SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 06\/08\/2008 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p>\tBy<br \/>\n\tway of this petition under Article 227 of the Constitution of India,<br \/>\n\tthe petitioner &#8211; Surat Municipal Corporation  has prayed for<br \/>\n\tappropriate writ, order and\/or directions, for quashing and setting<br \/>\n\taside the judgement and order dtd.10\/1\/2006  passed by the learned<br \/>\n\tPresiding Officer, FTC No.4, Surat in Regular Civil Appeal No.49 of<br \/>\n\t2003 in dismissing the same and confirming the judgement and order<br \/>\n\tdtd. 5\/5\/2001 passed by the learned Civil Judge (S.D.), Surat  in<br \/>\n\tMunicipal Tax Appeal No.25 of 1999.\n<\/p>\n<p>\tThe<br \/>\n\trespondents are owners of property situated in Chauta Bazar, Surat.<br \/>\n\tThe petitioner ?  Surat Municipal Corporation  assessed ratable<br \/>\n\tvalue of the property of the respondent and issued notice to the<br \/>\n\trespondent dtd.10\/8\/1999, the respondent raised objection and<br \/>\n\tthereafter the petitioner &#8211; Surat Municipal Corporation  assessed<br \/>\n\trent of the property in question at the rate of Rs.1200 per month<br \/>\n\tand the annual assessment  was fixed at Rs.14,400.  Being aggrieved<br \/>\n\tby and dissatisfied with the said assessment, the respondent<br \/>\n\tpreferred Original Tax Appeal under secs.406 and 407 of the Bombay<br \/>\n\tProvincial and Municipal Corporation  Act. It was the contention on<br \/>\n\tbehalf of the respondent that standard rent of the premises in<br \/>\n\tquestion was fixed at the rate of Rs.201 per month and therefore,<br \/>\n\tthe Surat Municipal Corporation  cannot go beyond the standard rent<br \/>\n\tand arbitrarily fixed the annual assessment at  Rs.14,400. It was<br \/>\n\talso contention on behalf of the respondent that the Surat Municipal<br \/>\n\tCorporation   had not given them opportunity and arbitrarily fixed<br \/>\n\tthe rent and therefore, it was prayed to quash and set aside the<br \/>\n\tnotice dtd.10\/8\/1995 and consequently  to quash and set aside the<br \/>\n\tassessment order dtd.10\/9\/1999. That the learned Civil Judge (S.D.),<br \/>\n\t  allowed the said appeal and directed the Surat Municipal<br \/>\n\tCorporation  to fix the assessment \/ tax considering the rent at the<br \/>\n\trate of Rs.201 per month of the property in question. Being<br \/>\n\taggrieved by and dissatisfied with the order passed by the learned<br \/>\n\tCivil Judge (S.D.), Surat in directing the Surat Municipal<br \/>\n\tCorporation  to fix the tax at the rate of Rs.201 per month<br \/>\n\tconsidering the standard rent, the petitioner preferred Regular<br \/>\n\tCivil Appeal No.49 of 2003 before the appellate court, which came to<br \/>\n\tbe heard  by the learned Presiding Officer, FTC No.4, Surat. It was<br \/>\n\tthe contention on behalf of the Surat Municipal Corporation  that<br \/>\n\treliance placed upon the order passed by the learned Civil Judge<br \/>\n\tfixing the standard rent at the rate of Rs.201, was consent decree<br \/>\n\tand it was not fair standard rent and the same was not fixed by the<br \/>\n\tCivil Court after adjudication on merits and therefore, the same<br \/>\n\tcannot be relied upon.\n<\/p>\n<p>\tThe<br \/>\n\tpetitioner also relied upon the decision of the learned Single Judge<br \/>\n\tof this Court in the case of P.M. Parmar Vs. Ambaben<br \/>\n\tHargovandas, reported in 1995 (1) G.L.H. 950.\n<\/p>\n<p>\tHowever, the learned appellate court  dismissed the said application<br \/>\n\tconfirming the order passed by the learned Civil Judge (S.D.), Surat<br \/>\n\tby observing that the decision of this Court in the case of   P.M.<br \/>\n\tParmar Vs. Ambaben Hargovandas (supra) would<br \/>\n\tnot be applicable as it is applicable to Small Cause Judge who has<br \/>\n\tfixed the standard rent. Being aggrieved by the order passed by both<br \/>\n\tthe courts below in directing the petitioner ?  Surat Municipal<br \/>\n\tCorporation   to fix the assessment \/ tax considering the rent at<br \/>\n\tthe rate of Rs.201 per month, as determined by the Court while<br \/>\n\tdeciding the standard rent, the petitioner ?  Surat Municipal<br \/>\n\tCorporation  has preferred present Special Civil Application under<br \/>\n\tArticle 227  of the Constitution of India.