Ultimately, the disciplinary authority imposed the<br \/>\n\tpunishment of stoppage of three increments with permanent effect,<br \/>\n\twhich ultimately came to be increased  to putting him to his<br \/>\n\toriginal pay scale by the Reviewing Authority.\n<\/p>\n<p>Against<br \/>\n\tthe said order of dismissal, the respondent raised a dispute, which<br \/>\n\twas referred to the Industrial Tribunal, Vadodara. The Tribunal,<br \/>\n\tafter hearing both the sides, allowed the reference partly by way of<br \/>\n\tthe impugned award. Hence, this petition.\n<\/p>\n<p>Heard<br \/>\n\tlearned counsel for the respective parties and perused the documents<br \/>\n\ton record. The respondent was found guilty of serious irregularity \/<br \/>\n\tmisconduct on different occasions in the past. Of these defaults,<br \/>\n\tmany defaults related to incidents of similar nature. In spite of<br \/>\n\tbeing found guilty of similar defaults in the past, the respondent<br \/>\n\tdid not improve his behaviour and continued to commit such<br \/>\n\tmisconduct, which is highly unbecoming of a public servant.\n<\/p>\n<p>Looking<br \/>\n\tto the facts of the case and the past record of the respondent, I am<br \/>\n\tof the opinion that the Labour Court has rightly substituted the<br \/>\n\torder of punishment imposed by the Reviewing Authority and confirmed<br \/>\n\tthe order passed by the Disciplinary Authority in exercising of<br \/>\n\tpowers under Section 11(A) of the Act.  In<br \/>\n\tview of aforesaid, the view taken by the Tribunal is just and<br \/>\n\tproper. The Tribunal has assigned cogent and convincing reasons for<br \/>\n\tarriving at the conclusion. I do not find any illegality much less<br \/>\n\tany perversity in the findings recorded by the Tribunal. No case is<br \/>\n\tmade out to interfere with the findings recorded by the Tribunal.<br \/>\n\tHence, present petition deserves to be dismissed.\n<\/p>\n<p>For<br \/>\n\tthe foregoing reasons, present petition fails and is, accordingly,<br \/>\n\tdismissed. The impugned judgment and award to be implemented<br \/>\n\twithin a period of seven months from today. Rule is<br \/>\n\tdischarged with no order as to costs.
