Kanabar, learned counsel appearing for the applicant and<br \/>\n\tShri P.D. Bhate, learned Additional Public Prosecutor, appearing on<br \/>\n\tbehalf of the opponent-State.\n<\/p>\n<p>Rule.\n<\/p>\n<p>\tThe formal service of notice of Rule is waived by Shri P.D. Bhate,<br \/>\n\tlearned Additional Public Prosecutor, on behalf of opponent-State.<br \/>\n\tThe Rule is fixed forthwith on consent.\n<\/p>\n<p>It<br \/>\n\tis submitted by Shri P.J. Kanabar that today this Court has admitted<br \/>\n\tthe appeal preferred by the present applicant against the judgment<br \/>\n\tand order of conviction and sentence passed by the learned<br \/>\n\tAdditional Sessions Judge and Special Judge, Banaskantha-Deesa in<br \/>\n\tSessions Case NO.114 of 2005. It is further submitted that the<br \/>\n\tapplicants were on bail pending trial and they have been again<br \/>\n\tenlarged on bail by the learned trial Judge  by exercising<br \/>\n\tdiscretion under Section 389 of the Code of Criminal Procedure, 1973<br \/>\n\tand therefore, at present they are enjoying bail.  So this is a fit<br \/>\n\tcase where this Court may exercise discretion considering the<br \/>\n\tquantum of punishment imposed by the learned trial Judge for the<br \/>\n\toffence punishable under Section 307 of the Indian Penal Code. The<br \/>\n\tissuance of notice for enhancement would not come in the way of the<br \/>\n\tapplicants in getting the discretionary relief.\n<\/p>\n<p>So<br \/>\n\thaving considered the totality of facts and circumstances of case,<br \/>\n\tincluding the fact the the applicants were on bail pending trial and<br \/>\n\tthey has been released on bail even after conviction and the fact<br \/>\n\tthat the amount of fine has been paid, the present application is<br \/>\n\thereby allowed. The substantive sentence is hereby placed under<br \/>\n\tsuspension pending hearing and disposal of the main appeal and the<br \/>\n\tapplicants-orig.convicts are hereby ordered to be released on bail<br \/>\n\ton each of them furnishing a<br \/>\n\tsolvent surety of Rs.10,000\/- (Rupees Ten Thousand only) and<br \/>\n\ta personal bond of the like amount by each of them on usual<br \/>\n\tconditions. Over and above the usual conditions, the applicants<br \/>\n\tshall abide by the following conditions that the applicants :\n<\/p>\n<blockquote><p>\t\t\t\tshall<br \/>\n\t\t\t\tnot involve themselves in any other or similar offence;\n<\/p><\/blockquote>\n<blockquote><p>\t\t\t\tshall<br \/>\n\t\t\t\tnot leave the territory of State of Gujarat without prior<br \/>\n\t\t\t\tpermission of this Court;\n<\/p><\/blockquote>\n<blockquote><p>\t\t\t\tshall<br \/>\n\t\t\t\tsurrender their passport, if any, before the concerned trial<br \/>\n\t\t\t\tCourt.\n<\/p><\/blockquote>\n<p>It<br \/>\n\tis further clarified that if there is breach of any of the aforesaid<br \/>\n\tconditions by any of the applicants, the learned trial Judge shall<br \/>\n\tissue a non-bailable warrant against the concerned applicants.\n<\/p>\n<p>Bail<br \/>\n\tbefore the trial Court.
