Judge, Junagadh in Land Acquisition Reference Case<br \/>\n\tNo.49 of 1981.\n<\/p>\n<p>The<br \/>\n\tfacts in short are  that  lands of the claimants were acquired by<br \/>\n\tthe State of Gujarat for Uben Irrigation Scheme in 1979 under a<br \/>\n\tnotification under Sec.4 of the Land Acquisition Act (hereinafter<br \/>\n\treferred  to  as  `the Act&#8217;) published on  22-2-1979 Thereafter, a<br \/>\n\tnotification under Sec.6 was published on 23-6-1979 in the Govt.<br \/>\n\tGazette and notification under Sec.9 of the Act was also issued<br \/>\n\tinviting objections from interested persons.    The  Land<br \/>\n\tAcquisition Officer passed the award on the basis of evidence<br \/>\n\tproduced before him awarding compensation for the irrigated lands,<br \/>\n\tnon-irrigated lands and waste lands. Being aggrieved by the same,<br \/>\n\tthe claimants moved references under Sec.18 of  the  Act  and  the<br \/>\n\tReference  Court  by the impugned order not only enhanced<br \/>\n\tcompensation granted by the Special Land Acquisition Officer but<br \/>\n\talso awarded compensation for standing trees existed in the lands of<br \/>\n\tthe claimants along with solatium under Sec.23(2) of the Act and<br \/>\n\tinterest @ 9% p.a. However, no amount was granted under Sec.23(1-A)<br \/>\n\tof the Act. Being aggrieved by the said judgment and award, present<br \/>\n\tappeal is preferred by the original claimants.\n<\/p>\n<p>Heard<br \/>\n\tlearned counsel, Mr.Amar D.Mithani for the appellants and learned<br \/>\n\tAGP,Mr.N.J.Shah for the respondent Nos.1 to 3.\n<\/p>\n<p>Mr.Mithani,<br \/>\n\tlearned counsel for the appellants,  taking this Court through the<br \/>\n\tevidence of the appellants-original claimants as well as the<br \/>\n\tdefendants, submitted that it is specifically claimed by the<br \/>\n\tclaimants that at the time of acquisition, there were 11 mango trees<br \/>\n\tin their field which has also been admitted by the defendants&#8217;<br \/>\n\twitness, Deputy Executive Engineer, Irrigation Department. He also<br \/>\n\ttook this Court through the joint measurement report produced at<br \/>\n\tEx.90 before the trial court  to substantiate his submission. As far<br \/>\n\tas other aspects are concerned, Mr.Mithani submitted that as per the<br \/>\n\tamendment in the Land Acquisition Act, the claimants are entitled to<br \/>\n\tget benefit as per Sec.23(1-A) and Sec.28 of the Act. He relied on<br \/>\n\ta decision of the Apex Court in the case of  Atma Singh<br \/>\n\t(died) through L. Rs. and Ors. v. State of Haryana and Anr. reported<br \/>\n\tin  AIR 2008 SC p.709.\n<\/p>\n<p>Learned<br \/>\n\tAGP, Mr.N.J.Shah, for the State could not convince this Court as to<br \/>\n\twhether only one mango tree was standing in the field of the<br \/>\n\tclaimants at the time of acquisition. He however submitted that<br \/>\n\trelying on the joint measurement report Ex.90, deposition of the<br \/>\n\tDeputy Executive Engineer was recorded  and hence, the original<br \/>\n\tclaimants could not prove the factum of existence of 11 mango trees.\n<\/p>\n<p>There<br \/>\n\tis no substance in the said submission since nothing is coming out<br \/>\n\tfrom the judgment as to whether any objection has been raised by the<br \/>\n\trespondents about the joint measurement sheet Ex.90 which is<br \/>\n\tprepared by the Acquisition Officer in presence of the claimant<br \/>\n\twherein signature of the claimant  was also obtained. In the cross<br \/>\n\texamination of witness of the defendants also, it has been admitted<br \/>\n\tthat  there were 11 mango trees in the field of the claimants. Apart<br \/>\n\tfrom that, nothing is produced on record by the defendants to show<br \/>\n\tthat said report is false or concocted by the plaintiffs. It seems<br \/>\n\tthat the trial court granted compensation for only one mango tree<br \/>\n\tthough it was duly established by the claimants that there were 11<br \/>\n\tmango trees existed at the time of acquisition of their lands.\n<\/p>\n<p>In<br \/>\n\tview of the above, in the opinion of this Court, there is no reason<br \/>\n\tto deny the compensation for the additional trees existed in the<br \/>\n\tfield of the claimants. It is however to be noted that the claimants<br \/>\n\thave claimed compensation for only 9 mango trees and hence, they<br \/>\n\tcannot be granted more than what has been claimed. Hence, the<br \/>\n\tclaimants are entitled to compensation for additional 8 (eight)<br \/>\n\tmango trees. As far as quantum of compensation and other aspects are<br \/>\n\tconcerned, the Reference Court, after discussing the evidence on<br \/>\n\trecord, came to the conclusion and partly allowed the references and<br \/>\n\tawarded just and adequate compensation, which, in the opinion of<br \/>\n\tthis Court, is not required to be interfered with.\n<\/p>\n<p>Thus,<br \/>\n\tthe appeal is partly allowed. The claimants are entitled to get<br \/>\n\tcompensation for additional 8 (eight) mango trees @ Rs.8000\/-<br \/>\n\t(Rupees Eight Thousand only) per mango tree together with the<br \/>\n\tbenefit accrued to them under Secs.23(1A) and 28 of the Act.
