No. 3580 of 2010\n                ................................................\n                   Dated: 2nd December, 2010\n\n                                 O R D E R\n<\/pre>\n<p>      In this Revision Petition filed under Section 397 read with<\/p>\n<p>Sec. 401       Cr.P.C. the petitioner who was the accused<\/p>\n<p>in    S.T. No. 871 of 2006 on the file of the J.F.C.M.<\/p>\n<p>IX, Thiruvananthapuram            challenges the conviction entered<\/p>\n<p>and the sentence passed against him for an offence punishable<\/p>\n<p>under     Sec. 138 of the Negotiable Instruments Act, 1881<\/p>\n<p>(hereinafter referred to as &#8216;the Act&#8217;). The cheque amount was `<\/p>\n<p>3,00,000\/-.      The        fine\/compensation ordered by the lower<\/p>\n<p>appellate court is ` 3,05,000\/-.\n<\/p>\n<p>      2.    I heard the learned counsel for the Revision Petitioner<\/p>\n<p>and the learned Public Prosecutor.\n<\/p>\n<p>      3.    The learned counsel appearing for the Revision<\/p>\n<p>Petitioner re-iterated the contentions in support of the Revision.<\/p>\n<p>      4.     The courts below have concurrently held that the<\/p>\n<p>cheque in question was drawn by the petitioner in favour of the<\/p>\n<p>complainant, that the complainant had validly complied with<\/p>\n<p>clauses (a) and (b) of the proviso to Section 138 of the Act.<\/p>\n<p>and that the Revision Petitioner\/accused failed to make the<\/p>\n<p><span class=\"hidden_text\">Crl.R..P. No. 3580 of 2010          -:2:-<\/span><\/p>\n<p>payment within 15 days of receipt of the statutory notice.        Both<\/p>\n<p>the courts have considered and rejected the defence set up by<\/p>\n<p>the revision petitioner while entering the conviction.        The said<\/p>\n<p>conviction has been recorded after a careful evaluation of the<\/p>\n<p>oral and documentary evidence. This Court sitting in the rarefied<\/p>\n<p>revisional jurisdiction will be loath to interfere with the findings of<\/p>\n<p>fact recorded by the Courts below concurrently.           I do not find<\/p>\n<p>any error, illegality or impropriety in the conviction so recorded<\/p>\n<p>concurrently by the courts below and the same is hereby<\/p>\n<p>confirmed.\n<\/p>\n<p>       5.      What now survives for consideration is the legality of<\/p>\n<p>the sentence imposed on the revision petitioner.             No doubt,<\/p>\n<p>now after the decision of the            Apex      Court in <a href=\"\/doc\/1806949\/\">Vijayan v.<\/p>\n<p>Sadanandan           K. and Another<\/a>       (2009)    6 SCC    652   it is<\/p>\n<p>permissible for the Court           to slap     a default sentence    of<\/p>\n<p>imprisonment while awarding compensation under Sec. 357 (3)<\/p>\n<p>Cr.P.C.        But,    in that event, a sentence of imprisonment will<\/p>\n<p>be inevitable. I am, however, of the view that in the facts and<\/p>\n<p>circumstances of this case              a sentence of fine     with an<\/p>\n<p>appropriate default sentence          will suffice. Accordingly, for the<\/p>\n<p>conviction under Section 138 of the Act the revision petitioner is<\/p>\n<p>sentenced to pay a fine of ` 3,07,000\/-. (Rupees three lakh<\/p>\n<p>seven thousand only).              The said      fine shall be paid as<\/p>\n<p>compensation under Section 357 (1) Cr.P.C.                 The revision<\/p>\n<p>petitioner is permitted either to deposit the said fine amount<\/p>\n<p><span class=\"hidden_text\">Crl.R..P. No. 3580 of 2010          -:3:-<\/span><\/p>\n<p>before the Court below or directly pay the compensation to the<\/p>\n<p>complainant within six           months from today and produce a<\/p>\n<p>memo to that effect before the trial Court in case of direct<\/p>\n<p>payment. If he fails to deposit or pay the said amount within<\/p>\n<p>the aforementioned period he shall suffer simple imprisonment<\/p>\n<p>for three months by way of default sentence.<\/p>\n<p>       6.     The petitioner shall be released from prison<\/p>\n<p>unless his continued             detention is found necessary in<\/p>\n<p>connection with any other case. However, his release shall<\/p>\n<p>be subject to his liability to pay the above said amount.<\/p>\n<p>       7.     In the result, this Revision is disposed of confirming<\/p>\n<p>the conviction entered but modifying the sentence imposed on<\/p>\n<p>the revision petitioner.\n<\/p>\n<p>       Dated this the 2nd day of December, 2010.\n<\/p>\n<\/p>\n<p>                                        Sd\/-V.
