SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 09\/02\/2011 \n\n \n\n \n \n\n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tMs.\n<\/p>\n<p>Jayshree Hingorani, learned advocate for Ms. Bhaya, learned advocate<br \/>\nfor the applicant seeks permission to delete respondent no.4 driver<br \/>\nof the offending vehicle so far as present application is concerned.<br \/>\nPermission is accordingly granted. Respondent no.4 is permitted to be<br \/>\ndeleted. Though served, nobody appears on behalf of respondent\n<\/p>\n<p>-original claimant and the owner of the offending vehicle in<br \/>\nquestion.\n<\/p>\n<p>2.\tPresent<br \/>\napplication has been preferred by the applicant herein-original<br \/>\nopponent no.3.- The New India Assurance Co. Ltd for interim relief to<br \/>\nstay further implementation, execution and operation of the judgment<br \/>\nand award dated 7.5.2010 passed by the learned Motor Accident Claims<br \/>\nTribunal (Auxi), Surat passed in MACP No.465 of 2004.\n<\/p>\n<p>3.\tAppeal<br \/>\nagainst the impugned judgment and award passed by the Tribunal is<br \/>\nalready admitted by this Court. On Civil Application for interim<br \/>\nrelief this Court passed the following order on 13.12.2010:\n<\/p>\n<p>&#8220;Rule<br \/>\nreturnable on 25.1.2011.\n<\/p>\n<p>Ad-interim<br \/>\nrelief in terms of para 5(A) on condition that the amount awarded by<br \/>\nthe Tribunal concerned shall be deposited by the appellant- Insurance<br \/>\nCompany with the Tribunal before the returnable date. On such deposit<br \/>\nbeing made, the Tribunal concerned shall invest the same in Fixed<br \/>\nDeposit with a  Nationalized Bank on long term basis. Further orders<br \/>\nregarding investment \/disbursal shall be passed on the returnable<br \/>\ndate&#8221;.\n<\/p>\n<p>3.1.\tAs<br \/>\nstated above, though served nobody appears on behalf of the original<br \/>\nclaimants. Under the circumstances, ad-interim relief granted earlier<br \/>\nis directed to be continued as interim relief till final disposal of<br \/>\nmain First Appeal. Tribunal is directed to invest the entire amount<br \/>\nas awarded by the Tribunal along with interest and cost in Fixed<br \/>\nDeposit in any Nationalized Bank for long term basis in the name of<br \/>\nNazir and continued to renew the same from time to time, as required.<br \/>\nHowever, claimants shall be entitled to withdraw periodical interest<br \/>\non the same which shall be paid to the original claimants by Account<br \/>\nPayee Cheque on proper verification.
