SHAH\n\t\t\n\t\n\n \n\nDate\n: 30\/09\/2010 \n\n \n\n \n \n\n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\t\tBy<br \/>\nway of this petition under Article 227 of the Constitution of India,<br \/>\nthe petitioners &#8211; ONGC and another have prayed for an<br \/>\nappropriate writ, order and\/or direction, quashing and setting aside<br \/>\nthe impugned order dated 28\/01\/2004 passed in Complaint (IT) No.7 of<br \/>\n2002 in Reference (ITC) No.70\/2000.\n<\/p>\n<p>2.\t\tMr.T.R.Mishra,<br \/>\nlearned advocate appearing on behalf of the concerned workmen, has<br \/>\nstated at the bar that the concerned workmen have been reinstated<br \/>\nin-service and are also paid the wages for post idle period and,<br \/>\ntherefore, it is submitted that as such no cause survive in the<br \/>\npresent petition.\n<\/p>\n<p>3.\t\tMr.Kunan<br \/>\nNaik, learned advocate appearing on behalf of the petitioners has<br \/>\nsubmitted that he has no further instruction in the matter. However,<br \/>\nhe has requested to dispose of the present petition accordingly,<br \/>\nreserving liberty in favour of the petitioners to revive the present<br \/>\npetition by filing appropriate application in case of difficulty.\n<\/p>\n<p>4.\t\tIn<br \/>\nview of the above, the present petition is disposed of as no cause<br \/>\nsurvive in view of the subsequent development, reserving liberty  in<br \/>\nfavour  of  the petitioners to revive the present petition by filing<br \/>\nappropriate application in case of difficulty.
