DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 11\/02\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.<br \/>\n        Rule.\n<\/p>\n<p>Mr.  learned APP, waives service of notice of Rule for respondent &#8211;<br \/>\nState.\n<\/p>\n<p>2.\t\tThis<br \/>\napplication is filed under Section 439 of the Code of Criminal<br \/>\nProcedure in connection with first information report registered<br \/>\nbeing CR No.I- 339 of 2010  with Shaherkotda Police Station,  for the<br \/>\noffences punishable under Sections 454, 457, 480 of the Indian Penal<br \/>\nCode.\n<\/p>\n<p>3.\t\tLearned<br \/>\ncounsel appearing for the petitioner submits that  the charge sheet<br \/>\nis filed and beyond the circumstances under control and salary of the<br \/>\npetitioner was not paid, the allegations levelled appear to be not<br \/>\nwell founded about the commissioning of alleged crime.  In view of<br \/>\nthe above, it is submitted by the learned Advocate that by imposing<br \/>\nsuitable conditions, the petitioner may be enlarged on bail.\n<\/p>\n<p>\t\tHeard learned<br \/>\nAPP  for the respondent &#8211; State who opposed grant of bail<br \/>\nlooking to the role attributed to the accused and the punishment<br \/>\nprescribed.\n<\/p>\n<p>4.\t\tI have  heard<br \/>\nlearned counsel for the parties and perused the record of the case.<br \/>\nPrima facie, it appears that the petitioner has repeated the offence<br \/>\nat the same place and muddamal was recovered but considering the<br \/>\nprovisions about the alleged offence vis-a-vis the  punishment<br \/>\nprescribed for the alleged offences and the same is triable by the<br \/>\nlearned Magistrate and now charge sheet is filed,  by imposing<br \/>\nsuitable condition, I am inclined to enlarge the petitioner on bail.\n<\/p>\n<p>\t\tLearned counsel<br \/>\nfor the parties do not press for further reasoned order.\n<\/p>\n<p>5.\t\tIn the facts<br \/>\nand circumstances of the case, the application is allowed and the<br \/>\npetitioner is ordered to be released on bail in connection with first<br \/>\ninformation report registered being  C.R. No.I- 339 of 2010  with<br \/>\nShaherkotda Police Station on executing a bond of Rs.5,000\/- (Rupees<br \/>\nFive thousand only) with one surety of the like amount to the<br \/>\nsatisfaction of the trial Court and subject to the conditions that he<br \/>\nshall;\n<\/p>\n<p>not<br \/>\n\ttake undue advantage of liberty or misuse liberty;\n<\/p>\n<p>not<br \/>\n\tact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>surrender<br \/>\n\tpassport, if any, to the lower court within a week;\n<\/p>\n<p>not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p>mark<br \/>\n\tpresence at the concerned police station on the first Sunday of<br \/>\n\tevery month between 10.00 a.m. and 3.00 p.m. for three months only;\n<\/p>\n<p>furnish<br \/>\n\tthe present address of his residence to the I.O. and also to the<br \/>\n\tCourt at the time of execution of the bond and shall not change the<br \/>\n\tresidence without prior permission of this Court;\n<\/p>\n<p>The<br \/>\n\tpetitioner is ordered to remain out of Ahmedabad for a period<br \/>\n\tof three months except for marking presence and for attending the<br \/>\n\ttrial.\n<\/p>\n<p>\t\tThe<br \/>\nAuthorities will release the petitioner only if not required in<br \/>\nconnection with any other offence for the time being.\n<\/p>\n<p>\t\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>\t\tBail<br \/>\nbond to be executed before the lower court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p> At the trial, the trial court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the petitioner on bail.\n<\/p>\n<p>\t\tRule<br \/>\nis made absolute to the aforesaid extent.
