Justice P.N.RAVINDRAN\n\n Dated :21\/12\/2010\n\n O R D E R\n                                                                                   C.R.\n                     C.N.RAMACHANDRAN NAIR,\n                        BHABANI PRASAD RAY, &amp;\n                              P.N.RAVINDRAN, JJ.\n               ....................................................................\n                        Writ Appeal No.1262 of 2009\n               ....................................................................\n               Dated this the 21st day of December, 2010.\n\n                                      JUDGMENT\n<\/pre>\n<p>Ramachandran Nair, J.\n<\/p>\n<p>      The specific question referred to the Full Bench by a Division<\/p>\n<p>Bench of this court is whether a building with two residential<\/p>\n<p>apartments owned by the same person should be assessed as a single<\/p>\n<p>building in his name as the owner or should be assessed as two<\/p>\n<p>buildings treating each residential apartment as a separate building in<\/p>\n<p>the name of the same owner. Considering the importance of the issue<\/p>\n<p>and the divergent opinions expressed by different Benches of this<\/p>\n<p>court, the Division Bench referred the matter for decision by Full<\/p>\n<p>Bench.     We have heard Government Pleader appearing for the<\/p>\n<p>appellant and counsel appearing for the respondent.<\/p>\n<p>      2. The learned Single Judge referred to a Single Bench judgment<\/p>\n<p>of this court in LALITHA VS. STATE OF KERALA reported in 1994<\/p>\n<p>(2) KLT 66 and held that since there is no provision for clubbing plinth<\/p>\n<p><span class=\"hidden_text\">W.A. 1262\/2009                      2<\/span><\/p>\n<p>areas of different buildings under common ownership for the<\/p>\n<p>assessment of building tax, the building involved which is a single<\/p>\n<p>building with two residential apartments, cannot be assessed as one<\/p>\n<p>building. The question has to be considered with reference to the<\/p>\n<p>relevant provisions in the Kerala Building Tax Act, 1975 (hereinafter<\/p>\n<p>called &#8220;the Act&#8221;) which are extracted hereunder:\n<\/p>\n<blockquote><p>           S.2. Definitions:-\n<\/p><\/blockquote>\n<blockquote><p>           (e) &#8220;building&#8221; means a house, out-house, garage, or any<br \/>\n     other structure, or part thereof, whether of masonry, bricks,<br \/>\n     wood, metal or other material, but does not include any<br \/>\n     portable shelter or any shed constructed principally of mud,<br \/>\n     bamboos, leaves, grass or thatch or a latrine which is not<br \/>\n     attached to the main structure.\n<\/p><\/blockquote>\n<blockquote><p>           Explanation 1:- In the case of buildings constructed for<br \/>\n     providing housing accommodation for workers and their<br \/>\n     families residing in plantations, in pursuance of Section 15 of<br \/>\n     the Plantations Labour Act, 1951 (Central Act 69 of 1951) or<br \/>\n     buildings constructed under the Government of India<br \/>\n     Subsidised Housing Scheme for industrial workers, each part<br \/>\n     of   a   building    providing    or   intended   to   provide<br \/>\n     accommodation for a worker or a worker and his family shall<br \/>\n     be deemed to be a separate building.\n<\/p><\/blockquote>\n<blockquote><p>           Explanation 2:- Where a building consists of different<br \/>\n     apartments or flats owned by different persons and the cost of<br \/>\n     construction      of the building was met by all such persons<br \/>\n     jointly, each such apartment or flat shall be deemed to be a<br \/>\n     separate building.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">W.A. 1262\/2009                      3<\/span><\/p>\n<blockquote><p>           (k) &#8220;plinth area&#8221; means the area included in the floor of<br \/>\n     a building and where a building has more than one floor the<br \/>\n     aggregate area included in all the floors together:\n<\/p><\/blockquote>\n<blockquote><p>     Provided that in the case of a building referred to in the<br \/>\n     Explanation 2 to clause (e), the plinth area shall be calculated<br \/>\n     separately.\n<\/p><\/blockquote>\n<blockquote><p>     S.5. Charge of building tax:- (1) Subject to the other<br \/>\n     provisions contained in this Act, there shall be charged a tax<br \/>\n     (hereinafter referred to as &#8220;building tax&#8221;) based on the plinth<br \/>\n     area at the rate specified in the Schedule on every building<br \/>\n     the construction of which is completed on or after the<br \/>\n     appointed day.\n<\/p><\/blockquote>\n<blockquote><p>     S.7. Return of completion, etc., of building:- (1) The owner of<br \/>\n     every building the construction of which is completed, or to<br \/>\n     which major repair or improvement is made on or after the<br \/>\n     appointed day shall furnish to the assessing authority a return<br \/>\n     in the prescribed form within the prescribed period along with<br \/>\n     a copy of the plan approved by the local authority or such<br \/>\n     other authorities as may be specified by the Government in<br \/>\n     this behalf and verified in the prescribed manner and<br \/>\n     containing such particulars as may be prescribed.