FAA directed the PIO to\nprovide complete information to the Appellant within 20 days.\n\nGrounds for Second Appeal:\nInformation not provided till date.\n\nRelevant Facts<\/pre>\n<p> that emerged during the Hearing on 26 May 2010:\n<\/p>\n<p>&#8220;The following were present:\n<\/p>\n<p>Appellant: Absent;\n<\/p>\n<p>Respondent: Mr. Ajit Singh, FSO-7 on behalf of Mr. Chokhe Lal, PIO &amp; AC;\n<\/p>\n<p>        The Respondent has not given the progress of the application as sought by the Appellant.<br \/>\nEven after the order of the FAA some information has been provided on 11\/04\/2010 but it still<br \/>\ndoes not answer the queries of the progress of the application of the appellant. When the<br \/>\nCommission questioned the respondent why he had not provided the dates on which various<br \/>\nactions were taken on the applications, he gave evasive replies and claimed that the approval for<br \/>\ngetting kerosene had now been provided to the Appellant hence nothing survives in the RTI<br \/>\nApplication. Since the respondent has not yet supplied the information sought in the RTI<br \/>\nApplication he appears to be responsible for not providing the information to the Appellant so<br \/>\nfar. &#8221;\n<\/p>\n<p>Commission&#8217;s Decision dated 26 May 2010:\n<\/p>\n<p>&#8220;The appeal is allowed.\n<\/p>\n<p>        The Deemed PIO Mr. Ajit Singh is directed to provide the complete information sought<br \/>\nby the appellant before 05 June 2010.\n<\/p>\n<p>The issue before the Commission is of not supplying the complete, required information by<br \/>\nthe deemed PIO Mr. Ajit Singh within 30 days as required by the law.<br \/>\nFrom the facts before the Commission it is apparent that the deemed PIO is guilty of not<br \/>\nfurnishing information within the time specified under sub-section (1) of Section 7 by not<br \/>\nreplying within 30 days, as per the requirement of the RTI Act. He has further refused to obey<br \/>\nthe orders of his superior officer, which raises a reasonable doubt that the denial of information<br \/>\nmay also be malafide. The First Appellate Authority has clearly ordered the information to be<br \/>\ngiven.\n<\/p>\n<p>It appears that the deemed PIO&#8217;s actions attract the penal provisions of Section 20 (1). A<br \/>\nshowcause notice is being issued to him, and he is directed give his reasons to the Commission to<br \/>\nshow cause why penalty should not be levied on him. Mr. Ajit Singh will present himself before<br \/>\nthe Commission at the above address on 10 June 2010 at 2.30pm alongwith his written<br \/>\nsubmissions showing cause why penalty should not be imposed on him as mandated under<br \/>\nSection 20 (1). He will also submit proof of having given the information to the appellant.\n<\/p>\n<p><span class=\"hidden_text\">                                                                                       Page 2 of 3<\/span><\/p>\n<p> If there are other persons responsible for the delay in providing the information to the<br \/>\nAppellant the PIO is directed to inform such persons of the show cause hearing and direct<br \/>\nthem to appear before the Commission with him.&#8221;\n<\/p>\n<p>Relevant facts emerged during the showcause hearing on 10 June 2010:<br \/>\n&#8220;The following were present:\n<\/p>\n<p>Respondent: Mr. Ajit Singh, FSO-7 &amp; Deemed PIO; Mr. Pankaj Kumar, Inspector;\n<\/p>\n<p>        The Commission had given an order to the Deemed PIO Mr. Ajit Singh to provide the complete<br \/>\ninformation. He has not been able to bring the complete information even now since he states that the<br \/>\noriginal application of the appellant is in the Head Quarter. This is completely unacceptable and a clear<br \/>\ndefiance of the order of the Commission. The Commission under its powers under Section 18(3) of the<br \/>\nRTI Act is directing Mr. Ajit Singh to get all the documents required to provide the information to the<br \/>\nCommission on 21 June 2010 at 5.00PM. He will bring the complete information with him with all<br \/>\nsupporting documents. The Commission will decide on the penalty proceedings on the same day.\n<\/p>\n<p>Adjunct decision:\n<\/p>\n<p>     The Commission under its powers under Section 18(3) of the RTI Act is directing<br \/>\nMr. Ajit Singh to get all the documents required to provide the information to the<br \/>\nCommission on 21 June 2010 at 5.00PM.&#8221;\n<\/p>\n<p>Relevant facts emerging during showcause hearing on 21 June 2010:<br \/>\nThe following were present:\n<\/p>\n<p>Respondent: Mr. Ajit Singh, FSO-7 &amp; Deemed PIO; Mr. Pankaj Kumar, Inspector;\n<\/p>\n<p>        The Deemed PIO Mr. Ajit Singh states that no action has been taken on the application of the<br \/>\nappellant. In May 2010 action has been initiated and the change from Gas to Kerosene has been effective.<br \/>\nMr.Ajit Singh is directed to send this information alongwith file notings to the appellant before 30 June<br \/>\n2010. Mr. Ajit Singh has given an explanation that since there was no record available in the office hence<br \/>\nhe did not give the information earlier.
