aforesaid judgment and order<br \/>\npassed by the trial Court, the appellant has preferred the  Criminal<br \/>\nAppeal No.49 of 2009 before the Sessions Court, Nadiad. After<br \/>\nconsidering the record of the case, the learned Additional Judge and<br \/>\nPresiding Officer, 2nd Fast Track Court, Nadiad vide order<br \/>\ndated 15.6.2010 disposed of the Appeal on the ground that the<br \/>\nSessions Court has no jurisdiction to adjudicate the Appeal.\n<\/p>\n<p>3.\tIt<br \/>\nis contended by learned advocate Ms. Jyoti Mehta for Mr. Vijay Patel,<br \/>\nlearned advocate for the appellant, that the judgment and order of<br \/>\nthe trial Court is against the provisions of law; the trial Court has<br \/>\nnot properly considered the evidence led by the prosecution and<br \/>\nlooking to the provisions of law itself it is established that the<br \/>\nprosecution has proved the whole ingredients of the evidence against<br \/>\nthe present respondent. Learned advocate has also taken this court<br \/>\nthrough the oral as well  as the entire documentary evidence. She<br \/>\nfurther submitted that there are major contradictions between the<br \/>\ndeposition of Narhari Reva Shanker of defence witness and his<br \/>\ncross-examination. Said witness deposed that he had given cheque to<br \/>\nthe appellant without any knowledge of respondent No.2 &#8211;<br \/>\naccused and he also deposed that there was no legal outstanding of<br \/>\nthe respondent No.2. This witness admitted in his cross-examination<br \/>\nthat he was only accountant of respondent No.2 &#8211; accused and he<br \/>\nnever issued any cheque without instructions of respondent No.2. Even<br \/>\nthe said witness did not produce accounts, which were called upon.<br \/>\nLearned advocate also read the complaint and oral evidence of<br \/>\ncomplainant at Exhibit 12 and documentary evidence. She also<br \/>\nsubmitted that learned Judge has not considered both the evidence.<br \/>\nThe accused has examined three witnesses and produced documentary<br \/>\nevidence, but the learned trial Judge has wrongly considered the oral<br \/>\nevidence of the defence side and has discarded the documentary and<br \/>\noral evidence of the complainant. Therefore, the learned trial Judge<br \/>\nhas committed grave error in acquitting the respondent No.2 &#8211;<br \/>\naccused. She also prayed to allow this Appeal by quashing and setting<br \/>\naside the judgment and order passed learned trial Court.\n<\/p>\n<p>4.\tLearned<br \/>\nAPP Mr. Jani submitted that in this matter, the State is a formal<br \/>\nparty and he has only assisted the Court.\n<\/p>\n<p>5.\tHeard<br \/>\nboth the sides and perused the judgment and order passed by the trial<br \/>\nCourt. I have also perused the contents of Exhibit 41, certificate<br \/>\nissued by the bank to the complainant and Exhibit 17 Cheque. From the<br \/>\ndeposition and cross-examination of complainant at Exhibit 12, it<br \/>\nclearly proves that the complainant has failed to prove legal dues<br \/>\nagainst the accused. It appears from the admission of the complainant<br \/>\nthat he had no fixed deposits in his his own name. From Exhibit 41,<br \/>\nthe certificate, it clearly appears that appellant &#8211;<br \/>\ncomplainant has no locus standi to file the complaint. Learned trial<br \/>\nJudge has also considered the issue and the fixed deposits in the<br \/>\nbank,  wherein there were name of Vinitkumar, Jalpaben, Nishaben and<br \/>\nSnehalben, who are family members of the complainant. Therefore,<br \/>\nthere is no ground on which the complainant has claimed that he has<br \/>\nevidence to say that the said amount, which would be recovered from<br \/>\nthe accused, by way of this complaint, his legal dues. Learned trial<br \/>\nJudge has also observed in para 19 of his judgment that in the<br \/>\ncross-examination of the complainant, it was asked to the complainant<br \/>\nthat whether the complainant has any evidence of outstanding amount<br \/>\nagainst  the accused and the complainant replied that there is only<br \/>\ncheque for which the complaint was lodged. Therefore, it is clear<br \/>\nthat the complainant has no right to file the complaint against the<br \/>\naccused as there was no legal dues against the accused.\n<\/p>\n<p>6.\tIn<br \/>\na recent decision of the Apex Court in the case of <a href=\"\/doc\/585040\/\">State<br \/>\nof Goa V. Sanjay Thakran &amp; Anr. Reported<\/a> in (2007)3 SCC 75,<br \/>\nthe  Court has reiterated the powers of the High Court in such cases.