Justice P.N.RAVINDRAN\n\n Dated :20\/07\/2010\n\n O R D E R\n         J.Chelameswar, CJ. &amp; P.N.Ravindran, J.\n          - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n                      W.A.No. 1157 OF 2010\n          - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n              Dated this the 20th day of July, 2010\n\n                             JUDGMENT\n<\/pre>\n<p>J.Chelameswar, CJ.\n<\/p>\n<p>      The unsuccessful petitioner in W.P.(C) No.3043 of 2010 is<\/p>\n<p>the appellant herein. He was employed by the State as a<\/p>\n<p>driver on daily wage basis from 1994 onwards. Apprehending<\/p>\n<p>that   his  services      are    likely    to    be    terminated,    the<\/p>\n<p>petitioner\/appellant approached this Court praying that his<\/p>\n<p>service may be dispensed with until a regular employee is<\/p>\n<p>appointed. By the judgment under appeal the learned Judge<\/p>\n<p>dismissed   the    writ    petition     on    the    ground      that the<\/p>\n<p>petitioner\/appellant has no enforceable legal right.<\/p>\n<p>      2. Heard Sri.M.V. Bose, the learned counsel appearing<\/p>\n<p>for the appellant and Sri.Benny Gervasis, the learned Senior<\/p>\n<p>Government Pleader appearing for the respondents.<\/p>\n<p>      3. Nothing is brought to our notice to demonstrate that<\/p>\n<p>the judgment under appeal needs interference, except stating<\/p>\n<p>that a lenient view may be taken in view of his provisional<\/p>\n<p>WA No. 1157 of 2010<br \/>\n<span class=\"hidden_text\">                              -:2:-<\/span><\/p>\n<p>service of more than 10 years. We are afraid such a discretion is<\/p>\n<p>not available to this Court.
