15.   28.04.2011           Heard learned counsel for the petitioner and<\/p>\n
                   the State.\n<\/p>\n
                           Petitioners in both the Writ Applications are<\/p>\n
                   retired Government employees. Their application is<\/p>\n
                   for a direction to the Respondents to re-imburse the<\/p>\n
                   expenses incurred by them over their treatment, in<\/p>\n
                   the light of the Order of the High Court, dated<\/p>\n
                   27.03.1996, passed in C.W.J.C. No. 7891 of 1995.<\/p>\n
                           Both the petitioners have undergone surgery
\n                    2<\/span><\/p>\n
for their heart ailment and in that regard they have<\/p>\n
incurred expenses and also have spent money for<\/p>\n
purchasing medicines.\n<\/p>\n
        Petitioners    have   represented        their     case<\/p>\n
before the concerned authorities after being released<\/p>\n
from the hospital, but till date right from 2002 their<\/p>\n
matter is lingering and no re-imbursement has been<\/p>\n
allowed to them.\n<\/p>\n
        Petitioners    case   is   that    the   Pensionary<\/p>\n
Samaj, which is a society, registered under the<\/p>\n
Societies Registration Act had earlier filed a Writ<\/p>\n
Application vide C.W.J.C. No. 7891 of 1995, in which<\/p>\n
the claim of the petitioner was for a direction to the<\/p>\n
Government that the pensioners be reimbursed of<\/p>\n
any money spent by them either as indoor or<\/p>\n
outdoor patients in any recognized institute of all<\/p>\n
India repute without any reference by Government<\/p>\n
Doctors for going for treatment in those institutes.<\/p>\n
The   Writ   Application   was     disposed      of   noticing<\/p>\n
Government Circular, whereby the facility of re-<\/p>\n
imbursement     have    not    been       allowed     to    the<\/p>\n
pensioners as per clause 21 of that Circular. The<\/p>\n
Writ Application was disposed of giving direction to<\/p>\n
the State to frame scheme within three months from
\n                  3<\/span><\/p>\n
the date of Order for making proper arrangements<\/p>\n
to re-imburse the amount to the pensioners for the<\/p>\n
medicines, which could not be made available to<\/p>\n
them from the Government dispensaries and they<\/p>\n
had to purchase from open market. It was also<\/p>\n
directed that pensioners shall be entitled to re-<\/p>\n
imburse from the Government Departments where<\/p>\n
they served, for the medicines they had to buy for<\/p>\n
the pensioners or their wives and so far clause 21 of<\/p>\n
the Circular was concerned, which negatived the<\/p>\n
facility of reimbursement to the pensioners that was<\/p>\n
struck   down.   In   this   Writ   Application   specific<\/p>\n
direction was issued to the State Government to<\/p>\n
give facility of reimbursement to the pensioners. The<\/p>\n
Order was passed in the Writ Application on 27th of<\/p>\n
March, 1996, but till date no scheme has been<\/p>\n
framed by the State Government.\n<\/p>\n
         From the Counter Affidavit filed in the Writ<\/p>\n
Applications, it transpires that in stead of framing<\/p>\n
any scheme or rule as per the direction of the Court,<\/p>\n
the Department of Health, Government of Bihar<\/p>\n
came out with a resolution, contained in Memo No.<\/p>\n
5308, dated 24.07.2001, whereby medical allowance<\/p>\n
of Rs. 1,00\/- per month was made available to the
\n                    4<\/span><\/p>\n
pensioners. As informed, subsequently, this amount<\/p>\n
is enhanced to Rs. 2,00\/- per month. But so far a<\/p>\n
full fledged scheme relating to reimbursement of<\/p>\n
medical expenses to the pensioners are concerned,<\/p>\n
has not been framed as yet.\n<\/p>\n
         Counsels,          appearing      on     behalf      of\n\nRespondent     State,        have      informed      that    the\n\n<\/pre>\n
Government has framed a scheme, that is still<\/p>\n
awaiting for approval of the Cabinet and in the<\/p>\n
meantime the Respondent Authorities are examining<\/p>\n
the medical facilities available in other States to<\/p>\n
their employees and the pensioners.\n<\/p>\n
         I fail to understand that the issue like<\/p>\n
reimbursement        of      medical      expenses     to    the<\/p>\n
petitioners or the Government employees whether<\/p>\n
can be delayed for such a long period. The order was<\/p>\n
passed in the Writ Application in the year 1996 that<\/p>\n
was also affirmed by the Apex Court in the year<\/p>\n
1998. We are in the year 2011 and the claim of the<\/p>\n
petitioners   relating       to   reimbursement       of    their<\/p>\n
medical bills incurred in 2001 and 2004-05 are still<\/p>\n
awaiting for framing of a scheme in this regard.<\/p>\n
Without going into the intricacies of the policy<\/p>\n
making    powers       of   the   State    Government       and
\n                           5<\/span><\/p>\n
      interference in this matter by the judiciary, I direct<\/p>\n
      the Respondents to reimburse the amounts claimed<\/p>\n
      by the petitioner, which incurred while undergoing<\/p>\n
      treatment for their heart ailment. Petitioners have<\/p>\n
      already      represented       their     matters   before<\/p>\n
      Respondents Authorities and that is pending for such<\/p>\n
      a   long    time.   The    Respondents    Authorities   are<\/p>\n
      directed to make reimbursement of entire medical<\/p>\n
      expenses, which the petitioners have incurred in<\/p>\n
      their treatment. Petitioners can not be denied his<\/p>\n
      facilities in anticipation of framing of any scheme by<\/p>\n
      the State Government or its approval by the<\/p>\n
      competent authority. All payments must be made to<\/p>\n
      the petitioners within four weeks from the date of<\/p>\n
      production \/ communication of this Order.<\/p>\n
                 With the aforesaid observations, both the<\/p>\n
      Writ Applications are allowed.\n<\/p>\n<\/p>\n
