The petitioner to carry out the same.\n<\/p>\n<p>2.\t\tRule.\n<\/p>\n<p>Mr.M.R.Mengdey, learned Additional Public Prosecutor waives service<br \/>\nof notice of Rule on behalf of respondent No.1 and Mr.Rajesh Deval,<br \/>\nlearned advocate waives service of notice of Rule on behalf of<br \/>\nrespondent No.2 &#8211; original complainant.\n<\/p>\n<p>3.\t\tIn<br \/>\nthe facts and circumstances of the case and with the consent of the<br \/>\nlearned advocates appearing on behalf of the respective parties and<br \/>\nin view of the settlement between the parties, the present petition<br \/>\nis taken up for final hearing today.\n<\/p>\n<p>4.\t\tBy<br \/>\nway of this petition under Article 226 of the Constitution of India<br \/>\nread with Section 482 of the Code of Criminal Procedure, the<br \/>\npetitioner &#8211; original accused has prayed for an appropriate<br \/>\nwrit, order and\/or direction, quashing and setting aside the impugned<br \/>\ncomplaint \/ FIR being C.R.No.I-85\/2010 registered with Valia Police<br \/>\nStation, which has been lodged against the petitioner &#8211;<br \/>\noriginal accused by respondent No.2 &#8211; original complainant for<br \/>\nthe offence punishable under Sections 406 and 420 of the Indian Penal<br \/>\nCode.\n<\/p>\n<p>5.\t\tIt<br \/>\nappears from the impugned complaint \/ FIR that the petitioner is<br \/>\npower of attorney holder of Abeysinh Harisinh Mangrola, who was the<br \/>\nowner of the land bearing Block No.91 admeasuring 23144 sq.meters.<br \/>\nThat the said land was converted from Agricultural Use to<br \/>\nNon-agricultural Use and was sub-plotted. It appears that on<br \/>\n19\/09\/2002, respondent No.2 &#8211; original complainant purchased<br \/>\ntwo plots bearing Nos.37 &amp; 38 of Block No.91 from said Abeysinh<br \/>\nHarisinh Mangrola and the petitioner being power of attorney holder<br \/>\nof    said Abeysinh Harisinh Mangrola executed a sale deed in favour<br \/>\nof respondent No.2 on sale consideration of Rs.40,000\/- with respect<br \/>\nto aforesaid two plots. It appears that respondent No.2 sold<br \/>\naforesaid two plots i.e. Plot Nos.37 &amp; 38 to Ritaben Manharbhai<br \/>\nPatel by registered sale deed. It appears that the said Ritaben found<br \/>\nthat Plot No.37 was earlier sold to Umanglal Shankerlal Doshi and he<br \/>\nwas in possession of the said plot and despite the same, it was sold<br \/>\nto Ritaben, the said Ritaben brought the said fact to the notice of<br \/>\nthe petitioner  and, therefore, respondent No.2 served Notice upon<br \/>\nthe petitioner on 3\/4\/2010.\n<\/p>\n<p>6.\t\tIt<br \/>\nis the case on behalf of the petitioner that an obvious mistake was<br \/>\ncommitted when plots were sold to respondent No.2 and, therefore, the<br \/>\npetitioner immediately agreed to cure the mistake by offering another<br \/>\nplot to the said Ritaben. However, some time was required and in the<br \/>\nmeantime, respondent No.2 had lodged the aforesaid complaint with<br \/>\nValia Police Station on 13\/07\/2010 for alleged commission of offence<br \/>\npunishable under Sections 406 and 420 of the Indian Penal Code.<br \/>\nHence, the petitioner has preferred the present Special Criminal<br \/>\nApplication to quash and set aside the impugned FIR by submitting<br \/>\nthat the petitioner has not committed any offence as alleged against<br \/>\nhim for the offence punishable under Sections 406 and 420  of the<br \/>\nIndian Penal Code and there was no intention to cheat the respondent<br \/>\nNo.2. It is submitted that it was an obvious mistake committed at the<br \/>\ntime when plot was sold to respondent No.2 and having realized the<br \/>\nmistake, the petitioner agreed to cure the said mistake by offering<br \/>\none another plot to subsequent purchaser i.e. Ritaben.\n<\/p>\n<p>7.\t\tToday<br \/>\nwhen the present petition is taken up for final hearing, Mr.Rajesh<br \/>\nDeval, learned advocate had appeared on behalf of respondent No.2 &#8211;<br \/>\noriginal complainant. Learned advocates appearing on behalf of the<br \/>\nrespective parties have stated at the bar that the purchaser i.e.<br \/>\nRitaben Manharbhai Patel had purchased the said plot No.37 from<br \/>\nrespondent No.2, agreed for the settlement and to accept Plot No.91<br \/>\nin lieu of Plot No.37. A sale deed is also executed in favour of the<br \/>\nsaid Ritaben  on 15\/11\/2010 and the said Ritaben is satisfied with<br \/>\nthe same and, therefore, neither respondent No.2 nor the said Ritaben<br \/>\nhave any grievance. Rajesh Deval, learned advocate appearing on<br \/>\nbehalf of respondent No.2 has stated at the bar, under the<br \/>\ninstruction received from respondent No.2, who is personally present<br \/>\nin the Court, that in light of the above, he has no objection, if the<br \/>\nimpugned complaint \/ FIR is quashed and set aside.\n<\/p>\n<p>\t\tIn<br \/>\nview of the above and in the facts and circumstances of the case and<br \/>\nsubsequent development as narrated hereinabove and even otherwise<br \/>\nconsidering the facts in the complaint, this Court is of the opinion<br \/>\nthat it cannot be said that the petitioner has committed an offence<br \/>\npunishable under Sections 406 and 420 of the Indian Penal Code and,<br \/>\ntherefore, the impugned complaint deserves to be quashed and set<br \/>\naside in exercise of power under Section 482 of the Code of Criminal<br \/>\nProcedure.\n<\/p>\n<p>8.\t\tIt<br \/>\nappears that there is a bonafide mistake on the part of the<br \/>\npetitioner in allotting Plot No.37 to respondent No.2, which was<br \/>\nalready sold to the another person earlier and having brought to his<br \/>\nnotice, he has already cured the mistake by allotting and handing<br \/>\nover possession of another Plot in lieu of Plot No.37. It appears to<br \/>\nthe Court that no case is made out against the petitioner for the<br \/>\noffence punishable under Sections 406 and 420 of the Indian Penal<br \/>\nCode. Considering the aforesaid facts and circumstances of the case,<br \/>\nthe petition deserves to be allowed and the impugned compliant<br \/>\ndeserves to be quashed and set aside.\n<\/p>\n<p>9.\t\tFor<br \/>\nthe reasons stated hereinabove, the petition succeeds and the<br \/>\nimpugned complaint\/FIR being C.R.No. I-85\/2010 registered with Valia<br \/>\nPolice Station is hereby quashed and set aside.
