Justice S.S.SATHEESACHANDRAN\n\n Dated :08\/09\/2010\n\n O R D E R\n            S.S.SATHEESACHANDRAN, J.\n          ---------------------------------------\n              R.S.A.No.1052 of 2010\n          ---------------------------------------\n       Dated this the 8th day of September, 2010\n\n                      JUDGMENT\n<\/pre>\n<p>         Plaintiff is the appellant.             Plaintiff<\/p>\n<p>is operating a Milma Booth at Thakaraparambu,<\/p>\n<p>within  the    limits     of    City     Corporation    of<\/p>\n<p>Thiruvananthapuram.        The defendant, the City<\/p>\n<p>Corporation,   proceeded      against      the   plaintiff<\/p>\n<p>since no licence was obtained for operating the<\/p>\n<p>booth. Plaintiff approached the court and filed a<\/p>\n<p>suit for injunction to restrain the defendant<\/p>\n<p>from interfering with the operation of the booth,<\/p>\n<p>to enable him to run the booth smoothly.<\/p>\n<p>         2. The trial court dismissed the suit<\/p>\n<p>which was confirmed in appeal by                the first<\/p>\n<p>appellate court.      Challenge in this appeal is<\/p>\n<p>against the concurrent decision so rendered by<\/p>\n<p>the courts below.\n<\/p>\n<p>R.S.A.No.1052 of 2010<\/p>\n<p>                      :: 2 ::\n<\/p>\n<\/p>\n<p>          3.  At   the time   of  hearing on the<\/p>\n<p>admississibility   of  the   appeal,  the learned<\/p>\n<p>counsel for the appellant\/plaintiff sought for<\/p>\n<p>indulgence of the court to have some time to<\/p>\n<p>vacate from the building, submitting that the<\/p>\n<p>appellant is eking out his livelihood from the<\/p>\n<p>business  operated   in  the  booth.  The learned<\/p>\n<p>counsel for the respondent has no objection in<\/p>\n<p>granting   reasonable    time,   subject  to  an<\/p>\n<p>undertaking given by the appellant to remove his<\/p>\n<p>goods and vacate the booth, within the time<\/p>\n<p>extended by this court.\n<\/p>\n<p>          4. Considering the submissions made as<\/p>\n<p>above, upholding the decree passed by the court<\/p>\n<p>below, a period of three months is granted     to<\/p>\n<p>the appellant for removing his goods and vacating<\/p>\n<p>the booth, on condition of the appellant filing<\/p>\n<p>an undertaking in writing before the court below,<\/p>\n<p>within a period of three weeks from today, that<\/p>\n<p>R.S.A.No.1052 of 2010<\/p>\n<p>                          :: 3 ::\n<\/p>\n<p>\nhe shall unconditionally remove his goods and<\/p>\n<p>vacate the booth within three months from today.<\/p>\n<p>In the event of default by the appellant to<\/p>\n<p>furnish   undertaking     within    three weeks, the<\/p>\n<p>period of extension will not be available to him.<\/p>\n<p>If undertaking is given as directed, and in the<\/p>\n<p>event  of     violation    to    surrender after the<\/p>\n<p>extended period, the Corporation can remove the<\/p>\n<p>unauthorised booth, in accordance with law.<\/p>\n<p>          Second appeal is disposed of as above.<\/p>\n<p>                                     Sd\/-\n<\/p>\n<p>                           (S.S.SATHEESACHANDRAN)<br \/>\n                                     JUDGE<br \/>\nsk\/-\n<\/p>\n<blockquote><p>          \/\/true copy\/\/<\/p>\n<p>               P.S. to Judge.<\/p>\n<\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court P.Sreekantan Nair vs City Corporation on 8 September, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM RSA.No. 1052 of 2010() 1.
