(Oral)\n<\/pre>\n<p>          Present petition has been preferred by the petitioners under<\/p>\n<p>Section 438 Cr.P.C. praying for pre-arrest bail in case FIR No. 74 dated<\/p>\n<p>20.2.2009 registered at Police Station Sadar, Patiala, under Sections<\/p>\n<p>342, 380, 448, 511, 427, 506, 148, 149 &amp; 120-B IPC and 25\/27 Arms<\/p>\n<p>Act.\n<\/p>\n<p>          On 9.3.2009, this Court had passed the following order:-<\/p>\n<blockquote><p>                             &#8220;Counsel for the petitioner has stated that<\/p>\n<p>                   complainant is grand son of the real brother of<\/p>\n<p>                   petitioner No.1. Parties are involved in civil litigation.<br \/>\n<span class=\"hidden_text\"> Criminal Misc. No. M-6581 of 2009                                          2<\/span><\/p>\n<p>                 Counsel for the petitioner has placed reliance upon<\/p>\n<p>                 Annexure P3 a civil suit pending between the<\/p>\n<p>                 parties. It has been further submitted that all<\/p>\n<p>                 offences except offence falling under Section 380<\/p>\n<p>                 IPC are bailable. Perusal of allegations as noticed<\/p>\n<p>                 in the impugned order show that a gas cylinder was<\/p>\n<p>                 taken away by a number of persons who came<\/p>\n<p>                 allegedly on the dead of night armed with weapons.<\/p>\n<p>                 No injury has been caused in the occurrence.<\/p>\n<\/blockquote>\n<blockquote><p>                           At this stage, Mr. Rajinder Kumar Singla,<\/p>\n<p>                 Advocate,    has    caused      appearance          for   the<\/p>\n<p>                 complainant. He has stated that along with gas<\/p>\n<p>                 cylinder, container for storing 5\/6 bags of wheat, one<\/p>\n<p>                 sofa and other household articles were taken.<\/p>\n<\/blockquote>\n<blockquote><p>                           The probability of the version stated by the<\/p>\n<p>                 complainant is to be verified during course of<\/p>\n<p>                 investigation.   Custodial     interrogation        of    the<\/p>\n<p>                 petitioners may not be necessary.\n<\/p><\/blockquote>\n<blockquote><p>                           Issue notice of motion to learned Advocate<\/p>\n<p>                 General, Punjab, for 27.3.2009.\n<\/p><\/blockquote>\n<blockquote><p>                           Meanwhile,      in   the   event     of     arrest,<\/p>\n<p>                 petitioners shall be released on interim bail to the<\/p>\n<p>                 satisfaction of the Arresting Officer. Petitioners shall<\/p>\n<p>                 join investigation as and when called for. Petitioners<\/p>\n<p>                 shall also abide by the conditions specified under<\/p>\n<p>                 Section 438(2) Cr.P.C.&#8221;\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\"> Criminal Misc. No. M-6581 of 2009                                         3<\/span><\/p>\n<blockquote>\n<\/blockquote>\n<p>          It is essentially a civil dispute between the family members.<\/p>\n<p>          Counsel for the State, on instructions from Karnail Singh,<\/p>\n<p>Head Constable, submits that petitioners have joined investigation but<\/p>\n<p>recovery of gas cylinder, sofa set, six quintals wheat drum containing<\/p>\n<p>wheat, bricks, guarder is to be effected.<\/p>\n<p>          Taking the entire gamut of case into consideration, custodial<\/p>\n<p>interrogation of the petitioners is not required.<\/p>\n<p>          In view of the statement made by counsel for the State and<\/p>\n<p>order dated 9.3.2009       passed by this Court, interim pre-arrest bail<\/p>\n<p>granted to the petitioners is affirmed till filing of the report under Section<\/p>\n<p>173 Cr.P.C.