\n<\/p>\n<p>\tHeard<br \/>\n\tMr.Asthawadi, learned advocate appearing on behalf of Mr.Prashant<br \/>\n\tG.Desai, learned advocate for the petitioners. Though served no body<br \/>\n\tappears on behalf of the respondents.\n<\/p>\n<p>\tConsidering<br \/>\n\tthe impugned order passed by both the courts below, it appears that<br \/>\n\tboth the courts below have heavily relied upon the decision of the<br \/>\n\trent court determining the standard rent at the rate of Rs.201 per<br \/>\n\tmonth and thereby quashed the impugned assessment\/tax bill issued by<br \/>\n\tthe petitioner ?  Corporation. However, it is to be noted that so<br \/>\n\tfar as the decision of the rent court fixing the standard at the<br \/>\n\trate of Rs.201 per month is concerned, the same is a consent decree<br \/>\n\tand the said rent is not decided after adjudication on merits. Under<br \/>\n\tthe circumstances, both the courts below have materially erred in<br \/>\n\tassessing and\/or considering the fair rent at the rate of Rs.201 per<br \/>\n\tmonth. Identical question came to be  considered by the learned<br \/>\n\tSingle Judge of this Court in the case of P.M. Parmar (supra). In<br \/>\n\tthe said case   consent terms were relied upon while deciding the<br \/>\n\tdispute with respect to the standard rent and the standard rent was<br \/>\n\taccordingly fixed without recording any evidence and without<br \/>\n\tassigning any reason whatsoever  and in the said case it is observed<br \/>\n\tby the learned Single Judge of this Court that ?SIt is undoubtedly<br \/>\n\ttrue that the consent decree is nothing but contract between the<br \/>\n\tparties to which is superseded  the seal of the Court, but the Court<br \/>\n\t which is called upon to perform its statutory duty of fixing the<br \/>\n\tstandard rent shall have to be more vigilant, judicious and<br \/>\n\tconscious when it is without any support, documentary or otherwise,<br \/>\n\traising standard rent.?? It is also to be noted that even the said<br \/>\n\tconsent decree on the basis of the consent terms and\/or agreement<br \/>\n\twas by and between the landlord and the tenant ?  respondents<br \/>\n\therein, in which the petitioner Corporation was not a party and<br \/>\n\ttherefore, even otherwise the said consent decree cannot bind the<br \/>\n\tpetitioner Corporation. The said consent decree fixing the standard<br \/>\n\trent at the rate of Rs.201 per month cannot be the base to consider<br \/>\n\tthe assessment \/ tax. Under the circumstances, it appears that both<br \/>\n\tthe courts have materially erred in relying upon the decision of the<br \/>\n\tCivil Court \/ Rent Court determining the standard rent at the rate<br \/>\n\tof Rs.201 per month, which was on the basis of consent terms between<br \/>\n\tthe landlord and the tenant and the said rent was not adjudicated on<br \/>\n\tmerits.  Under the circumstances, both the impugned orders  passed<br \/>\n\tby the courts below require to be quashed and set aside and the<br \/>\n\tmatter is required to be remanded to the learned trial court for<br \/>\n\tdeciding the Municipal Tax Appeal No.25 of 1999 afresh in accordance<br \/>\n\twith law and on merits and ignoring the decision of the rent court<br \/>\n\tdetermining the rent of Rs.201 per month fixed by consent terms.\n<\/p>\n<p>\tFor<br \/>\n\tthe reasons stated above, the petition succeeds. The order<br \/>\n\tdtd.5\/5\/2001 passed by the learned Civil Judge (S.D.), Surat in<br \/>\n\tMunicipal Tax Appeal No.25 of 1999 as well as the judgement and<br \/>\n\torder dtd.10\/1\/2006  passed by the learned Presiding Officer, FTC<br \/>\n\tNo.4, Surat in Regular Civil Appeal No.49 of 2003, are hereby<br \/>\n\tquashed and set aside and the matter is remanded back to the learned<br \/>\n\tCivil Judge (S.D.), Surat to decide and dispose of Municipal Tax<br \/>\n\tAppeal No.25 of 1999 afresh, in accordance with law and on merits,<br \/>\n\tin light of the observations made hereinabove.  The said exercise to<br \/>\n\tbe completed within a period of six months from the date of receipt<br \/>\n\tof this order.  Registry to send the writ of this order to the trial<br \/>\n\tcourt immediately. Rule is made absolute accordingly.
