Heard both sides.\n<\/p>\n<p>\t3. A re&#8217;sume&#8217; of facts absolutely necessary and germane for the disposal<br \/>\nof this Civil Miscellaneous Appeal would run thus:\n<\/p>\n<p>\tThe Tribunal vide Judgement dated 28.06.2002 has awarded compensation to a<br \/>\ntune of Rs.1,52,580\/- (Rupees one lakh fifty two thousand five hundred and<br \/>\neighty only) on the following sub-heads:\n<\/p>\n<p>\tFor loss of income\t&#8211;\tRs.   3,080\/-\n<\/p>\n<p>\tduring treatment period<\/p>\n<p>\tFor medical expenses\t&#8211;\tRs.   2,500\/-\n<\/p>\n<p>\tFor pain and sufferings &#8211;\tRs.   5,000\/-\n<\/p>\n<p>\tFor extra nourishment\t&#8211;\tRs.   1,000\/-\n<\/p>\n<p>\tFor permanent partial<br \/>\n\tdisability\t\t\tRs.  40,000\/-\n<\/p>\n<p>\tFor transportation\t&#8211;\tRs.   1,000\/-\n<\/p>\n<p>\tFor future loss of income\tRs.1,00,000\/-\n<\/p>\n<blockquote><p>\t\t\t\t\t&#8212;&#8212;&#8212;&#8212;-<br \/>\n\t\t\tTotal\t&#8211;\tRs.1,52,580\/-\n<\/p><\/blockquote>\n<p>\t\t\t\t\t&#8212;&#8212;&#8212;&#8212;-<\/p>\n<p>\t4. Being aggrieved by and dissatisfied with, the Judgment and decree of<br \/>\nthe Tribunal this appeal<\/p>\n<p>has been filed on the main grounds that the Tribunal committed error in awarding<br \/>\na sum of Rs.1,00,000\/- (Rupees one lakh only) towards future loss of income in<br \/>\naddition to awarding a sum of Rs.40,000\/- (Rupees forty thousand only) towards<br \/>\npermanent partial disability.\n<\/p>\n<p>\t5. The point for consideration is as to whether the Tribunal arrived at<br \/>\n&#8216;just compensation&#8217;?\n<\/p>\n<p>6.On Point:\n<\/p>\n<p>\tThe learned counsel for the appellant Tamil Nadu State Transport<br \/>\nCorporation reiterated what are all stated in the grounds of appeal, whereas the<br \/>\nlearned counsel for the first respondent\/claimant would submit that because of<br \/>\nthe accident, the injured lost his employment under the very same appellant<br \/>\nitself; in fact, the accident occurred while he was working as temporary<br \/>\nconductor in that bus and hence the Tribunal was justified in awarding a sum of<br \/>\nRs.1,00,000\/- (Rupees one lakh only) towards future loss of income.\n<\/p>\n<p>\t7. Taking into consideration the decision of this Court in Cholan Roadways<br \/>\nCorporation Ltd., rep. by its Managing Director, Kumbakonam-612 001 v. Ahmed<br \/>\nThambi and others reported in 2006(4) CTC 433, just compensation should be<br \/>\nawarded for the permanent disability and pain and sufferings sustained by the<br \/>\nindividual.  While awarding compensation for the permanent disability the fact<br \/>\nremains that that compensation amount takes care of the future loss of income<br \/>\nalso and as such separately under the caption future loss of income,<br \/>\ncompensation should not be awarded and that would amount to duplication of<br \/>\nawarding of damages.  Adhering to the above said Full Bench decision of this<br \/>\nCourt, I am of the considered opinion that the compensation awarded could be<br \/>\nvaried as under.\n<\/p>\n<p>\t8. Admittedly and indubitably, the first respondent\/claimant sustained 43%<br \/>\npermanent disability as he sustained fracture of his left forearm.  Taking into<br \/>\naccount the fact that the injured was 31 years old at the relevant time of the<br \/>\naccident, at the rate of Rs.2000\/- (Rupees two thousand only) for each<br \/>\npercentage of permanent disability, the compensation could be awarded and<br \/>\naccordingly if worked out, it comes to (43X2000=86,000\/-) Rs.86,000\/- (Rupees<br \/>\neighty six thousand only).\n<\/p>\n<p>\t9. The Tribunal awarded a sum of Rs.3,080\/- (Rupees three thousand and<br \/>\neighty) only towards loss of income during the treatment period.  I am of the<br \/>\nconsidered opinion that the amount could be enhanced to Rs.10,000\/- (Rupees ten<br \/>\nthousand only) as at least he might not have been able to carry on with any<br \/>\navocation for two months.\n<\/p>\n<p>\t10. Under the caption pain and sufferings, the Tribunal awarded a sum of<br \/>\nRs.5,000\/- (Rupees five thousand only) and that could be enhanced to Rs.10,000\/-<br \/>\n(Rupees ten thousand only) taking into account the seriousness of the injury.\n<\/p>\n<p>\t11. Under the captions extra nourishment and transportation, the Tribunal<br \/>\nawarded a sum of Rs.1000\/- (Rupees one thousand only) each and that could be<br \/>\nenhanced to Rs.2,000\/- (Rupees two thousand only) under each caption.\n<\/p>\n<p>\t12. Under the count &#8216;medical expenses&#8217; a sum of Rs.2,500\/- (Rupees two<br \/>\nthousand and five hundred only) was awarded and that can be left as such in view<br \/>\nof there being no challenge made as against it.\n<\/p>\n<p>\t13. The awarding of a sum of Rs.1,00,000\/- (Rupees one lakh only) under<br \/>\nthe caption future loss of income and a sum of Rs.40,000\/- (Rupees forty<br \/>\nthousand only) under the caption permanent partial disability by the Tribunal<br \/>\nare set aside.  Accordingly, the compensation is modified as under:\n<\/p>\n<p>\tFor loss of income<br \/>\n \tduring treatment period\t\tRs.  10,000\/-\n<\/p>\n<p>\tFor medical expenses\t&#8211;\tRs.   2,500\/-\n<\/p>\n<p>\tFor pain and sufferings &#8211;\tRs.  10,000\/-\n<\/p>\n<p>\tFor extra nourishment\t&#8211;\tRs.   2,000\/-\n<\/p>\n<p>\tFor permanent partial<br \/>\n\tdisability\t\t\tRs.  86,000\/-\n<\/p>\n<p>\tFor transportation\t&#8211;\tRs.   2,000\/-\n<\/p>\n<p>\t\t\t\t\t&#8212;&#8212;&#8212;&#8212;-\n<\/p>\n<p>\t\tTotal\t\t&#8211;\tRs.1,12,500\/-\n<\/p>\n<p>\t\t\t\t\t&#8212;&#8212;&#8212;&#8212;-\n<\/p>\n<p>\t14. In the result, this Civil Miscellaneous Appeal is partly allowed and<br \/>\nthe award of the Tribunal is reduced from Rs.1,52,580\/- (Rupees one lakh fifty<br \/>\ntwo thousand five hundred and eighty only) to Rs.1,12,500\/- (Rupees one lakh<br \/>\ntwelve thousand and five hundred only).  The Tribunal awarded 9% interest, over<br \/>\nwhich there is no challenge.  Hence, it is left as such.