<br \/>\nIn para 16 of the said decision the Court has observed as under:\n<\/p>\n<p>&#8220;16.\tFrom<br \/>\nthe aforesaid decisions, it is apparent that while exercising the<br \/>\npowers in appeal against the order of acquittal the Court of appeal<br \/>\nwould not ordinarily interfere with the order of acquittal unless the<br \/>\napproach of the lower Court is vitiated by some manifest illegality<br \/>\nand the conclusion arrived at would not be arrived at by any<br \/>\nreasonable person and, therefore, the decision is to be characterized<br \/>\nas perverse. Merely because two views are possible, the Court of<br \/>\nappeal would not take the view which would upset the judgement<br \/>\ndelivered by the  Court below. However, the appellate court has a<br \/>\npower to review the evidence if it is of the view that the conclusion<br \/>\narrived at by the Court below is perverse and the Court has committed<br \/>\na manifest error of law and ignored the material evidence on record.<br \/>\nA duty is cast upon the appellate court, in such circumstances, to<br \/>\nre-appreciate the evidence to arrive to a just decision on the basis<br \/>\nof material placed on record to find out whether any of the accused<br \/>\nis connected with the commission of the crime he is charged with.&#8221;\n<\/p>\n<p>7.\tSimilar<br \/>\nprinciple has been laid down by the Apex  Court  in the cases of<br \/>\nState of<br \/>\nUttar Pradesh Vs. Ram Veer Singh &amp; Ors, reported in 2007 AIR SCW<br \/>\n5553 and<br \/>\nin Girja<br \/>\nPrasad (Dead) by LRs Vs. state of MP, reported in 2007 AIR SCW 5589.<br \/>\nThus, the powers which this Court may exercise against an order of<br \/>\nacquittal are well settled.\n<\/p>\n<p>8.\tIt<br \/>\nis also a settled legal position that in acquittal appeal, the<br \/>\nappellate court is not required to re-write the judgement or to give<br \/>\nfresh reasonigns, when the reasons assigned by the Court below are<br \/>\nfound to be just and proper. Such principle is laid down by the Apex<br \/>\nCourt in the  case of State<br \/>\nof Karnataka Vs. Hemareddy, reported in AIR 1981 SC 1417<br \/>\nwherein it is held as under:\n<\/p>\n<p>&#8220;&#8230;\n<\/p>\n<p>This<br \/>\ncourt has observed in Girija Nandini Devi V. Bigendra Nandini<br \/>\nChaudhary (1967)1 SCR 93: (AIR 1967 SC 1124) that it is not the duty<br \/>\nof the appellate court when it agrees with the view of the trial<br \/>\ncourt on the evidence to repeat the narration of the evidence or to<br \/>\nreiterate the reasons given by the trial court expression of general<br \/>\nagreement with the reasons given by the Court the decision of which<br \/>\nis under appeal, will ordinarily suffice.&#8221;\n<\/p>\n<p>9.\tThus,<br \/>\nin case the  appellate court agrees with the reasons and the opinion<br \/>\ngiven by the lower court, then the discussion of evidence is not<br \/>\nnecessary.\n<\/p>\n<p>10.\tI<br \/>\nhave gone through the judgment and order passed by the trial court. I<br \/>\nhave also perused the oral as well as documentary evidence led by the<br \/>\ntrial court and also considered the submissions made by learned<br \/>\nadvocate for the appellant. Thus, from the evidence itself it is<br \/>\nestablished that the prosecution has not proved its case beyond<br \/>\nreasonable doubt.\n<\/p>\n<p>11.\tMs.\n<\/p>\n<p>Jyoti Mehta, learned advocate is not in a position to show any<br \/>\nevidence to take a contrary view of the matter or that the approach<br \/>\nof the trial court is vitiated by some manifest illegality or that<br \/>\nthe decision is perverse or that the trial court has ignored the<br \/>\nmaterial evidence on record.\n<\/p>\n<p>12.\tIn<br \/>\nthe above view of the matter, I am of the considered opinion that the<br \/>\ntrial court was completely justified in acquitting the respondent of<br \/>\nthe charges leveled against him.\n<\/p>\n<p>13.\tI<br \/>\nfind that the findings recorded by the trial court are absolutely<br \/>\njust and proper and in recording the said findings, no illegality or<br \/>\ninfirmity has been committed by it.\n<\/p>\n<p>14.\tI<br \/>\nam, therefore, in complete agreement with the findings, ultimate<br \/>\nconclusion and the resultant order of acquittal recorded by the court<br \/>\nbelow and hence find no reasons to interfere with the same. Hence the<br \/>\nappeal is hereby dismissed.
