RUDAKIYA - Respondent(s)\n \n\n=========================================================\n \nAppearance\n: \nMR\nLB DABHI, LD.ASST.GOVERNMENT PLEADER\nfor\nPetitioner(s) : 1 - 2. \nRULE NOT RECD BACK for Respondent(s) :\n1, \nMR MUKESH H RATHOD for Respondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE KS JHAVERI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 09\/08\/2010\n \n\nORAL\nORDER<\/pre>\n<p>\tBy<br \/>\n\tway of present petition, the petitioner has inter alia prayed for<br \/>\n\tquashing and setting aside the judgment and award dated 06th<br \/>\n\tJune 2008 passed by the Labour Court, Rajkot in Reference (LCR)<br \/>\n\tNo.1461 of 1988, whereby the Labour Court rejected the Reference of<br \/>\n\tthe petitioner.\n<\/p>\n<p>It<br \/>\n\tis the case of the petitioner that the respondent was working as<br \/>\n\tJunior Clerk purely on temporary, ad-hoc and daily wage basis and<br \/>\n\this appointment was for a fixed period.  After expiry of such<br \/>\n\tperiod, the respondent was discontinued from service and thus, it<br \/>\n\tcannot be said to be retrenchment. It is submitted that the<br \/>\n\tprovision of Section 2(OO)(bb) is not applicable in the present<br \/>\n\tcase. It is submitted that the Division in which the respondent was<br \/>\n\tworking is already closed.  It is submitted that there was no<br \/>\n\tevidence before the Labour<br \/>\n\tCourt that the respondent has completed 240 days of service.<br \/>\n\tThe Labour Court<br \/>\n\thas also erred in granting 25% backwages. Thus, the judgment and<br \/>\n\taward passed by the Labour<br \/>\n\tCourt is required to be quashed and set aside.\n<\/p>\n<p>\tMr.Mukesh<br \/>\n\tH. Rathod, learned advocate for the respondent, has submitted that<br \/>\n\tthe  judgment and  award passed by the Labour Court is just and<br \/>\n\tproper and the same is passed after taking into consideration the<br \/>\n\tpros and cons of the matter as well as evidence produced on record.<br \/>\n\tHence, the present petition is required to be dismissed.\n<\/p>\n<p>\tHaving<br \/>\n\tregard to the rival contentions raised by the learned advocates for<br \/>\n\tthe respective parties, averments made in the petition as well as<br \/>\n\tthe documentary evidence produced on record, it transpires that the<br \/>\n\tLabour Court has appreciated the evidence on record and after going<br \/>\n\tthrough the pros and cons of the matter, it has rightly granted<br \/>\n\treinstatement with continuity of service as there was a breach of<br \/>\n\tprovisions of Sections 25(F), 25(G) and 25(H) as well as Section 81<br \/>\n\tof the Industrial Disputes Act, 1947. The view taken by the Labour<br \/>\n\tCourt qua reinstatement and continuity of service is absolutely just<br \/>\n\tand proper.\n<\/p>\n<p>\t\tInsofar<br \/>\n\tas granting of backwages is concerned, it is required to be noted<br \/>\n\tthat when the respondent-workman has not worked at all, there is no<br \/>\n\tquestion of granting him any backwages. Even the Apex Court in the<br \/>\n\trecent decision has laid down a ratio  no work, no pay . Thus,<br \/>\n\tthe Labour Court has erred in granting backwages to the respondent<br \/>\n\tlooking to the facts and circumstances of the case.\n<\/p>\n<p>\tIn<br \/>\n\tview of aforesaid, I am of the opinion that the judgment and award<br \/>\n\tqua reinstatement and continuity of service is required to be<br \/>\n\tupheld. However, so far as the judgment and award qua backwages is<br \/>\n\tconcerned, the same is required to be quashed and set aside.\n<\/p>\n<p>For<br \/>\n\tthe foregoing reasons, present petition is hereby partly allowed.<br \/>\n\tThe impugned judgment and award dated 06th June 2006<br \/>\n\tpassed by the Labour Court, Rajkot in Reference (LCR) No.1461 of<br \/>\n\t1988 is hereby quashed and set aside only qua 25% backwages. The<br \/>\n\timpugned judgment and award qua reinstatement and continuity of<br \/>\n\tservice is hereby upheld.  Rule is made absolute to the aforesaid<br \/>\n\textent. No order as to costs.\n<\/p>\n<p>\tThe<br \/>\n\tpetitioner is directed to reinstate the respondent-workman on or<br \/>\n\tbefore 01st<br \/>\n\tOctober 2010.\n<\/p>\n<p>\tThe ensuing monetary benefits will be released by the petitioner in<br \/>\n\tfavour of the respondent within a period of SIX<br \/>\n\tMONTHS<br \/>\n\tfrom today. The respondent is entitled to get benefits from the date<br \/>\n\tof award till its actual realisation.
