NO. 859 OF 2005\n            = = = = = = = = = = = = = = =\n        Dated this the 27th day of June, 2008.\n\n                     J U D G M E N T\n<\/pre>\n<p>     This appeal is preferred against the award of the Motor<\/p>\n<p>Accidents Claims Tribunal, Muvattupuzha in O.P.(MV)94\/01.<\/p>\n<p>The Tribunal has awarded a compensation of Rs.22,513\/-<\/p>\n<p>with 9% interest per annum from the date of application to<\/p>\n<p>the date of deposit. The Tribunal repelled the contention of<\/p>\n<p>the insurance company regarding its non liability on the<\/p>\n<p>ground that it has not been proved that the violation of the<\/p>\n<p>condition is so fundamental as to have contributed to the<\/p>\n<p>accident. The said finding has been based on the decision of<\/p>\n<p>the Apex Court reported in Swaran Singh&#8217;s case <a href=\"\/doc\/1827019\/\">National<\/p>\n<p>Insurance Co. Ltd. v. Swaran Singh<\/a> (2004 (1) KLT<\/p>\n<p>781). A reading of paragraph 102, (iii) and (vi) would reveal<\/p>\n<p>that,<\/p>\n<p>               &#8220;To avoid its liability towards insured,<\/p>\n<p>         the insurer has to prove that the insured<\/p>\n<p>         was guilty of negligence and failed to<\/p>\n<p>         exercise reasonable care in the matter of<\/p>\n<p>M.A.C.A. 859 OF 2005<br \/>\n<span class=\"hidden_text\">                                 -:2:-<\/span><\/p>\n<p>         fulfilling the condition of policy regarding the<\/p>\n<p>         use of vehicles by duly licensed driver or one<\/p>\n<p>         who was not disqualified to drive at the<\/p>\n<p>         relevant time.&#8221;\n<\/p>\n<p>    The Apex Court further held that,<\/p>\n<p>            &#8220;Even where the insurer is able to prove<\/p>\n<p>    breach on the part of the insured concerning the<\/p>\n<p>    policy condition regarding holding of a valid licence<\/p>\n<p>    by the driver or his qualification to drive during the<\/p>\n<p>    relevant period, the insurer would not be allowed<\/p>\n<p>    to avoid its liability towards insured unless the said<\/p>\n<p>    breach or breaches of the condition of driving<\/p>\n<p>    licence is\/are so fundamental as are found to have<\/p>\n<p>    contributed to the cause of the accident.&#8221;<\/p>\n<p>    It is also laid down in that decision,<\/p>\n<p>          &#8220;The insurance companies are, however, with<\/p>\n<p>    a view to avoid their liability must not only<\/p>\n<p>    establish the available defences raised in the said<\/p>\n<p>    proceedings but must also establish breach on the<\/p>\n<p>    part of the owner of the vehicle, the burden of<\/p>\n<p>    proof therefor would be on them.&#8221;\n<\/p>\n<p>    So unless these ingredients are proved and established<\/p>\n<p>when there is a policy the insurance company cannot get<\/p>\n<p>M.A.C.A. 859 OF 2005<br \/>\n<span class=\"hidden_text\">                             -:3:-<\/span><\/p>\n<p>absolved from the liability to the insurer.  The Tribunal<\/p>\n<p>applying the dictum laid down by the Apex Court in the<\/p>\n<p>above said decision has arrived at a finding that there is<\/p>\n<p>nothing to prove those facts and therefore negatived the<\/p>\n<p>contentions of the insurance company.    As facts are not<\/p>\n<p>proved, there is no ground to interfere with the decision<\/p>\n<p>rendered by the Tribunal and therefore the MACA is<\/p>\n<p>dismissed.\n<\/p>\n<\/p>\n<p>                          M.N.