\n<\/p><\/blockquote>\n<blockquote><p>     S.9. Assessment:- (1) If the assessing authority is satisfied<br \/>\n     that a return made by an owner under Section 7 or Section 8<br \/>\n     is correct and complete, it shall assess the amount payable by<br \/>\n     him as building tax or luxury tax on the basis of the return.&#8221;\n<\/p><\/blockquote>\n<p>What is clear from the above provisions is that the subject matter of<\/p>\n<p>assessment is the building and the person to be assessed is the owner<\/p>\n<p>and the basis of assessment is the plinth area of the building. The<\/p>\n<p><span class=\"hidden_text\">W.A. 1262\/2009                     4<\/span><\/p>\n<p>charging section makes it clear that the charge of tax is on the plinth<\/p>\n<p>area of every building constructed after the appointed day. Section 7<\/p>\n<p>makes it mandatory that the owner of every building the construction<\/p>\n<p>of which or the major improvement to which is made on or after the<\/p>\n<p>appointed day, shall furnish to the officer a return in the prescribed<\/p>\n<p>form for the purpose of assessment. Section 9 says that if return is<\/p>\n<p>correct and complete, the Assessing Officer shall complete assessment<\/p>\n<p>based on return filed. What is clear from these provisions is that<\/p>\n<p>assessment has to be completed for each and every building<\/p>\n<p>constructed and for this purpose, the owner of the building should file<\/p>\n<p>as many returns as the number of buildings he has constructed.<\/p>\n<p>Therefore, separate building tax assessments have to be made in the<\/p>\n<p>name of very same person for all the buildings constructed or repaired<\/p>\n<p>by him which attract liability. Since the charging section specifically<\/p>\n<p>speaks about levy of tax based on the plinth area of every building<\/p>\n<p>constructed, separate assessment is called for in the name of the same<\/p>\n<p>owner for the plinth area of every building constructed by him. In the<\/p>\n<p>scheme under the Central Income Tax Act, charge of tax is on the total<\/p>\n<p><span class=\"hidden_text\">W.A. 1262\/2009                     5<\/span><\/p>\n<p>income of a person from all sources and under all heads which are<\/p>\n<p>clubbed together for assessment.      However, for the purpose of<\/p>\n<p>assessment of building tax, there is no provision in the Act to make<\/p>\n<p>only single assessment for every financial year in respect of plinth area<\/p>\n<p>of all buildings constructed by a person.      In the absence of any<\/p>\n<p>provision in the Act authorising clubbing of plinth areas of different<\/p>\n<p>buildings or common assessment in the hands of a single person for all<\/p>\n<p>buildings constructed by him, there cannot be single building tax<\/p>\n<p>assessment for all the buildings constructed by him. So much so, the<\/p>\n<p>statutory scheme authorises separate assessment for each and every<\/p>\n<p>building in the name of the same owner. In other words, same person<\/p>\n<p>can be subject to separate assessment for building tax for each and<\/p>\n<p>every building constructed by him. This proposition of course applies<\/p>\n<p>to independent buildings constructed by a man. However, the question<\/p>\n<p>to be considered is whether this principle laid down in the decision in<\/p>\n<p>LALITHA VS. STATE OF KERALA referred above and followed by<\/p>\n<p>the learned Single Judge applies for assessment of two flats or multi-<\/p>\n<p>flat apartment building constructed and owned by the same person.<\/p>\n<p><span class=\"hidden_text\">W.A. 1262\/2009                      6<\/span><\/p>\n<p>      3. The question above referred has to be answered with reference<\/p>\n<p>to the definitions of &#8220;building&#8221; and &#8220;plinth area&#8221; which is the basis of<\/p>\n<p>charge under the charging section.      &#8220;Building&#8221; as defined under the<\/p>\n<p>main clause (e) of Section 2 covers all buildings in the literal sense and<\/p>\n<p>besides it, it includes every structure or part of a building. The plinth<\/p>\n<p>area which is the basis of assessment under Section 2(k), takes in the<\/p>\n<p>floor area of the building and where the building has more than one<\/p>\n<p>floor, the aggregate area included in all the floors have to be taken<\/p>\n<p>together. In other words, if a building owned by the person consists of<\/p>\n<p>several floors, the same has to be assessed as a single unit and the<\/p>\n<p>assessment has to be on the total plinth area of the building. Going by<\/p>\n<p>the definition of &#8220;building&#8221; contained in Section 2(e) read with<\/p>\n<p>definition of &#8220;plinth area&#8221; under Section 2(k) and the charging section,<\/p>\n<p>Section 5, a multi-storied building or a building with different<\/p>\n<p>residential or commercial apartments has to be assessed as a single unit<\/p>\n<p>on the total plinth area which include the plinth area of all the floors of<\/p>\n<p>the building. However, the assessment has to be necessarily in the<\/p>\n<p>name of the owner or owners of the building, if it is jointly owned by<\/p>\n<p><span class=\"hidden_text\">W.A. 1262\/2009                     7<\/span><\/p>\n<p>several persons. Two exceptions are provided in the Act against single<\/p>\n<p>assessment of multi-flat apartment, whether residential or commercial.