Sharma, Central Government<br \/>\n                    Standing Counsel, for the respondents.<\/p>\n<pre>                                  .       .      .\n\nAJAI LAMBA, J (Oral)\n\n                    This     civil            writ    petition       filed      under\n\n<\/pre>\n<p>Article 226\/227 of the Constitution of India prays for<\/p>\n<p>issuance   of   a   writ     in       the      nature       of    certiorari      for<\/p>\n<p>quashing Order dated 30.5.2007 (Annexure P-3). Vide the<\/p>\n<p>impugned   order,        claim       of   the        petitioner      for     special<\/p>\n<p>family pension has been rejected.\n<\/p>\n<p>                    It     transpires                that    husband       of    the<\/p>\n<p>petitioner died on 28.4.2005 on account of heart-attack<\/p>\n<p>(Acute Myocardial Infarction) while on annual leave. In<\/p>\n<p>the impugned order, it has been stated that the death was<\/p>\n<p>not in any way related to duties of military service and<\/p>\n<p>being    not    attributable              to     military          service,       the<\/p>\n<p>petitioner is not entitled to special family pension. The<\/p>\n<p>petitioner was given the right to file an appeal before<br \/>\n CWP No.13809 of 2008                                           [2]<\/p>\n<p>the Appellate Committee. It seems that the petitioner did<\/p>\n<p>file an appeal as is evident from Annexure P-4.<\/p>\n<p>                   Learned counsel for the petitioner states<\/p>\n<p>that during the pendency of the writ petition, the appeal<\/p>\n<p>has been decided on 20.1.2009, however, the order has<\/p>\n<p>been conveyed vide a single line order in the following<\/p>\n<p>terms:-\n<\/p>\n<blockquote><p>                                         &#8220;Second Appeal<\/p>\n<\/blockquote>\n<blockquote><p>                   1.     Reference Government of India, Ministry of Defence,<br \/>\n                   letter No.2(116)\/2007\/D (Pen.
