Justice K.T.SANKARAN\n\n Dated :22\/12\/2009\n\n O R D E R\n                          K.T.SANKARAN, J.\n             ------------------------------------------------------\n                       B.A. NO. 7360 OF 2009\n             ------------------------------------------------------\n           Dated this the 22nd day of December, 2009\n\n\n                                O R D E R\n<\/pre>\n<p>       This is an application for anticipatory bail under Section 438 of<\/p>\n<p>the Code of Criminal Procedure. The petitioner is the first accused<\/p>\n<p>in Crime No.474 of 2009 of Kondotty Police Station, Malappuram<\/p>\n<p>District.\n<\/p>\n<\/p>\n<p>       2.    The offence alleged against the petitioner is under<\/p>\n<p>Section 498A read with Section 34 of the Indian Penal Code.<\/p>\n<p>       3.    Heard the learned counsel for the petitioner and the<\/p>\n<p>learned Public Prosecutor.\n<\/p>\n<\/p>\n<p>       4.    Taking into account the facts and circumstances of the<\/p>\n<p>case, the nature of the offence and other circumstances, I am of the<\/p>\n<p>view that anticipatory bail can be granted to the petitioner.<\/p>\n<p>       5. There will be a direction that in the event of the arrest of the<\/p>\n<p>petitioner, the officer in charge of the police station shall release him<\/p>\n<p>B.A. NO. 7360 OF 2009<\/p>\n<p>                                    :: 2 ::\n<\/p>\n<p>on bail on his executing bond for Rs.15,000\/- with two solvent<\/p>\n<p>sureties for the like amount to the satisfaction of the officer<\/p>\n<p>concerned, subject to the following conditions:<\/p>\n<blockquote><p>      a)    The petitioner shall appear before the investigating<br \/>\n            officer for interrogation as and when required;<\/p>\n<\/blockquote>\n<blockquote><p>      b)    The petitioner shall not try to influence the prosecution<br \/>\n            witnesses or tamper with the evidence;\n<\/p><\/blockquote>\n<blockquote><p>      c)    The petitioner shall not commit any offence or indulge in<br \/>\n            any prejudicial activity while on bail;<\/p>\n<\/blockquote>\n<blockquote><p>      d)    In case of breach of any of the conditions mentioned<br \/>\n            above, the bail shall be liable to be cancelled.<\/p>\n<p>      The Bail Application is allowed to the extent indicated above.<\/p><\/blockquote>\n<p>                                                   (K.T.SANKARAN)<br \/>\n                                                          Judge<\/p>\n<p>ahz\/<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Abdul Latheef vs State Of Kerala on 22 December, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 7360 of 2009() 1.
