The bus \n\nRama Temple bus stop at Annasandra Palya for   H\n\nthe passengers. Corporation. On appreciation of \u00a3h.\u00e9fev1de\ufb01\u00a2\u00a2.qh ‘record, the

After deducting 10% of the compensation out of the saigd<\/p>\n
amount, the Tribunal awarded a compensationgll\ufb01of<\/p>\n
Rs.3, 14,100\/-.\n<\/p>\n
4. Learned Counsel for the <\/p>\n
would contend that having  to.” the  on
\nrecord, the Tribunal was not  attributing only
\n10% of the negligence to i’EtS11bn1itted that
\neven as per the.vc_oro..plaiiit’  deceased<\/p>\n
was alighting__.ti1e .btis.,.’;’xvhei1_titwas  the move. Therefore,<\/p>\n
the TribL1_nal_ sholiJ_ld…h3aVe’attributed contributory negligence
\nto an extenttto 5O%._to’-ltAhe_’deceased. It is further submitted<\/p>\n
that the\u00bb deceased “Wash aged 56 years at the time of<\/p>\n
 laceidlent. 3–.”which is clear from the post mortem report.<\/p>\n
intiltiplier to be applied is 9 as per the<\/p>\n
decision Apex Court in SARALA VARMA AND<\/p>\n

excessive. On the other hand, learned Counsel forthe<\/p>\n
claimants submits that the deceased was not respo_nsib\u00abIe”‘.V’<\/p>\n
for the accident in any manner. Therefore, deducting’  ‘<\/p>\n
of the compensation is itself erroneous… It is iutrthesrfpargzled <\/p>\n
that the award of compensation by the Tifii3una1._is  7.’<\/p>\n
proper.\n<\/p>\n
5. I have carefuliy”considerzedu arguments of the
\nlearned Counsel for tb\u00a2””i-\\.’.’~–1′:tie\\9″‘ ,\u00a5’9_adev_ ifthe Bar and
\nperused the mai:eria1s’_piaced\u20ac  record.’ it <\/p>\n
6.   for the appellant\/ Corporation
\nhas made’eya:1ab1eV_’ti;g:~.;\u00a5e\u00a2\u00a7fa:;’ of the Tribunal. A careful<\/p>\n
perusal . of th4e”c:ornp1ain-tdfiled by P.W.2 shows that the<\/p>\n
“VV’decea’.’9ed iwasivi.alightingthe bus when it was on move. in<\/p>\n
his =e\\fidenee’; hehas given a different version. The Tribunal<\/p>\n
  was ofthe  that at an undisputed point of time when<\/p>\n
 ‘ ‘RW.  ..hirnseIf has stated in the complaint that the<\/p>\n
 deceas-ed was alighting the bus when it was moving.<\/p>\n
 the said version, the Tribunal attributed<\/p>\n

contributory negligence at 10% on the deceased. The<\/p>\n
finding of fact recorded by the Tribunal is on appreciation<\/p>\n
of the evidence on record and the said finding does not”<\/p>\n
for interference. As per the RM. report, the dec.easerl:Vp’v.;tas*. ”<\/p>\n
aged about 56 years. As per Sara1a_.VarzT1a’s’ <\/p>\n
