The suit was contested by defendants 1<\/p>\n<p>to 3 only. When the case was at the stage of recording of defence<\/p>\n<p>evidence, the matter was sent to Lok Adalat where the plaintiffs and the<\/p>\n<p>contesting defendants compromised the matter. So far as defendant No.11<\/p>\n<p>was concerned, he had admitted the claim of the plaintiff earlier and he<\/p>\n<p>was only a proforma defendant. The application of defendant No.11 has<\/p>\n<p>been allowed and he has been permitted to be transposed as plaintiff only<\/p>\n<p>on the ground that if the defendants and the plaintiffs compromise the<\/p>\n<p>matter, it will affect his rights, therefore, for complete adjudication of the<\/p>\n<p>suit and for avoiding multiplicity of proceedings, the transposing of<\/p>\n<p>defendant No.11 was allowed.\n<\/p>\n<p><span class=\"hidden_text\"> Civil Rev. 3914 OF 2008                           2<\/span><\/p>\n<p>            I have heard learned counsel for the petitioner. No one has put<\/p>\n<p>in appearance on behalf of the respondents despite service.<\/p>\n<p>            The trial court has ignored the fact that defendant No.11 was a<\/p>\n<p>proforma defendant and that he had admitted the claim of the plaintiffs. By<\/p>\n<p>permitting him to be transposed as plaintiff after the plaintiffs compromised<\/p>\n<p>the matter with defendants 1 to 3, he will be permitted to resile out of the<\/p>\n<p>admission made by him.
