No.7252 of 2010<\/p>\n<p>                               Heard counsel for the petitioner and the<\/p>\n<p>                   counsel appearing for the State.\n<\/p>\n<p>                           The writ application has been filed by the<\/p>\n<p>                   petitioner for a direction to the respondents to<\/p>\n<p>                   regularize the service of the petitioner in Class IV post<\/p>\n<p>                   and   for    giving   consequential   benefits   fixing   his<\/p>\n<p>                   seniority on the date of his joining as Class IV post as<\/p>\n<p>                   daily wage worker. Petitioner&#8217;s case is that being<\/p>\n<p>                   selected in July, 1994 till now he has worked in<\/p>\n<p>                   different capacity at different places and at the time of<\/p>\n<p>                   filing of the writ application, he had already worked<\/p>\n<p>                   for more than 2660 days. The qualification of the<\/p>\n<p>                   petitioner is Graduate and he belongs to extremely<\/p>\n<p>                   backward class. The panel of daily wagers prepared as<\/p>\n<p>                   per their seniority in the year 2006, indicated that<\/p>\n<p>                   petitioner is placed at serial no. 103. This fact has also<\/p>\n<p>                   been admitted in the counter affidavit filed by the<\/p>\n<p>                   respondent along with which the panel prepared<\/p>\n<p>                   according to seniority of the daily wager has been<br \/>\n<span class=\"hidden_text\">                     2<\/span><\/p>\n<p>annexed as Annexure-A, in which the petitioner is at<\/p>\n<p>serial No. 103.\n<\/p>\n<p>        Petitioner&#8217;s case is that despite the fact that<\/p>\n<p>several sanctioned vacant posts are lying vacant, the<\/p>\n<p>respondent authorities are not regularizing the daily<\/p>\n<p>wagers. Regularization is being done without following<\/p>\n<p>the order of seniority, on the basis of pick and choose<\/p>\n<p>method.\n<\/p>\n<p>        In the counter affidavit at Para 11 it has been<\/p>\n<p>stated that seniority list of daily wages worker was<\/p>\n<p>prepared     on    26.9.2006     which    was        subsequently<\/p>\n<p>modified on 14.6.2007. 66 candidates out of that list<\/p>\n<p>has been regularized against 66 vacant posts. As per<\/p>\n<p>this counter affidavit, number of vacancies in the year<\/p>\n<p>2007 was only 66 and only candidates listed in the<\/p>\n<p>panel up to 66 serial numbers were regularized.<\/p>\n<p>        I.A. No. 7252 of 2010 has been filed by the<\/p>\n<p>petitioner    in    order   to    bring        the    subsequent<\/p>\n<p>development, on the record of the case. Along with<\/p>\n<p>the   interlocutory     application,     the    petitioner   has<\/p>\n<p>annexed the list of vacancies available in the district<\/p>\n<p>of Buxar in different departments and the position of<\/p>\n<p>the vacancies as per the reservation roaster available<\/p>\n<p>in different categories and also the panel prepared by<br \/>\n<span class=\"hidden_text\">                     3<\/span><\/p>\n<p>the   District    Selection    Committee       on    9.4.2010<\/p>\n<p>considering the position of vacancy and roaster<\/p>\n<p>position for adjustment of candidates as per their<\/p>\n<p>seniority against such vacancies. The number of<\/p>\n<p>vacancies available for the candidates belonging to<\/p>\n<p>extremely backward category is nine. In the seniority<\/p>\n<p>panel petitioner&#8217;s position is seventh.<\/p>\n<p>          Counsel for the petitioner submits that as per<\/p>\n<p>panel prepared by the District Selection Committee<\/p>\n<p>cases of others, who are there in the panel in the<\/p>\n<p>extremely backward category is being considered or<\/p>\n<p>have already been considered. So far petitioner is<\/p>\n<p>concerned, an order in          this regard has not been<\/p>\n<p>passed, for the reason that his writ application is<\/p>\n<p>pending before this Court.\n<\/p>\n<p>          The materials brought on record by way of<\/p>\n<p>interlocutory application and the documents annexed<\/p>\n<p>with the interlocutory application, shows entitlement<\/p>\n<p>of petitioner for absorption against the 7th available<\/p>\n<p>vacancy     in    extremely     backward      category.   The<\/p>\n<p>respondents are directed to pass necessary orders for<\/p>\n<p>absorption of the petitioner against vacancy shown in<\/p>\n<p>the   seniority    panel,     approved   by    the   Selection<\/p>\n<p>Committee on 9.4.2010. It is directed that the<br \/>\n<span class=\"hidden_text\">                              4<\/span><\/p>\n<p>           petitioner should be absorbed against the vacancy<\/p>\n<p>           available in this panel before expiry of the life of the<\/p>\n<p>           panel   which   presumably   is   going   to     expire   on<\/p>\n<p>           16.7.2011.\n<\/p>\n<p>                   The Interlocutory application as well as the<\/p>\n<p>           writ application is allowed. The respondents are<\/p>\n<p>           directed to regularize the service of the petitioner in<\/p>\n<p>           Class IV post with all consequential benefits within<\/p>\n<p>           four      weeks       from        the          date       of<\/p>\n<p>           presentation\/communication of this order.<\/p>\n<p>                                    ( Mridula Mishra, J.)<br \/>\nA.