<\/p>\n<p>Explanation (1) of Section 2(e) deals with assessment of buildings<\/p>\n<p>constructed for providing accommodation to workers and their families<\/p>\n<p>residing in plantations and also buildings constructed under the<\/p>\n<p>Government of India Subsidised Housing Scheme for industrial<\/p>\n<p>workers.     In the case of these buildings, each part of the building<\/p>\n<p>providing or intended to provide accommodation for a worker or<\/p>\n<p>family of a worker shall be deemed to be a separate building. In other<\/p>\n<p>words, but for this exception, even though a building with several<\/p>\n<p>residential units providing accommodation to different workers or<\/p>\n<p>families of different workers is assessable as a single building under<\/p>\n<p>the main clause Section 2(e), the fiction available under Explanation 1<\/p>\n<p>of Section 2(e) provides for treatment of each such residential unit<\/p>\n<p>within a building as a separate building for assessment. In other<\/p>\n<p>words, but for this exception even apartment buildings, whether line<\/p>\n<p>buildings or multi-storied buildings providing accommodation to<\/p>\n<p>employees in plantations or industries, would have been assessed as a<\/p>\n<p><span class=\"hidden_text\">W.A. 1262\/2009                      8<\/span><\/p>\n<p>single building in the name of the owner-employer. The second<\/p>\n<p>exception providing for separate assessment of different flats or<\/p>\n<p>apartments in the same building are those buildings constructed by<\/p>\n<p>several persons sharing the cost of construction and owning the<\/p>\n<p>building as flats or apartments among themselves.        Here again, the<\/p>\n<p>exception provides for separate assessment of each flat or apartment of<\/p>\n<p>a multi-flat or multi-apartment building in the name of each owner of<\/p>\n<p>the flat or apartment.   It is very common that several persons pool<\/p>\n<p>their resources and construct buildings for commercial or residential<\/p>\n<p>purposes and share the building       each one taking separate flat or<\/p>\n<p>apartment.     By virtue of the provision contained in Explanation 2,<\/p>\n<p>each and every apartment or flats comprised in the single building<\/p>\n<p>constructed by sharing the cost of construction by the several owners<\/p>\n<p>jointly shall be deemed to be separate buildings for assessment.      If<\/p>\n<p>the Explanation was not there in the statute, the building consisting of<\/p>\n<p>different apartments or flats owned by several persons and constructed<\/p>\n<p>by sharing the cost would have been assessed as a single building<\/p>\n<p>under the main clause (e) in the joint names of all of them.<\/p>\n<p><span class=\"hidden_text\">W.A. 1262\/2009                     9<\/span><\/p>\n<p>      4. What is clear from the above provision is that a building<\/p>\n<p>irrespective of the number of flats or apartments contained therein,<\/p>\n<p>should be assessed as a single unit and the exceptions are only those<\/p>\n<p>stated in Explanations 1 and 2 stated above. A Division Bench of this<\/p>\n<p>court in SHENOY REAL ESTATES (P) LTD. VS. TAHSILDAR<\/p>\n<p>reported in 2004(1) KLT 133 held that sale of flats by a builder after<\/p>\n<p>completion of construction of apartment building to different owners<\/p>\n<p>will not justify separate assessment of each flat under Explanation (2)<\/p>\n<p>to Section 2(e) of the Act. What is to be noted from this judgment is<\/p>\n<p>that unless apartment building is constructed by the joint owners by<\/p>\n<p>sharing the cost, each and every apartment cannot be assessed as a<\/p>\n<p>separate building, no matter the building after construction was sold by<\/p>\n<p>the owner to different persons. In this case different ownership for the<\/p>\n<p>building happens after completion of construction of the building and,<\/p>\n<p>the sale made thereafter to different owners is immaterial for the<\/p>\n<p>purpose of assessment. In fact, the incidence of tax is on completion<\/p>\n<p>of construction of the building and it is immaterial as to whether the<\/p>\n<p>owner retains the building or transfers the same in full or in part or in<\/p>\n<p><span class=\"hidden_text\">W.A. 1262\/2009                      10<\/span><\/p>\n<p>pieces after completion of construction. Separate assessment of each<\/p>\n<p>and every flat is called for only in respect of the constructions covered<\/p>\n<p>by Explanations (1) and (2) of Section 2(e).\n<\/p>\n<p>      5. In the result and in view of our findings above, we hold that<\/p>\n<p>the single building consisting of two separate flats constructed by the<\/p>\n<p>respondent has to be assessed as a single building as the building does<\/p>\n<p>not fall within the Explanation (1) or (2) of Section 2(e).
