JUSTICE MOHIT S. SHAH)<\/p>\n<p> ORDER<br \/>\nIN L.P.A. NO.1172 OF 2008 :\n<\/p>\n<p>\tMr.D.B.Rana,<br \/>\nlearned counsel for the appellant states that, without challenging<br \/>\nthe order of the learned Single Judge, the petitioner is ready and<br \/>\nwilling to pay market fees in respect of the transactions under which<br \/>\nthe petitioner had sold the goods within the market area of<br \/>\nrespondent No.2 ?  Market Committee.  Mr.Rana further states that<br \/>\nthe petitioner has given the break up of such transactions in<br \/>\nAnnexure ?SB?? to this appeal memo.  Mr.Rana also states that the<br \/>\npetitioner will, accordingly, make an application to respondent No.2<br \/>\n?  Market Committee for refund of the fees in respect of the<br \/>\ntransactions under which the petitioner had sold the goods outside<br \/>\nthe market area and such application will be made under Rule 49(1)(i)<br \/>\nof the Gujarat Agricultural Produce Market Rules, 1965.\n<\/p>\n<p>\tIn<br \/>\nview of the above statements, we dispose of this appeal with a<br \/>\ndirection to the Agriculture Produce Market Committee, Vadhvan,<br \/>\nrespondent No.2 herein, to consider the petitioner&#8217;s application in<br \/>\naccordance with the Rules.
