 _x;}’ez1der of the plaintiff one Smt. Iravva Benni on a monthly<\/p>\n
  rent of R3500\/-\u00ab. Since the respondent stopped payment of<\/p>\n
rent, HRC No.3\/21300 was \ufb01led by the respondent and the<\/p>\n

same was dismissed as abated in View of the repeal of the<\/p>\n
Karnataka Rent Control Act, 1961 and coming into &;;1+\u00a7{“qr<\/p>\n
the Karnataka Rent Act, 1999 and though the dcrega\u00a2n;g’:\u00a7’\u00a2\u00e9;’s’ <\/p>\n
served with legal notice, he neither mplied  Z  K   I<\/p>\n

3. In pursuance to the _\u00a7_10tjce,V_\u00bbissued .  tire trial<\/p>\n
Court, the defendant th;~cxi;g);Ai,\u00a7m;;;se1 and \ufb01led
\nwritten statement _eontendi3\u00a7g:~.   ‘  had no<\/p>\n
absolute  ”   _o1.’r’\u00a3V:\u00a5*’ vthe suit property and
\ndenied  the plaint and sought for
\ndismissalvof   A VA :\n<\/p>\n
‘  E :4; .   trial Judge, after considering the<\/p>\n
   con.f.e3;_\u00a7tA3:1$  parties and the oral and documentary<\/p>\n
  \u00e9v_i(1cnce \u00bbo\u00a71:.recont decreed the suit of the plain\ufb01\ufb01 directing<\/p>\n
   fi\u00e9fcndant to hand over the vacant possession of the suit<\/p>\n
 and also directed to pay a sum of Rs.18,000\/–<\/p>\n
‘V V   ‘4″t9\u00a7\u00a7?a1\ufb02s arrears of rent to the plaintiff. Being aggzicved by<\/p>\n
the said judgment and decree, the defendant-appellant
\npreferred R.A.No. 16\/ 2007 and the learned Civil J11dgc(Scnior<\/p>\n
Division), Dharwad, by order dated 05\/09] $008 dismissed<\/p>\n
the appeal by con\ufb01rming the judgment and decree <\/p>\n

j  under a registered sale deed dated 29\/12\/1997<\/p>\n

the respondent had \ufb01led eviction petitcn in HRC No.3] 2000<\/p>\n

10. Duzing the course of arguments, the counsel for<\/p>\n

armaxs of rent of Rs.18,000\/- before the txial Court. The<\/p>\n
learned counsel appearing for the appellant submitted that<\/p>\n
the respondent herein has owned a business premises of his<\/p>\n
own and to shift the business from the schedule <\/p>\n
his own premise, he requires some more time  <\/p>\n
granted by the lower appellate Court, themfore__it_’isV    b <\/p>\n
proper to grant reasonable time  <\/p>\n
and hand over the Vacant  of    ‘V  L\u00bb<\/p>\n
premises to the reepondent-decitttegholder.   ‘<\/p>\n
