This petition is pending<br \/>\nadmission hearing since February, 2005. Inspite of the completed<br \/>\npleadings the petition is not heard because Mr.Paul has been filing<br \/>\nsick notes. On 4th October, 2005 this Court had made order<br \/>\nas under :\n<\/p>\n<p>?SLearned advocate<br \/>\nMr.Paul has filed sick-note. S.O. to 10th October, 2005.<br \/>\nThe petition is pending admission hearing for almost a year.<br \/>\nHence-forth, there shall not be further adjournment either on the<br \/>\nground of sick-note or leave note or for want of presence of either<br \/>\nof the learned advocate.??\n<\/p>\n<p>Nevertheless, today Mr.Paul<br \/>\nhas filed sick note. The matter should proceed hearing today. Heard<br \/>\nthe learned advocate Mr.Thacker.\n<\/p>\n<p>\tThe petitioner is a<br \/>\nDriver-cum-Pump Operator employed by the respondent ?  Jamnagar<br \/>\nMunicipal Corporation (hereinafter referred to as, ?Sthe<br \/>\nCorporation??). It is the grievance of the petitioner that<br \/>\nthough he has been appointed as Driver-cum-Pump Operator he has been<br \/>\nassigned the duty of a Mechanic and has been called to function as a<br \/>\nMechanic. The petitioner has thus been serving as a Mechanic for over<br \/>\na period of ten years. Nevertheless, the petitioner has been paid the<br \/>\nsalary of a Driver-cum-Pump Operator. It is the demand of the<br \/>\npetitioner that since he has been performing the duties of a Mechanic<br \/>\nhe should be paid the salaries as a Mechanic and not as a<br \/>\nDriver-cum-Pump Operator. According to the petitioner prior to 1st<br \/>\nApril, 1996 the prevalent pay-scales for Driver-cum-Pump Operator and<br \/>\nfor Mechanic in the Fire Department of the Corporation were<br \/>\nRs.950-1500 and Rs.1200-2040 respectively. Since 1st<br \/>\nApril, 1996 the said scales have been revised to that of Rs.3050-4590<br \/>\nand Rs.4000-6000 respectively.\n<\/p>\n<p>\tThe petition is contested<br \/>\nby the Corporation. Mr.Thacker has submitted that it is not in<br \/>\ndispute that by order dated 7th July, 1994 the petitioner,<br \/>\nthen a Pump Operator, was promoted and posted as Driver-cum-Pump<br \/>\nOperator in then prevailing pay scale of Rs.950-1500. He has<br \/>\nsubmitted that it is also not in dispute that the petitioner has been<br \/>\nassigned duties of a Mechanic and has been serving as a Mechanic in<br \/>\nthe Fire Department as alleged. He has, however, submitted that it is<br \/>\nnot true that the pay scale of a Mechanic is higher than that of a<br \/>\nDriver-cum-Pump Operator. He has submitted that the Driver-cum-Pump<br \/>\nOperators and the Mechanics in the Fire Department were placed in the<br \/>\ncommon pay scale of Rs.950-1500 which has since been revised to<br \/>\nRs.3050-4590. He has submitted that the pay scale of Rs.1200-2040 was<br \/>\nassigned to the post of Head Mechanic and has since been revised to<br \/>\nRs.4000-6000. He has submitted that the petitioner had never been<br \/>\nassigned the duties of a Head Mechanic nor was he called upon to<br \/>\nfunction as Head Mechanic. The petitioner&#8217;s claim for higher salary<br \/>\nof Rs.1200-2040 (prevalent prior to 1st April, 1996) is<br \/>\nmisconceived and requires to be rejected.\n<\/p>\n<p>\tThe petitioner has produced<br \/>\na copy of the pay scale prevalent in the Corporation and settled<br \/>\nbefore the Industrial Tribunal, Rajkot in Reference IT No.227\/1987.<br \/>\nAccording to the said settlement several posts in the Fire Department<br \/>\nincluding the posts of Driver-cum-Pump Operator and Mechanic had been<br \/>\ngrouped under a common pay scale of Rs.950-1500 under Item No.14.<br \/>\nWhereas, the pay scale of Rs.1200-2040 was sanctioned under Item<br \/>\nNo.11 for several posts including the post of Senior Clerk, Head<br \/>\nMechanic, Vehicle Controller, etc. Thus, the claim of the petitioner<br \/>\nthat the post of Mechanic shall fetch higher pay scale is ex-facie<br \/>\nfalse. The claim of the petitioner is totally misconceived and devoid<br \/>\nof any merit.\n<\/p>\n<p>\tIn above view of the matter<br \/>\nthe petition is summarily rejected.
