Justice THOMAS P.JOSEPH\n\n Dated :08\/09\/2010\n\n O R D E R\n                     THOMAS P.JOSEPH, J.\n            ====================================\n                     W.P(C) No.27609 of 2010\n            ====================================\n         Dated this the 08th    day of September,   2010\n\n\n                         J U D G M E N T\n<\/pre>\n<p>      Defendant No.3 in O.S.No.330 of 2003 of the court of learned<\/p>\n<p>Munsiff, Thalassery is the petitioner before me.         Preliminary<\/p>\n<p>judgment and decree for partition were passed observing in<\/p>\n<p>paragraph six of the judgment that possession of petitioner over<\/p>\n<p>portion of the property (where he is said to have constructed a<\/p>\n<p>building) is to be protected to the extent possible while effecting<\/p>\n<p>partition by metes and bounds. Grievance of petitioner is that<\/p>\n<p>Advocate Commissioner while preparing       Ext.P2, report and plan<\/p>\n<p>has disregarded that direction. Petitioner filed Ext.P3, objection to<\/p>\n<p>the   report and plan      on 17.07.2008 requesting the      learned<\/p>\n<p>Munsiff to set aside Ext.P2, report and plan. But without<\/p>\n<p>considering the objection learned Munsiff is about to pass a final<\/p>\n<p>decree. Petitioner seeks a direction to the learned Munsiff to<\/p>\n<p>consider Ext.P3, objection.\n<\/p>\n<\/p>\n<p>      2.    If petitioner has preferred an objection to Ext.P2, report<\/p>\n<p>and plan there is no reason to think that learned Munsiff will<\/p>\n<p>W.P(C) No.27609 of 2010<br \/>\n<span class=\"hidden_text\">                                 -: 2 :-<\/span><\/p>\n<p>disregard the objection and pass a final decree. It will be open to<\/p>\n<p>petitioner to urge the objection before the learned Munsiff.<\/p>\n<p>      With the above observation, this Writ Petition is closed.<\/p>\n<p>                                  THOMAS P.
